Sub: BRIEF REPORT OF THE
PROCEEDINGS OF PETITION FOR TRANSFER THE SA CASE OA 288/2012 IN CAT PRNCIPAL
BENCH OF
MUMBAI

Dear Comrades,
A brief report of the Proceedings of
Petition for Transfer filed by S.K. Singh, in the CAT Principal Bench held on 7th
April 2017 on the SA Case (OA No. 288/2012) to CAT, Principal Bench New Delhi from
Mumbai is given below:
The Transfer Petition filed by shri
SK Singh was dismissed after hearing held on 7th April 2017 by the
Chairman, CAT Principal Bench, New Delhi. While the matter taken for
consideration the advocate for NFAEE and Com. G. Ramesh, Jt. Treasurer NFAEE
and the Gen. Secretary HWP (M) SA SSA was present in the case. No advocate was
present for SK Singh during that time.
The Chairman of CAT Principal Bench
asked NFAEE counsel to present the opinion on Petition for Transfer. Our
advocate opposed the petition as the transfer may get more delayed since fresh
hearings & arguments are to be started. Whereas, the Mumbai CAT may
pronounce its judgment as early as possible since all proceedings completed
& the next date is posted on 01.05.17. Further, our advocate requested to
instruct the Mumbai CAT to pronounce the judgment on next hearing date.
Then, the advocate appeared for
Department told that he has to get instructions to present his views and
requested for two weeks time to present.
Thereafter the Chairman called the
advocate for applicant SK Singh and asked to argue. Singh stood and told that
his advocate is not present in the court and requested the Chairman to give 2
to 4 hrs time to call his advocate, which was not accepted.(who knows
really any advocate was engaged or not).
As the Chairman asked Singh to present
any thing if he wants to present, Singh told that due to non support &
cooperation of NFAEE & AEW&S Union, the case is getting delayed. He
further mentioned that their advocate didn't attend on 27.01.2017.
Our advocate intervened and countered
the allegation of Singh and briefed the reason for boycotting particular bench
as per the call of bar association. At this time Chairman told he recalled the
dispute existed during the month of January 2017 & told that the dispute has been
solved by him.
Finally the Chairman CAT Principal Bench New Delhi dismissed
the Petition for Transfer filed by SK Singh with instruction to Mumbai CAT to
expedite on next posted date or within a month period possibly as requested our
advocate.
Dear Comrades,
It is very unfortunate to note here
that Singh became the cause for delaying the judgment in the O A filed by NFAEE
at Mumbai CAT on AQE. If he was not approached CAT Principal Bench, in the last
date of hearing of the case in Mumbai CAT held on 3rd March 2017
itself could have been concluded with an outcome and this 2 months delay of
March & April could have been saved at least.
It can also be noted that Singh
always abusing the working class of DAE and BARC and its representative body of
NFAEE, AEW& S Union, who have filed the case and never blamed the
management who are the culprits for this injustice meted out by the SA
COMMUNITY.
From the proceedings, it can also be
clear that the decision of the Federation is not influenced by the Department
on SA case and not changed the views and NFAEE stuck on the decision taken in the
Working Committee on 4th February 2017, which proved correct.
All the affiliates are further
requested to bring the factual positions to the each and every Scientific Assistant
and request them not to trap themselves by the misgivings of SK Singh.
Let
all us think about the anxiousness & suppression of the cadre.
Let
us unite for the genuine & justified demand.

Mr. Jairaj, Do you understand basic difference in Rejection & Disposal of case. You must first learn English and court proceedings.
For update of your knowledge, the case was disposed with following orders & instructions :-
1. The Mumbai CAT shall act for earliest disposal with May.
2. Your advocate shall honour the court and must not boycott the court proceedings.
3. Suitable actions will be initiated if your advocate remain absent further.
4. You must co-operate & support the early disposal of the case.
With these strict orders, instead of feeling shameful, you are beating chest. Are you weeping or crying ?
You have already been rejected by masses in DAE. Do you not have any well to jump.
