Sub: Discussion on Sixth Central Pay Commission.

Dear Comrade,

It is understood that the Standing Committee of National Council (JCM) held on 7th May 2008 and had discussion based on the note submitted the Secretary Staff Side. Thereafter the Staff side members of the Standing Committee members met the Cabinet Secretary and other Secretaries who all are the members of high power committee constituted by the Government to submit its report on the recommendations of Sixth Central Pay Commission on 17th May 2008.

From the minutes of the Standing committee meeting held on 7th May as well as the report we received from Confederation of Central Government Employees & Workers about the deliberation had with the Cabinet Secretary and his colleagues on 17th may 2008, it is understood that there had been no emphasis on the important issues such as determination of minimum wage, fitment formula, maintain the ratio with the lowest and highest pay, construction of pay structure, benefit on promotion, increment rates, other allowances and facilities.

We would like to bring the following for your active consideration:

1. That it is very much important to consolidate the stand of the staff side on derivation of minimum pay based on our principal stand on Need Based Minimum Wage as per 15th ILC Norms. The staff side has to put pressure to revisit the calculation of the Pay commission in the regard as they deviated from the guidelines of ILC norms as well as the directive of Supreme Court. In the civil appeal No. 4336 (NL) of 1991 between the Workers Vs The Reptakos Brett & Co. Ltd, the Hon’ble Supreme Court Decision came on 31.10. 1991 in which court directed to add 25% of the overall cost shall be considered for the marriages, festival/ ceremonies, etc. Once Minimum wage is finalized the higher wage should be fixed based on maintaining the ratio as we demanded 1:10 at the level Group D as 2550 in the present pay. Once found the minimum wage correspondence to Rs 2550, using the multiple factor derive the pay corresponding to Rs 2750/- or Rs 3050/- whatever be the minimum. Then by applying the uniform multiple factor various pay structure shall be fixed.

2. That if the government is decided not to change the higher pay suggested by the SCPC as Rs 90000/-, then the lower pay should be Rs 9000/- as per our demand to maintain the ratio 1:10 or at least the lowest pay should be Rs 7660/- in correspondence to Rs 2550/- as per the existing ratio of 1:11.76. In that case the multiple factor shall be 3. If the lowest pay is bringing to Rs 2750/- then the new minimum should be 2750 X 3 = Rs 8150/- Accordingly other pay should be derived.

3. That if we insist 2.625 as the multiple factor, then all pay structure should be reworked out including that of Cabinet Secretary and Secretaries and equivalent. Otherwise the ratio existing shall be disturbed. It is pertinent to note here that the ratio in the lower pay and higher pay decreased after every pay commission in earlier occasions. Where as here it is increasing. This should not be allowed and accepted.

4. That the earlier Pay Commissions take care to maintain the vertical & horizontal relativity as well as the ratio of the entry grade in each Group with that of Secretary and & equivalent posts as well as that Cabinet Secretary. In fact the ratio which was prevailed after the implementation of Fourth CPC recommendations was reduced in almost all cases after the implementations of the Fifth Central Pay Commission Report. But the SCPC has not taken care of maintain the vertical and horizontal relativity and thus the ratio of the Pay scale in all Group has been widened.

Hence it is important to take care of continue the vertical as well as horizontal relativity at every stage and the ratio exists at least if not ready to reduce.

5. That while finalizing the Fitment Formula only the omission of merger of 50% DA as DP will be a factor for calculation to find the Pay Band as well as the fixation of individual’s pay in the defined pay structure. There only the demand of consideration of 86 % in place of 74% will come into picture.

6. That there are numbers of issues pertaining to other Departments similar to Railway such allowances like Overtime Allowance, Night Duty Allowance etc, other facilities etc. These issue should be discussed and settled for all Departments, not for any single Ministry/Department

7. That if the Government, is not prepared to consider the demand on revisit on minimum wage, fitment formula, maintain the ratio with minimum and maximum pay etc, the JCM participants should come out with agitational programme including indefinite strike.

8. That the Pay Commission and its implementation is most important to all section of employees as well as the pensioners, it should be dealt with proper care and should consider all views and suggestions proposed by various section of employees minutely. It is the future of the whole government employees as well other section of employees and pensioners of the country and no decisions shall be taken in hurry.

9. That it is necessary to convene an All India Convention of all constituent units of JCM participants immediately and place the record of the deliberations held in the first round meetings held on 7th May 2008 and 17th May 2008 in the convention and based on the decision in the convention should move ahead.

Campaign Programme:

As per the call given by the Confederation of CG Emp & Workers, NFAEE appealed its affiliates to conduct campaign programme from 13- 15 May 2008 and to join in the Mass Dharna programme. In Mumbai in BARC we conducted more than ten meetings inside the BARC as well as in the near by units.Also our members were participated in the Mass Dharna held on 16th May 2008 at Old CGO building

Workshop on SCPC recommendation:

Maniben Karve Institute a Trust under the leadership HMS organized a Workshop on Recommendations of SCPC on 12th May 2008 at Mumbai. Three representatives from NFAEE participated along with other delegates of COC of CG Employees & Workers in the full day Workshop. Com. Umraomal Purohit Secretary Staff Side, National Council (JCM) was the key spoke person. He narrated the important features of the SCPC as well as the out come of the Standing Committee meeting held on 7th May 2008. Com. Jayaraj.K.V presented a paper on behalf of the COC of CG Employees and Workers Mumbai.

Convention on SCPC recommendations:

National Railway Mazdoor Union (NRMU) organized a Convention on SCPC recommendations on 20th May 2008 at the Raliway Auditorium at CST Mumbai. Three delegates from NFAEE participated in the convention. Com. D.L.Karad Secretary CITU Maharashtra State Committee, Com. R.G. Karnik President AISGEF, J.R. Bhosle Treasurer AIRF, Sathyanarayan Vice President AIDEF, Jayaraj.K.V Secretary General NFAEE, Com. Rahate Vice President NFPE, RP Singh Secretary COC of CG Emp & Workers Mumbai etc were addressed the gathering. Apart from Com Bhosle all speakers were expressed the unhappiness about the discussions being held at National Level, and stressed the need to address the issues like revisit the minimum wage, ratio of minimum pay and maximum pay, increment rate, fixation on promotion, need of improvement and retention of other facilities and allowances. The convention passed a resolution to urge the government to discuss and settle the issues raised by the Staff side. Also urge the National Leaders to come out with united action programme against the retrograded recommendations and prepare for strike action including indefinite strike.

We strongly feel that the following issues should be the centre for discussion:

That if the government is decided not to change the higher pay suggested by the SCPC as Rs 90000/-, then the lower pay should be Rs 9000/- as per our demand to maintain the ratio 1:10 or at least the lowest pay should be Rs 7660/- in correspondence to Rs 2550/- as per the existing ratio of 1:11.76. 3. If the minimum wage is upgrading to 2750 or 3050, the ratio also should be correspondingly to be changed to 1:10.9 or 1:9.83 as the case may be.

4. We should not put Rs 7400/- shall be the minimum pay. Only should mention that, if the methodology adopted by the 5th CPC, then the minimum pay shall be Rs 7400/-

5. If we insist 2.625 as the multiple factor, then all pay structure should be reworked out including that of Cabinet Secretary and Secretaries and equivalent. Otherwise the ratio existing shall be disturbed. It is pertinent to note here that the ratio in the lower pay and higher pay decreased after every pay commission in earlier occasions. Where as here it is increasing. This should not be allowed and accepted. Hence we should demand to use multiple factor 2.625 also, if it is universally applied from lowest pay to Cabinet secretary then only the ratio can maintain. Otherwise again the ratio shall be disturbed. So proportionate changes should be carried out to all pay structures.

6. 10. Railway Leadership in the Standing Committee of National Council JCM claims and propogating that what ever decisions are taken and presented in the meeting with official side are based on the unanimous decision in staff side meeting. Factual position should bring among the membership.

11. The Pay Commission and its implementation is most important to all section of employees as well as the pensioners, it should be dealt with proper care and should consider all views and suggestions proposed by various section of employees minutely. It is the future of the whole government employees as well other section of employees and pensioners of the country and no decisions shall be taken in hurry.

12. Confederation should make proposal for the consideration of JCM leadership, for wider discussion among the staff side by convening an all India convention of Central Government employees immediately. It is necessary to convene an All India Convention of all constituent units of JCM participants immediately and place the record of the deliberations held in the first round meetings held on 7th May 2008 and 17th May 2008 in the convention and based on the decision in the convention should move ahead.

13. If the JCM Leadership is not agree for initiate the negotiation based on the above mentioned points the Confederation and other like minded organizations should take initiate to organize national level convention immediately and should come out with agitational programme including two or three days strike as we alone initiated strike for Bonus.

We hope that the above proposals may consider in the Secretariat meeting of Confederation scheduled to be held on 27th May 2008 in detail and some bold decision shall be taken by Confederation to expose the leadership of National Council JCM who are trying to agreeing with dotted lines.
