Sub: Implementation of the CCS (Revised Pay) Rules 2008 – Reg.

Sir,

This is in continuation with our earlier letter No. nfaee/sg/08/123 and 125 regarding above mentioned subject. As we indicated in our earlier correspondence, the Resolution issued by the Central Government on 29th August 2008 and the notification promulgated subsequently contains number of discrepancies, anomalies, inequitable principle. As the discontentment among the employees are increasing day by day, in various area where these discrepancies exists such as in deriving minimum pay, multiple factor to derive the pay structure for various grades, matters pertaining to promotion, deviation of the existing ACP of the financial upgradation to grade hierarchy to pay hierarchy etc. We hope the department also agrees with the grievances already raised by the employees and will take up to the Government to resolve the same.

Through this letter we would like to bring to your attention that by implementing the Government notification to revise the pay based on the CCS (Revised Pay) Rules 2008, in DAE there certain issues are going to be create which will certainly to be addressed before issuing the DAE notification, other wise there shall be discontentment among the employees in almost all sections of employees. The major issues to be addressed at the earliest are briefly explained below:

I. Group D Employees:

a. If the Government upgraded the existing entry lowest scale of pay of Rs 2550 – 3540 to Rs 2750 – 4400, it would be a welcome step as it is upgradation. But now through the notification Government merged all existing scales of pay for Group D employees into Rs 2750 – 4400. The result of this decision shall be bringing Mali A, Helper A, Security Guard, Wash Boy, Ayah, Sweeper, Mali B/C, Helper B/C, Bearer, Tea/Coffee Maker, Mali D, Helper D, Head Security Guard etc into same existing pay scale of Rs 2750 – 4400. By doing so the senior most employees who is in service for more 15 years and got two or three promotions also bring back into the entry level.

b. Under this circumstance the Department has to take a decision to ensure to extend the equal number of the financial upgradation what they got from the feeder cadre prior to 01.01.2006.

II. Fixation in Merged scales: [CCS (Revised Pay) Rules, 2008 – Part C, section I (ii)]

a. In the notification it is given that the scales of pay Rs 5000 – 8000, Rs 5500 – 9000 and Rs 6500 – 10500 has been merged into one. In fact the Government has not merged these three scales, but created an elongated scale of Rs 5000 – 10500. This can be clear from the selection of initial pay for Pay Band from the existing pay of Rs 5000 – 8000 (5000 X 1.86) and selection of Grade Pay by calculating 40% of the ending pay of the scale of Rs 6500 – 10500 (10500 X 0.4). By doing so, the Government brought back those employees who got promotion from the scale of pay of Rs. 5000 – 8000 into the scales of Pay of Rs 5500 – 9000 and Rs 6500 – 10500 to the pay scale starts with Rs 5000. This is nothing but degradation and not upgrdataion or even merger.

b. These scales of pay is existing in all section of employees in auxiliary, administration & accounts, technical, purchase & stores and hence the discontentment shall be in all those categories of employees.

c. Hence the Department has to take steps to ensure the promotional benefits to the employees by ensuring the existence of grades as earlier by revising the existing scale of pay of Rs 5000 – 8000 with the Grade Pay of Rs 4200 and moving next grade in the scale of pay of Rs 5500 - 9000 into next grade pay and correspondingly upgrading other grades.

d. If the Department initiates to abolish any post in between, then the existing employees in that particular grade should be moved into the next higher grade and cascading effects should be given by moving the employees in those grades into next higher grade to ensure the seniority as well as the promotional benefits.

e. Under this circumstance, we request the Department not to take any hasty decision to replace the pay scales of various grades existing in the Department for various section/categories. We request that the Department should consider all aspects to protect the promotional benefits acquired by the employees on their merit. Therefore we request the Department to immediately issue instruction to calculate the arrears to be paid to employees in the corresponding pay scale as mentioned in the notification No F.No 1/1/2008 – IC, dated 30th August 2008 and accordingly give the arrears to the employees. Thereafter in consultation with the similar Department such as Department of Space, DRDO as well as with the representatives of the recognized Federation/ Unions and associations of this Department, the proper pay structure may evolve for all sections of employees and accordingly implement the same.

III. Other issues:

1. Assured Career Progression:

While recommending 3 Assured Career Progression (ACP) to those employees who spent ten years continuously in the same grade, the Government watered in the present ACP. As per the present ACP, The employee who completed 12 years in the same grade is eligible for financial upgradation equivalent to the pay in his next promotional post. But in the proposed ACP, the financial upgradation where the promotional post is not in next grade pay, while considering for ACP, the employee shall be given the financial upgradation in the next pay structure in pay hierarchy and when the employee will get the financial upgradation corresponding to his promotional post at the time regular promotion. By doing so, in certain case, the employee who gets two financial in the span of 24 years in the present system shall be better than the new financial upgradation in the span of thirty years. Hence the Department should be taken up this matter with the Government to ensure financial upgradation equivalent to the next promotional post.

2. Over Time Allowance:

In the Government notification it was mentioned that the recommendations related to Overtime Allowance will be examined separately. In this regard without prejudice to our demand after 5th Central Pay Commission, we would like to mention here that it is responsibility of the Department to ensure revision of Overtime Allowance of the employees who perform Overtime as per the requirement of the Operational, maintenance and to over come the other emergency situation in the R&D establishments of the Department as in the Industrial units. In this regard, the activities of the Department should be taken as Industrial activity as in the case of Railways. The Department should take care of notify the order pertaining to OTA for R&D and other establishments also along with Industrial units.

3. Patient Care Allowance & Risk Allowance:

In the Notification it is mentioned that the Hospital Patient Care Allowance/Patient Care Allowance and Risk allowance will replace with Risk Insurance Scheme with effect from 01.04.2009 after consultation with the Staff side. Here too the Department too takes up the matter with the Government to ensure to continue the Patient Care Allowance as well as Risk Allowance as their is no logic to extend Risk insurance to the employees who suffered fatal due to the risk involves in the infectious deceases and other risk in case of the hospital staff and risk involves where the risk allowances are recommended. Hence the Department should take efforts to ensure to retain the Patient Care Allowance as well as Risk Allowance as exists and the Risk Insurance may be introduced as an additional benefit.

4. Transport Allowance:

Since the Government removed the condition “one Kilometer and with in Campus” in the earlier order by which Transport Allowance was extended to the employees, majority of the employees may eligible for Transport allowance.

In DAE, retaining buses are mandatory as per the international laws and therefore drivers also. Using that facility, we request the Department to consider continuing the Transport Facility by working out a methodology with mutual consultation. It is pertinent to note here that, before the introduction of the Transport Allowance also, Department was plying buses to various part of the city in all DAE units, by charging minimal amount towards the fuel expenditure along with subsidy from the Department. In the present condition it may be possible, by working out the exact expenditure towards the fuel which can be deducted as certain % of the Transport Allowance from those employees using the Transport facility extended by the Department.

There are few more anomalies/discrepancies while implementing the Government Notification. The same shall bring to the notice of the Department after detailed discussion among the affiliated unions and associations and other organizations. In this regard we would like to present our case in person. As the Department arranged immediately after the Report of SCPC released, a meeting of the office bearers of the Federation along with the President & General Secretaries of the affiliated unions and association may called to present our views.

It shall be highly appreciated an early appointment for a short duration and expecting a positive reply.

Sir,

We would like to invite the attention of the Department/ Government that if the Government notification issued on 29th August 2008 to revise the Pay scales of various categories of DAE employees represents NON SCIENTIFIC COMMUNITY as well as the entry level of scientific officers grade, the anomalies/discrepancies brought out to the notice of the Department as well as to the Government shall continue and the discontentment among these categories of employees continue as unresolved

It is sorry to mention here that it shows the Department failed to convince the Secretaries committee constituted by the Government to study the recommendations of the Sixth Central Pay Commission (SCPC) about the various anomalies in the recommendations and thus the Government has not made any modifications to ensure the better pay, promotional benefits, retaining the promotional avenues etc.

Though the entry level of a Central government employee is upgrades as in the pre revised scale of pay of Rs 2750 – 4400 in place of Rs 2550 – 3540 is a welcome step, the decision to merge all scales of pay of the Group D into single pay scale is nothing but denial of financial up gradation for the senior most employees which they gain during their entire service.

Similarly, the decision to abolish the scales of pay of Rs 5000 – 8000 and Rs 5500 – 9000 and bring those employees in the revised scale of pay of Rs 6500 – 10500 too welcome step, but here too senior most employees are the victims for not recommending financial upgradation. In fact the employees in the scale of pay of Rs 5500 – 9000 and 6500 – 10500 brought down into the scale of pay of 5000 – 8000 , thus taken away the benefit of one/two promotion they got in the service carrier as the case may be. This anomalies applies all section in auxiliary, administration, accounts, technical, purchase, stores and in the initial level of scientific officers.

It is also observed that the Department/Government enhanced the benefits of senior scientific community starts from Scientists F (SF) and above by ensuring lifting pay band from PB 3 to PB 4, ensuring the two increments and enhancing the special pay of Rs 2000/- to Rs 4000/- etc. Further the Department took effort to ensure better increment rate 4% for 20% of the scientific staff in PB3 and benefited by the enhancing the grade pay of these categories.

While appreciating effort by the Department to ensure better pay structure for the senior scientific community of the Department along with Department of Space (DOS) and Defence Research and Development Organisation (DRDO), we expects the same approach towards the other section employees in the non scientific community as well as that scientific officers in the junior level. It is pertinent to note here that with out the co operation and joint effort all section of employees, the Department cannot move towards growth, for which satisfying a meager section of scientists only will not give results. Especially when the brain drain happens in the entry level of Scientists and Technocrats including Technicians than in the senior most scientists/technocrats, a scientific approach should be applied to the pay revision to attract, retain the brilliant/scholars in the Departments.

But it is very unfortunate to note here that the revision in the pay for non scientific community will ensure a meager 21% to 40% pay rise for non scientific community where as an increase from 81% to 121% to the senior scientific community which most inequitable and is not based on any scientific principles. To over come the discrepancies as well as to ensure satisfaction among all section of employees, at least the existing promotional avenues as well as the benefit of the promotion already availed by the senior employees, Department has to apply scientific approach by taking the employees and there representatives into the confidence while revising the pay scales as per the Revised Pay Rules 2008.

It is` therefore request you to take initiative to ensure to remove anomalies/discrepancies while implementing the Revised Pay Rules in DAE.

CALL ATTENTION DAY – 05.09.08:


Hopes that all affiliates have been decided to call general meeting of the employees to observe CALL ATTENTION DAY on 5th September 2008. Copy of the draft resolution addressed to Secretary DAE is attached herewith. The resolution may pass in the general meeting/lunch hour meeting (as the case may be) and send to DAE on 5th September itself. A copy may be given to the Head of your units by meeting him in personally to intervene and explain the gravity of the situation.


STRIKE DECLARATION DAY – 19.09.08:

In the National Executive Committee meeting of the Confederation of Central Government Employees & Workers held on 26th August 2008, it was decided to initiate agitation against the Governments’ approach on the suggestions submitted by the staff side on various retrograded recommendations of Sixth Central Pay Commission (SCPC). To start with the agitation, the National Executive decided to observe Strike Declaration Day on 19th September 2008 by organizing meetings, badge demonstration etc. In the meeting charter of demand should declared and send to the Prime Minister, Cabinet Secretary and to the Head of the units of the concerned Department

All affiliates are requested to send their suggestions to be added into the Charter of Demand (the issue shall be common in nature) to the NFAEE Head Quarters before 8th September 2008, so that the same can be compiled and send the Head Quarters of Confederation of CG Employees and Workers before 10th September 2008. The Secretariat of the Confederation will finalise the Charter of Demand based on the suggestion received from the affiliated on 10/11th September 2008 and there after will circulate.

All affiliates are requested to issue the notice to the Department on 10.09.08 for observing STRIKE DECLARATION DAY on 19th September 2008. Though Working Committee Members proceeding to Mumbai to attend the Working Committee meetings all affiliates are requested to ensure that programme on 19th September 2008 conducted in all units.

NFAEE WORKING COMMITTEE – 17.09.08:

As mentioned in the notice issued for the Working Committee meeting of NFAEE, the meeting shall be held on 17th September 2008 at Mumbai. All affiliates are requested to send the following details:

· The posts (designation wise) operating in all units and the sanctioned as well as the existing staff strength in each category.
· Anomalies/discrepancies observed by the associations/members in the Central Civil Services (CCS) Revised Pay Rules 2008 issued on 29th August 2008 and the suggestions to remove such anomalies before 12th September 2008, so that all such suggestions can be compiled and circulate, so that the time can be saved in the meeting to presentation.

Ensure the participation of all Working Committee Members in the meeting apart from the DC members.

Sub: Implementation of the Government notification on Pay Revision 2008.

Sir,

The Government of India notified the Revised Pay Rules 2008 on 29th August 2008 and directed all Ministries and Department to implement the same at the earliest. In this regard we would like to call your attention that:

· While issuing the above mentioned notification the Government has not been considered the discrepancies in the recommendations of Sixth Central Pay Commission and the implementation of the notification as it may invite discontentment among the staff belongs to the non scientific community

· The Government while recommending merger of the pay scales at various level not consider the cases of senior employees who got the promotion. By merging the pay scales of Rs 6500 – 10500, 5500 – 9000 and 5000 – 8000, the Government in fact being done the degradation of Rs 5500 – 900 and 6500 – 10500. This nullified the promotion benefit of the employees who rendered more years of the service in the Department in Technical, administration, Auxiliary, Purchase & Stores.

· The Government has not considered the consequence of placement of all Group D employees in the revised scale of Pay of Rs 2750 – 4400. In this case too the Group D employees numbering about 3000 of this Department who rendered their service more than 20 years placed with the new incumbent.

Under this circumstance, we request you to give necessary direction to the concerned not to issue replacement pay scales in a hasty manner. We request that the Department should consider all aspects to protect the promotional benefits acquired by the employees on their merit. Therefore we request you to immediately issue the corresponding pay scale as mentioned in the notification No F.No 1/1/2008 – IC, dated 30th August 2008 and accordingly give the arrears to the employees. Thereafter in consultation with the similar Department such as Department of Space, DRDO as well as with the representatives of the recognized Federation/ Unions and associations of this Department, the proper pay structure may evolve for all sections of employees and accordingly implement the same. This may defuse the discontentment among the employees.

In this regard we would like to present our case in person. So it is highly appreciated an early appointment for a short duration.

Since the official Notification has been published by the Government, the immediate reactions/preliminary comments and observations on the common issues hereunder:

NEGATIVE:

1. As already analysed by the National Executive of Confederation of Central Government Employees the denial of Need Based Minimum Wage as per 15th ILC norms Rs.10,000 for Group 'D' but only granting of Rs.7,000 as Minimum wage to Group 'C' is most disappointing.

2. The fitment formula of 1.86 times of basic pay as on 1.1.2006 do not ensure even minimum wage rise of 40% to employees while the Group A officers

3. Group D employees without Matriculation qualification would only get the fitment in 1S scale with 1300/- grade pay and not PB-1 scale with 1800/- pay now until they are retrained suitably. The Non-Matriculate Group D officials who retired between 1.1.2006 and now would not be eligible for the PB-1 at all and thus deprived even this minimum wage of 7,000/- level and therefore their pension benefit would go down which is a major disappointment to the low paid employees.

4. Recommendation of pay commission to not to allow Merger of Dearness Allowance with Basic Pay at any stage is accepted. This is going to make a big difference and negative impact on our wages in future.

5. The three Assured Career Progression (ACP) is recommended in the Pay hierarchy not in the grade hierarchy, which great loss to the administrative & auxiliary staff

Transport Allowance - The employees below Rs.4000/- basic pay in the existing pay scales are going to get very less increase because of acceptance of recommendation for abolition of CCA.
7. Flexi-time for women employees and flexi-week recommended for physically challenged are rejected by the Government.


POSITIVE:

1. Transport Allowance for those employees in the basic pay of 4000/- in revised pay scales also will be on par with those who are in grade pay level of 4200/- to 4800/-. These employees will get 1600/- + DA on it in Metro Cities and 800/- + DA on it in all other places.

2. Campus restriction for Transport Allowance is removed by the Government so that all employees who occupy campus attached quarters [like SPM Quarters] will also be eligible for Transport Allowance.

The modification by the Government for granting two uniform dates of annual increments to facilitate drawal of increment either on 1st January or on 1st July is am improvement.

Benefit of one increment is given to avoid bunching of more than two stages in the revised running pay bands [But @ 3% of basic pay in pay band without including Grade Pay].

5. Rejection of the recommendation for reducing the Holidays only to National Holidays and allowing the status-quo is welcome.


CONCLUSION:

The decision of the National Executive of Confederation of Central Government employees & workers to go for an indefinite strike is the only alternative for opposing the retrograde stand of the Government on many issues like Need Based Minimum wage, Denial of uniform fitment benefit to all, Denial of Transport Allowance minimum 1200/-+DA on it for Metro and 800/-+DA on it for other places, Denial of Minimum 10% fixation benefit on promotion, Denial of ACP on grade hierarchy etc.

The Working Committee meeting scheduled to be held on 17th & 18th September shall assess thread bear the Government Notification & take important decisions to ensure justice to the workforce for of the Department

Let us concentrate to build a powerful movement by forging unity with all possible organisations outside the Confederation and let lose a powerful campaign and agitational programme to culminate in indefinite strike. Acceptance without further increase would result in huge loss.

Confederation Decides to Organise Indefinite Strike

The extended meeting of the National Executive Committee of Confederation of Central Government employees and workers held at New Delhi on 26th August, 2008 deliberated upon the refusal of the Government of India to accept any of the major suggestions made by the Employees organizations under the auspices of the JCM National Council, on the 6th CPC recommendations. It noted with disappointment that the Government did nothing to correct the wide disparity in wages amongst the employees and officers accentuated by the recommendation of the 6th CPC.

By suppressing minimum wage without any justifiable reason, the meeting noted that the wage structure of Group B, C and D cadres has been depressed with devastating impact for many years to come. The abolition of Group D posts numbering about 9 lakhs has opened up vast avenue for contractorisation of various Group D functions. It rightly observed that in the days to come the Government organizations will have more daily rated contract workers than regular employees.

The meeting came to the conclusion that the Government's decision warrants serious agitational approach and decided to call upon the Central Government employees to mobilize themselves for an indefinite strike Programme to generate necessary sanctions to compel the Government to enter into meaningful discussion over these issues with the employees' organizations and settle them satisfactorily. All the constituent units of the Confederation have been advised to meeting in their national convention/conference and endorse the decision of the indefinite strike action immediately. The National Executive Committee will again meet after holding discussion with the sister organizations in Defence etc. in the month of November, 2008 to decide upon the date on which the said indefinite strike action should commence.

The strike will be organized in the first fortnight of December, 2008 if the Government does not come forward for discussion, negotiation and settlement of the under mentioned Charter of Demands.

Dear Comrade,

The extended meeting of the National Executive of Confederation was held on 26th August, 2008 at New Delhi ( at IT Recreation Club hall). The representatives of twenty affiliated All India organizations and eleven State COCs were present at the meeting, besides the National Executive members.

It was thus a well represented meeting. The meeting briefly reviewed the strike Participation of Central Govt. employees on 20th August 2008 and endorsed the Press statement issued by the Confederation on that day, which had indicated the overall picture. The meeting evaluated that the announcement of the Govt.'s acceptance of the 6th CPC recommendation (even though major demands of the employees had been rejected) had created certain confusion amongst the rank and file of the workers, which had adversely affected the strike participation in certain areas, especially the northern and western India. The meeting attributed this mostly to the failure to combat the media propaganda.

The meeting came to the conclusion that the Govt.'s decision without conceding any of the major suggestions made by the employees organizations in the JCM was a serious matter and if not contested would bring about devastating impact on the wage structure of the Central Govt. employees. The meeting pinpointed the following issues, on which absolutely unsatisfactory position has been taken by the Govt.

a) Minimum wage
b) Contractorisation of Group D functions
c) Fitment formula
d) Financial benefit on promotions
e) Transport allowance, daily allowance etc.
f) The denial to give effect to the revised allowance from.1.01.2006. etc

The meeting also took note of the delay in the submission of the report of Natraja moorthy Committee on GDS Pay revision.

The meeting came to the unanimous opinion that:

a) Without organizing a serious industrial action of a prolonged nature including indefinite strike, no fruitful/meaningful negotiation or settlement is likely to be brought about.

b) A serious campaign has to be under-taken by holding department/organization- wise convention and state wise conventions to mobilize the employees for a militant action like indefinite strike.

c) Besides the CPC related issues, the other major pending issues, viz Compassionate Appointment, Board of Arbitration awards, Continuing ban on recruitment and abolition of posts, Outsourcing, Privatization, Contractorization, Regularization of existing daily rated workers, Bonus ceiling etc. should also be projected for settlement through the strike charter.

d) Serious consultation with the leadership of AIDEF should be made to explore the possibility of a united action.

e) Strike ballot has to be employed as a means of mobilization and to ensure that the decision for such a serious action has the seal of approval of all members.

f) The date of commencement of such action is to be decided by the National Executive on conclusion of the strike ballot by all the affiliates and in consultation with the sister organizations.

g) The proposed action should be slated to take place within a period of 3- 4 months time.

h) The draft resolution and charter of demands prepared by the Secretariat will be placed in the website as early as possible to elicit suggestions and amendments to reach the CHQ by 10th Sep., 2008

i) 19th Sept. will be observed as "Strike Declaration day" (SANGHARSH AHWAN DIVAS) throughout the country to popularize the demands and submit the resolution of NE meeting to all heads of offices and departments.

CHARTER OF DEMANDS

1. Grant Rs.10,000 as Minimum Wage as per 15th ILC Norms.
2. Grant minimum fitment benefit of 2.625 times of pre-revised basic pay to bring about uniform rise in emoluments.
3. No abolition of Group D posts and functions.
4. Lift ban on recruitment; fill up all vacant posts and scrap Screening Committee.
5. Grant Pension and Status of Civil Servants to GDS.
6. Grant 10% of Pay + Grade Pay as minimum benefit on promotion or financial upgradations.
7. No outsourcing or contractorising of Governmental functions.
8. Fix the date of effect of all allowances as 1.1.2006.
9. No reduction in the commutation value and restoration of full pension after 12 years.
10. Grant statutory defined pension scheme to the employees recruited after 1.1.2004 and withdraw the PFRDA Bill from Parliament.
11. Compute the pension entitlement on the basis of notional pay as on 1.1.1996.
12. No performance related pay or bonus scheme.
13. Implement all Board of Arbitration Awards.
14. Remove the arbitrary 5% ceiling and 3 years condition on compassionate appointment and withdraw court cases and absorb all waitlisted RRR candidates.
15. Implement the revision of bonus ceiling @ 3500/- in the case of Government Employees; Remove adhoc bonus and replace it with PLB and remove the 60 days ceiling.
16. Grant SDA to all employees in NE Region.
17. Revise the Transport and Daily Allowances as demanded by the Staff Side JCM National Council.
18. Direct all the Departmental Heads to settle 6th CPC related department specific demands / problems within a stipulated time limit.




















R e s o l u t i o n

adopted at the Extended meeting of the National Executive of the Confederation of Central Govt. Employees and Workers held at New Delhi on 26-08-2008.

This extended meeting of the National Executive of the Confederation of CGE and Workers held at New Delhi on 26 Aug 2008 unanimously resolves that the decisions taken by the Govt. on various recommendations of the 6th CPC, as is made known are unacceptable in as much as most of the modifications suggested by the employees organizations unitedly to reverse the anti-employee stand of the Commission have been rejected.

The Govt.'s propaganda that it has raised the minimum wage to Rs.7000/- is an untrue statement for the lowest level employees it works out to only Rs.6,040/- on the basis of which only the pay structure has been constructed. The non-acceptance of the suggestion to revise the fitment formula has resulted in the financial benefit flowing in a fortuitous manner whereby the senior employees and those in the higher scale of Pay of the bunched pay scales getting lesser than their juniors. It is deplorable that the arrears are to be paid in two installments of which the major chunk having been deferred by one year especially when the interim relief demanded by the employees was denied. There had been no improvement made in the grant of transport allowances, daily allowance, financial benefit on promotion commutation value of Pension etc. The meeting notes with extreme dissatisfaction that while the commutation value has been drastically reduced the restoration period has not been altered.

It appears that the Govt. has decided to accept the proposal for introduction of Performance related Pay System. Doing away with the present Bonus computation methodology and continue with the drastic downsizing measures and to do away with the Group D employees and hand over their functions for contractors are some of the other major decisions that affect adversely the career and job security of the employees. The meeting realizes that the abolition of Gr.D posts is intended to usher in large scale contractorisation of the permanent and perennial types of jobs. The meeting also notes with pain that the revision of wages affected on the basis of the present decision of the Government will have a deleterious effect in the long run and over a period continuation of 5th Pay scales and allowances would become more beneficial to the employees. While appreciating the decision of the Govt. to raise the ACP from 2 to 3 in acceptance of the suggestion made by the Staff side JCM in their memorandum and the slight increase in the rate of increment and the correction carried out in respect of the actual receipt of DA as on 01-01-2006.

The meeting realizes that the notification on acceptance of the recommendation of the 6th CPC as and when issued will make the picture clearer and the real purport and impact would become discernible to the mass of the employees.

The meeting has come to the inescapable conclusion that without an industrial action of a prolonged duration, no settlement would come about on the CPC related issues. The meeting therefore calls upon the affiliates of the Confederation to mobilize the rank and file of the membership for an eventual industrial action including strike action to take place with the next 2-3 months. The meeting also decides that besides the 6th CPC related common issues the Charter should also include the long pending common issues and department specific demands arising from the acceptance of 6th CPC suggestions by the Govt.

The meeting specifically decides that the demand for pension and Civil Servant status to Grameen Dak Sewaks must be included in the strike charter of demands.

The meeting has directed the Secretariat to get in touch with the leadership of the AIDEF to explore the possibility of the Defence Workers joining and leading the proposed strike action.

The meeting calls upon all affiliates to organize a strike ballot after extensive mobilization campaign and presentation of the issues before the mass of the membership and to complete the same by 10th November, 2008. The meeting asks the Secretariat to bring home the negative impact of the Govt.'s decision through a pamphlet

This meeting decides that the next meeting of the National Executive should meet before 20th November, 2008 to review the preparation made and take appropriate decision.

The meeting also calls upon all affiliated Associations/Federations to hold a national Convention enlisting the participation of leaders of all Units for mobilization of the grass root membership.

The meeting also calls up on the leaders of all State C-o-Cs to hold State level conventions eliciting the participation of the unit leaders of all affiliated Associations/Unions in the respective States in a bid to prepare the membership for a serious struggle.

The meeting decided to call upon all affiliated to collect a donation of Rs. 20/- from each member as and when the arrears are disbursed and remit the same to the Confederation CHQ.

GOVERNMENT HANDS OUT I-DAY BONANZA TO ITS STAFF

FOR WHOM IT IS BONANZA?


The Union Cabinet on Thursday bettered the recommendations of the sixth pay commission, coming up with a please – all final award. In the process, the UPA coalition managed to placate about 40 lakhs organized government employees who had been vocal about their resentment at the rising inflation and interest rates. The final package marks an increase of 21% over and above what the pay panel had recommended.


The above paragraph is quoted from the article appeared in the Times of India on 15th August 2008 – 62nd Independence Day of our country. What is the fact?

After a wait of nearly five months, the government has finally taken a decision to implement the 6 CPC recommendations with some minor modifications. What the modification the Government done on Justice Sreekrishna’s report.

The fitment in the pay bands has been modified by replacing the multiple factor 1.74 which was recommended by the Pay commission as 1.86. The fact was that as on 1.1.2006 the employees were drawing DA at 86%. The 6 CPC did not consider the DP factor and denied the benefit of 12%, an element that is already part of the pay. This 12% that was snatched away has now been restored. This is not a bonanza; it is not at all an additional increase. It is only restoration of what is due to the employees.

The minimum basic pay for a government servant has been increased to Rs 7000 from Rs 6660/-. The claim by the Government is nothing but to misguide, not only the employees but the whole nation. The fact is that the entry level in the government service at Group D (the minimum wage) is Rs 6050/- after the cabinet decision. Rs 7000/- is the entry level for Group C. After applying the multiplying factor of 1.86 (2750x1.86 =5115 rounded nearest in tens= 5120+1800 (Grade pay) =6920, brought it into Rs 7000/-

None of the demands raised by the staff side to improve the minimum pay recommended by the Pay commission has been accepted by the Government. It has neither been considered the Need Based Minimum Wage as per the 15th ILC formula nor the National Net Product formula of 5th Central Pay Commission by which the minimum pay cannot be below Rs 7400/- correspond to Rs 2550/-.

All earlier Pay Commissions have applied uniform multiple factor for pay fixation for all section of employees. For example the multiple factor for the fixation of pay by 5th CPC was 3.2 across the board. Thus the percentage in increase in pay was also in uniform. But by accepting the recommendations of Sixth CPC the Manmohan government increased the pay at the entry level from Rs 4750 to Rs 6050 (A meager of Rs 1300/-) where as the pay of the Secretary from Rs 26000 to Rs 80000 (an increase of Rs 54000) and that of Cabinet Secretary from Rs 30000 to Rs 90000/- (an increase of Rs 60000). At the entry level the increase is just 27% where as the increase for Secretary, it is 207% and for Cabinet Secretary it is 200%. For other top bureaucrats and senior scientists also the increase is about 200% or more. At the same time the Government has not considered to extent a uniform hike of 40% to the non gazetted employees in Group D, C, B and even in Group A.

The Government has agreed to raise the rate of increment as 3% instead of 2.5% of the basic pay. The request to re install the CCA and other benefits also was not considered by the Government, it seems from the press communiqué issued by the Government.

At the same time the Government has given more attention to the demands raised by the IPS, IFS, senior scientists and other senior officials in civilian and that of Military Force and upgraded the pay structure of those section.

From the communiqué issued by the Press Information Bureau it is clear that the DAE, DOS & DRDO too pleaded to extend more benefit to the scientific community only. The Government agreed to place the Scientists E & F into the Pay Band 4 instead of PB 3 by which the initial pay of a Scientist F (SF) is getting a jump from Rs 32,490/pm (recommended by Sixth CPC) to Rs 48200/pm. (an increase of Rs 15710/pm). Further the Government agreed to continue to grant special pay of Rs 2000/pm to Scientist G (SG) on promotion and doubling the amount to Rs 4000/pm. Already the update allowance has been enhanced from Rs 5000/pa to Rs 30000/pa for Scientific Officers. If considered these increases pay hike for senior scientists shall be more than 300%.

We are not against the hike extended to the scientific community. But the same approach the Department should be extended to other non scientific communities of the Department. But those who prepared the reports and recommendations were busy to canvas there on pay and perks and were not bothered for their subordinates.

Thus the Government or the Department has not done any thing to correct the wide disparity in wages amongst the employees and officers. On the contrary the disparity is widened in certain cases.

From the above it crystal clear that for whom the Government decision on Pay Commission is Bonanza. By any standards the decision to accept the recommendations of Sixth CPC with minor modifications are not at all a Bonanza to the Non gazetted central Government employees but only a deception and denial of justice.

Under such circumstances, the employees have to vehemently agitate and struggle for justice. Let us not confused with the announcement of the Government on Pay Commission Report and let us concentrate to mobilize the employees against the Governments decision which is discriminatory in nature.

We got the opportunity to show our strength by participating in the Nation Wide Strike on 20th August 2008. The strike is not only for pay commission related issues, but for protecting our Pension and other rights which are now increasingly under the treat of privatization.

Only a successful strike of the employees in general and DAE employees in particular would protect our rights. The battle cannot be won without forging unity with the entire work force of the Department along with the employees of other sector.

Hopes that all affiliates took the decision to give notice for the industrial action on 20th August 2008. From various organizations presented their views that whatever may be the programme conducting by various associations, it should be uniform irrespective of their participation. Hance all affiliates are also requested to discuss in the committee meetings thread bear about the possibility to go for strike action, or other wise what should be the action progrmee.

Keep it in mind that the decision of your association shall reflect in the final decision to go for what type of action programme shall be organized by DAE employees in all units on 20th August 2008. This discussion also shall be taken with two to three days that is by 7th August 2008 and communicate to the head quarters.

With openness all affiliates are requested to communicate the feelings of the committee and what extend we can proceeds on 20th August 2008.

Based on the above views of various unions and associations and extended meeting of the Secretariat of NFAEE shall be called on 15/16th August to take final decision about the course of action programme.

DECLARATION

Adopted unanimously at the convention of
Central and State Government employees, University, College and School Teachers
held on 8th July 2008 at New Delhi .

This Joint Convention of Central & State Govt. employees, Defence workers, University, College and School Teachers and other employees held this day, the 8th July, 2008 adopts the following declaration:

The Convention notes with distress that the Govt. of India and many State Governments in the country have been following the World Bank-IMF dictated neo-liberal economic policies unabated since 1991 despite the sustained and continued opposition and resistance of the working people. While fabulously enriching a few in the topmost strata of the society and allowing comfort to the high segment of the middle class, it has pushed millions of our countrymen to penury and poverty. While the economy is claimed to have grown at a faster pace during this period, the workers, peasants and common people became poorer in a much more accelerated manner.

The unprecedented inflation and rise in prices of the essential commodities and its accelerating trend caused due to the pursuance of the anti-people economic policies of globalization, liberalization and privatization has made the workers' and poor people's life miserable and unbearable. The raging inflation nullifies whatever increase in DA is granted by the Central and State Governments and will wipe out any financial benefit that might accrue to the

The Central and State Govt. employees and the teaching community have always been in the forefront of the struggles and industrial actions organized under the auspices of Sponsoring Committee of Trade Unions. This convention, therefore, strongly supports the decision of the Sponsoring Committee to organize yet another one day countrywide united strike on 20th August, 2008 to oppose the disastrous economic policies and force the Govt to effectively control and bring down the rampant escalation of prices of commodities

The present ferocious trend of price-rise which has already touched about 12% has become a killer disease for the ordinary countrymen, but most astonishingly, the Central Government is betraying an extremely callous and indifferent attitude to this type of unforeseen price-rise and pooh-poohing it as nothing but a 'world phenomenon'.

The trade unions of the country including those in the Govt sector can not remain just as spectators, when employees and the common people are writhing with unbearable pain of this phenomenon. It is, therefore, the bounden duty of all trade unions to rise up to the occasion with vigorous protest compelling the Govt to control the spiraling price rise of essential commodities and rescue the people from this extremely tormenting and fatal situation.

It is diabolical that while the country is reeling under the unprecedented and uncontrolled price rise, the Govt. is crazy in pursuing the Nuclear Deal even at the cost of national sovereignty. Hence arises the need for joining the countrywide strike on 20 August 2008.

This convention recognizes the fact that the Govt's attempt for withdrawal of the Statutory Pension Scheme of Govt. Employees to replace it with a contributory system is conceived to transfer funds from poor to rich and to finance the stock market operations. The mass scale outsourcing of regular jobs, contractorisation, and privatization have become the modern instruments of exploitation. This is being applied in all Govt sectors including the teaching community and the teaching institutions. In all sectors; be it private, public or Government; denial of legitimate wages to the workers are encouraged blatantly by the Govt. Basic and hard earned labour welfare legislative enactments are sought to be replaced by reactionary ones to provide room for unhindered exploitation of workers and to appease the Trans-national Corporations.

Right to Strike for the Govt. employees has not yet been formally granted. This year is the 60th year of Declaration of Human Rights by the ILO. Govt. of India is a member State of the ILO. However, for the last 60 years Govt. of India has been consistently refusing to ratify the ILO convention 87,98 in regard to TU rights and 151 concerning such rights to workers in public services. This convention demands of the Government to ratify the convention 87,98 and 151 and afford the right to strike to the Government employees.

This convention views the recommendations of the 6th Central Pay Commission as yet another manifestation of the intent of the ruling class to intensify the neo-liberal economic policies. The 6th CPC has discarded all the established norms and principles of wage determination and has advanced untenable arguments to deny the employees the minimum wage. It has openly advocated Corporatisation and even privatization of major departments of the Govt. of India, Railways and Defence in particular. This convention asks the Government to deist from the practice of Corporatisation and privatization of Government departments. In consonance with the practices prevailing in the western world, the commission has suggested hefty pay packets and benefits for the top echelons in the bureaucracy denying in the process even the legitimate and genuine demands of the employees. The commission's recommendation to dispense with the existing Bonus scheme and introduce a system of performance related wage structure being bereft of any logic or merit has been rejected by all the organizations of Central Govt. employees unanimously. The convention condemns the suggestion made by the 6th CPC to abolish Group D Cadre and to stop recruitment of Group D employees as being superfluous in the Govt. departments and permit contractorisation of these functions henceforth. This direction of the 6th CPC, if implemented by the Central Govt, will play havoc in the States, where the number of Group-D employees is in colossal numbers. This convention therefore demands the Govt. to enter into a meaningful discussion with the employees' organizations and bring about a satisfactory settlement on the recommendations made by the 6th CPC and ensure that the retrograde recommendation on stoppage of Group D recruitment is rejected.

The 6th CPC has not recommended to extend the existing defined benefit Pension Scheme for new recruits, which the Govt has stopped without any statutory sanction This is unacceptable and the Convention demands that the proposed new Contributory Pension Scheme which is yet to receive the assent of Parliament should be scrapped and all Govt. employees (including those recruited after 1.1.2004) brought within the ambit of the statutory defined pension scheme.

In addition to the above demands of the Govt sector in particular, the Convention fully adopts the Charter of Demands and endorses the programme of actions chalked out by the Sponsoring Committee in its national Convention held at New Delhi on 13th May, 2008 and calls upon the central and State Govt. employees, University, College and School Teachers to organize a day's countrywide strike on 20th August, 2008 in unison with the other sections of the working class in the country and carry out the following preparatory programmes of action.

1. Joint Conventions at States/District/Industrial centers to be completed by 15th July 2008.

2. Massive demonstration/mobilization/dharna in all the states and Industrial centers on 30th July, 2008.

3. Serving of strike notice through demonstration on 4th August 2008.

This Convention urges that Central and State employees' organizations, Teachers and other section of employees in the Govt sector should take steps for successful observance of the Strike through unified and coordinated action in all States.

The Convention also calls upon the State Govt. employees and Teachers to organize solidarity action programme as and when the Confederation of Central Govt. Employees and Workers and other sections of the Central Govt. employees go for strike and other industrial action demanding satisfactory settlement of the 6th CPC recommendations. The 6-Point Charter of Demands adopted by the Sponsoring Committee in National Convention of Trade Unions on 13 May 2008

1.Take urgent step to contain price-rise through (a) universalizing the public distribution system throughout the country to cater all essential commodities at controlled price through PDS, (b) ban on futures and forward trading in all essential commodities, (C) reduction of tax in petrol and diesel, (d) stringent action against hoarding and black marketing.

2. Strict implementation of all labour laws particularly in respect of minimum wages, working hours, social security and safety and stringent action against all cases of violations; stop contractorisation and outsourcing

3. Scope of the Unorganised Sector Workers Social Security Bill pending in Parliament should be expanded to cover all unorganised sector workers irrespective of BPL or APL category to ensure a national minimum social security benefit for them as per unanimous recommendation of the National Commission for Enterprises in the Unorganised Sector (NCEUS) and the Parliamentary Standing Committee on Labour with Central Govt Funding.

4. Farmers Loan Waiver Scheme to be extended to loans from private moneylenders; nationalized banks to extend easy credit to peasants at lower interest rate.

5. Lift ban on recruitment in Govt services; remove the negative and discriminatory features in the recommendation of 6th Pay Commission and finalise the same for implementation in consultation with the employees’ organisations; expedite regularization and grant of pension to 'gramin dak-sevaks.'

6. Expedite wage negotiation for the employees of Central PSUs including the contract workers without any conditionality.

Sub: Implementation of the recommendations of Sixth Central Pay Commission (SCPC) – Reg.

Dear Comrades,

Hopes that by this time all affiliates must gone through the note circulated by the Government on the Cabinet decision to implement the recommendations of Sixth Central Pay Commission.

Though the Government came out the decision to misguide the employees who all are preparing for make the Nation wide strike on 20th August 2008. But the declaration of the decision has become most sharp weapon to beat the government on 20th August 2008 as the Government has not took any initiative to correct the recommendations which are widely retrograde in nature.

The Government has considered none of the suggestions submitted by the staff side on Minimum pay, fitment formula, uniform multiple factor etc thus the disparity in wages amongst the employees and officers aroused by the recommendations of SCPC stands as it is.

By seeing the press communiqué, it is established that the Department too took pain to get better benefits to the scientific community only. None of the issues raised by the Federation and various affiliates to the Secretary, DAE and other senior most officials in the Department fallen on deaf ears.

Thus the importance of the Strike action on 20th August 2008 has become more relevant. This strike action should be the opportunity to give befitting reply to the Government as well to DAE for their discriminatory approach towards the work force in Central Government in general by the Government and in DAE by the Departmental officials.

The national executive of the Confederation of Central Government Employees & Workers scheduled to meet on 26th August to take stock and plan the future course of action.

In the mean time all affiliates are requested to all DAE employees to demonstrate their discontentment against the decision of the Government/DAE by participating fully in the nation wide strike on 20th August 2008 along with other section of work force of the country.

I am attaching herewith copies of the Press Release issued by the Government, Confederation of Central Government Employees & Workers and the draft prepared as campaign material.

All affiliates are requested to initiate vigorous campaign on 18th & 19th August 2008 among the DAE employees in all DAE units to ensure standstill of the activities of DAE on 20th August 2008. Those affiliates are in confusion to go for strike on 29th August, should reconsider their decision to go for solidarity action on 20th August, and prepare & mobilize the employees to join in strike by halting the activities of all DAE units.

It is great pleasure to note here that the unions associations of Kalpakkam Based units, Mumbai based units and CAT Indore is marching foreword to ensure participation of DAE employees of those units. NFAEE Head Quarters hopes that affiliates of the NFAEE of all other DAE units also follow these organizations for uniform strike action on 20th August 2008 to protect our pay and perks and other facilities.

Sub: Preparation of Strike action on 20th August 2008


Dear Comrades,

A meeting of the Office bearers of NFAEE available at Head Quarters and the office bearers of Mumbai based DAE unit was held on 17th August 2008 to discuss about the preparation of Strike on 20th August 2008 as well as the decision of the Union Cabinet to implement the recommendations of the sixth central pay commission.

The meeting after detailed discussion made conclusion that the decision for strike on 20th august become more relevant and accordingly decided to furtherance to preparation of strike on 20th august vigorously. Also decided to have badge demonstration on 19th August 2008 as a campaign for mobilization for participation in the strike on 20th August 2008.

All affiliates are requested to explore the possibility to have badge demonstration on 19th August to ensure maximum employees in strike on 20th August 2008. A draft for the badge is attached herewith.

ALL INDIA CONVENTION GOVERNMENT EMPLOYEES:

A joint Convention of Central and State Government Employees and University, College and School Teachers were held on 8th July 2008 MPCU Shah Auditorium, New Delhi. The convention was jointly organized by Confederation of Central Government Employees & Workers and All India State Government Employees Federation.

12 delegates from National Federation of Atomic Energy Employees were attended the convention. Convention was inaugurated by Com. M.K.Pandhe President CITU. Com. Sukumol Sen General Secretary, All India State Government Employees Federation presented the declaration for discussion and Com. S.K .Vyas President Confederation of Central Government Employees & workers seconded the declaration. More than twenty delegates participated in the discussion and a number of suggestions/amendments have been proposed for the consideration. Com. K.K.N Kutty, Secretary General Confederation of CG Employees & Workers summed up the discussion and placed the declaration with certain addition for approval and the same was adopted by unanimously by the Convention. The convention endorsed the decision of the sponsoring committee of Central Trade Unions and Federations held on 13th May 2008 and has called upon the Central and State Govt. employees, and teachers to organize the series of programmes of actions culminating in one day strike on 20th August, 2008.

The Convention was presided by a presidium consisting of S K Vyas, R G Karnik and Kartik Mondal.Com. R.G. Karnik, president All India State Government Employees Federation extended vote of thanks on behalf of the Presidium.

The Press Communique released joint by Confederation of CG Employees & workers and All India State Government Employees Federation along with the Declaration adopted in the Convention is attached herewith.

NFAEE request the affiliates to take necessary steps required for mobilization of the employees to ensure mass participation of the employees in the series of action programmes and the successful conduct of the one day strike on 20th August, 2008.

All affiliates are further requested to contact the COC of Central Government Employees & Workers in the respective State/ District wherever the case may be and other organizations to hold joint mobilization programmes in the coming days.

SIXTH CENTRAL PAY COMMISSION RELATED ISSUES:

The Extended meeting of the National Executive of Confederation of Central Government Employees was held on 8th July 2008 at New Delhi. In the meeting the Secretary General briefed the latest developments in respect to the matter related SCPC as follows:

There has been no official information about the decision taken by the Committee of Secretaries on various proposals made by the Staff Side JCM. It is however unofficially learnt that the proposal of the Committee of Secretaries is likely to be given to the Government by 20th of this month. We also do not know whether the Govt. will further discuss the issue with the Staff Side. As has been intimated in our last circular letter on the subject, a satisfactory settlement on core financial issues is the need of the hour. The discrimination in the fitment formula between the officers who are placed in PB3 and PB4 vis- a – vis others is without any logic and principle and brings about a vast amount of difference in emoluments, apart from providing varied percentage of benefit to even similarly placed employees. The irrational computation of minimum wage, if not addressed, will have an everlasting impact on the wage structure of Central Govt. employees. The process of negotiation that is presently on the anvil in the case of Public Sector employees, once come to fruition will widen the existing disparity in the wages of the Central Govt. employees and workers of the Public Sector workers. The future of further recruitment in Government department for carrying out the existing Group D functions is bound to be stopped. Since no organizations can do away with these functions, the only alternative will be contractual employment.

The National Executive of the Confederation has, therefore, decided to meet immediately on knowing the Government's decision on the 6th CPC related issues. The emergent meeting will be notified to take place within a few days' time. The members are requested to kindly respond and reach Delhi for consultation and decision.

About 800 delegates representing the Confederation of Central Government employees and workers, All India State Government Employees' Federation, All India Federation of University and College Teachers Union, School Teachers Federation of India attended the National Convention today at MPCU Shah Auditorium, Civil Lines, Delhi. The Convention was presided by a presidium consisting of S K Vyas, R G Karnik and Kartik Mondal.

The Convention was inaugurated by Com. M K Pandhe, President CITU and was addressed by Com Tapan Sen, MP, Secretary CITU, Com S K Bose, Assistant Secretary, NRMU, Com. Sailo Bhattacharya, General Secretary, All India Defence Employees Federation, Com. Bidyanath Mukherjee of School Teachers Federation of India, Com. B S Hota, President, All India University Employees Confederation, Com. James William, National Secretary AIFUCTO, Com. Rajesh Menon, General Secretary of Confederation of Central Govt Officers Organisations.

The Declaration, later approved by the Convention was presented by Com. Sukomal Sen, General Secretary AISGEF, and seconded by Com. KKN Kutty, Secretary General of Confederation of Central Employees summed up the discussion in which about 30 delegates participated. This Joint Convention of Central & State Govt. employee, Defence workers, University, College and School Teachers and other employees held this day, the 8th July, 2008 adopts the following declaration:

The Convention notes with distress that the Govt. of India and many State Governments in the country have been following the World Bank-IMF dictated neo-liberal economic policies unabated since 1991 despite the sustained and continued opposition and resistance of the working people. While fabulously enriching a few in the topmost strata of the society and allowing comfort to the high segment of the middle class, it has pushed millions of our countrymen to penury and poverty. While the economy is claimed to have grown at a faster pace during this period, the workers, peasants and common people became poorer in a much more accelerated manner.

The unprecedented inflation and rise in prices of the essential commodities and its accelerating trend caused due to the pursuance of the anti-people economic policies of globalization, liberalization and privatization has made the workers' and poor people's life miserable and unbearable. The raging inflation nullifies whatever increase in DA is granted by the Central and State Governments and will wipe out any financial benefit that might accrue to the employees if the VI-CPC recommendations are modified and implemented.

The Central and State Govt. employees and the teaching community have always been in the forefront of the struggles and industrial actions organized under the auspices of Sponsoring Committee of Trade Unions. This convention, therefore, strongly supports the decision of the Sponsoring Committee to organize yet another one day countrywide united strike on 20th August, 2008 to oppose the disastrous economic policies and force the Govt to effectively control and bring down the rampant escalation of prices of commodities.

The present ferocious trend of price-rise which has already touched about 12% has become a killer disease for the ordinary countrymen, but most astonishingly, the Central Government is betraying an extremely callous and indifferent attitude to this type of unforeseen price-rise and pooh-poohing it as nothing but a 'world phenomenon.

The trade unions of the country including those in the Govt sector can not remain just as spectators, when employees and the common people are writhing with unbearable pain of this phenomenon. It is, therefore, the bounden duty of all trade unions to rise up to the occasion with vigorous protest compelling the Govt to control the spiraling price rise of essential commodities and rescue the people from this extremely tormenting and fatal situation.

It is diabolical that while the country is reeling under the unprecedented and uncontrolled price rise, the Govt. is crazy in pursuing the Nuclear Deal even at the cost of national sovereignty. Hence arises the need for joining the countrywide strike on 20 August 2008.
