National Federation of Atomic Energy Employees (NFAEE) welcome the decision of the Department to constitute a committee vide their letter No. 32/1(2)/2008-SCS/R-198 dated 12th September 2008 to examine the implementation of the decisions of the Government on the Sixth Central Pay Commission (SCPC) with regard to certain common categories of employees as contained in Part B of the First Schedule of the Notification dated 29th August 2008, of the Department of Expenditure, Ministry of Finance. NFAEE would like invite the attention of the Committee that the anomalies/ discrepancies brought out to the notice of the Department as well as to the Government have not been addressed while issuing the Notification of the Government on 29th August 2008.

As we expressed earlier, the recommendations of SCPC was far below the expectations of the Central Government employees in general and that of the Department like DAE, DOS etc. Some of the recommendations will not only take away the existing privileges laid under the recruitment & promotional rules but are in retrograde in nature also. A few of the recommendations are totally against the natural justice for equal rights and against the existing vertical – horizontal relativity. Neither the report of SCPC nor the Secretaries committee’s modification addresses the problems facing the scientific & research & Development Organisations such as to attract and retain the young and talented incumbents to the service.

The Department too failed to pursue either the SCPC or the Secretaries Committee to overcome the brain drain scenario by offering a better pay packet as other ministries could do for their employees by upgrading the Pay structure. Hence the Government notification as such failed to remove this paradox situation of attracting the best brain and talented Technocrats & Technicians to the Department. The growth of the NATION always related with the advancement in the arena of Science & Technology. Country’s prestige and honor lies in its dominance in Science & Technology. Though the Government of India has identified the potential of the Departments like DAE, DOS and DRDO with the advancement in the technology, it is unfortunate to note here that a raw deal has been given to the employees of such organizations while issuing the Notification by the Government on Pay revision.

Though all discrepancies in the SCPC report was brought to the notice to the Department in time vide our letter No. nfaee/sg/08/52 dated 5th May 2008 after detailed discussion with the Secretary DAE and other senior officials including the officers assigned to prepare suggestions/modifications to submit the Secretaries Committee and pleaded for redressal of grievances. It is pertinent to note here that various ministries & departments could take up the issues with Pay Commission as well as the Secretaries Committee and get it notified the upgraded pay structure of department specified cadres. Postman, Assistant Accountant, Assistant Accounts Officers, Security Guards, Technician, Assistants, Junior Administration Officer, Section Officer, Notice Server, UDC etc are some of the post in various ministries and departments got upgraded in the part C. Where as in Part B of the notification it is assured upgradations of various posts such as Nurses, teachers, Organised Accounts Cadre, Office Staff etc.

Keeping the above in mind, Department has to take utmost care to address the grievances raised by various categories of employees and also set right all anomalies created/to be created while implementing the Revised Pay Rules 2008. The basic approach of the Department towards to ensure sanctity and integrity of the whole DAE family can attain:
· by ensuring adequate pay to attract & retain the best talents at various level
· by assuring career progression at a lesser span of time
· by placing proper scale of pay such that a distinct attraction and ensuring vertical & horizontal relativity exists in the Department as well as in other establishments.

In our earlier letters to the Secretary to Department we brought out the various discrepancies, anomalies and the inequitable principle adopted by the Government. Hence we request to the committee the following issues:

1. The upward movement of Group D posts into the entry level of Group C with out ensuring Career Progression to the senior most employees in the scale of Pay of S2, S2 A, S3, & S4 by assuring Career Progression by extending financial upgradation in Grade Pay equal to the promotion already they availed will continue the discontentment among the employees.

2. Unless the Department takes action to de-merge the merged scales of pay either by moving up the posts in the pay scales S11, S 12 etc, or abolishing the post/s of the merged scale by moving the employees in the merged scales in to next grade hierarchy the discrepancy crated by the merger of the pay scales shall continue.

3. The impact of the Cadre Review Report, the entry-level pay for Technical Staff in the pre revised pay, as 4000 -6000 etc also should be considered while taking the decision.

4. Though the DPS has been recognized as distinct Cadre apart from Administration and Accounts, no steps has been taken so far to evolve proper pay structure based on the job/qualification requirements etc

5. The retention of posts having the scale of Pay Rs 8000 – 13500, as a promotional post in Pay Band 2 instead of PB 3 should be rectified. The Pay Commission as well as the Secretaries Committee taken care to place various categories of employee who entered in the pay scale of Rs 8000 – 13500 by virtue of promotion such as nurses, section officers, teachers etc.

Based on the detailed discussion in the Working Committee of NFAEE held on 17th & 18th September 2008 in Mumbai, NFAEE decided to submit the suggestions/ enclosed with this letter for the consideration of the Committee constituted by the Department.

Detailed note along with illustrations on discrepancies/anomalies and suggestions on categories left out in this letter including isolated categories shall be submitted at the earliest.

The NFAEE further request you to arrange a meeting of the Committee members with a delegation of NFAEE to explain our views regarding the implementation of Part B & the need to consider Part C of the notification while taking decision in DAE.

SUGGESTIONS ON IMPLEMENTATION OF PART B OF THE FIRST SCHEDULE OF THE GOVERNMENT NOTIFICATION
ON REVISED PAY RULES 2008 OF DEPARTMENT OF EXPENDITURE, MINISTRY OF FINANCE,
DATED 29TH AUGUST 2008

1. In the terms of reference of the committee constituted by DAE vide their Office Memorandum No. 32/1(2)/2008-SCS/R-198 dated 12th September 2008 it was asked to examine all aspects and formulate proposal for implementing the recommendations of SCPC by ensuring not to disturb the vertical & horizontal relativity among various cadres as well as the cascading effect.
2. The Committee was also asked to submit proposals to remove the anomalies to be arises while implementing the Government Notification
3. The Committee was further asked to take care/precaution not to exacerabated the anomalies while recommending proposals on selecting scales of Pay by ensuring parity amongst the equivalent cadres.
4. By keeping the above mentioned directives in the terms of reference in the said OM, we suggest the following points should be considered while suggesting the Pay structure for various categories of employees of the Department:

A. All Group D posts after merging into the pre revised Scales of Pay of Rs 2750 – 4400, the fixation shall be carried out to the employees after giving financial upgradation in grade pay equal to the number of promotions availed in the exiting pay scales to ensure he seniority in letter & spirit which assured by the SCPC
B. The recommendations of Second Cadre Review should be consider while recommending Pay Structure for auxiliary, administrative accounts, and purchase & store staff of the Department.
C. The recommendations contains in the Part B as well as Part C of the Government Notification on certain common categories of staff and upgraded pay structure for certain post in various ministries/departments respectively should take into consideration for the post having identical qualifications, experience, nature of job etc.
D. Upgraded pay structure for Nurses, Teaching Staff, Organised Accounts Cadre etc should be implemented with out any alteration/modification.
E. While selecting the Pay Structure for Technical, Administration, Accounts, Purchase & Stores etc, the vertical & horizontal relativity exists in the Department with those cadres got upgradation based on the recommendations contains in the Part B of the notification.

F. Upgradation at the entry level in certain categories to over come the brain drain, such as in the case of Scientific Officers, Scientific Assistants, Technicians is to be carried out based on the recommendation of the SCPC as well as the earlier Pay Commission. The recommendation of 5th Pay Commission to ensure the entry level of Technical staff (Tradesman B in DAE) in the Pay Scale of Rs 4000 – 6000 who have the qualification of SSC with ITI or +2 in science as minimum qualification should consider
G. In the Government notification it was mentioned that the Department specific recommendations which are not included in this resolution shall be processed by the concerned Department/Ministry and approvals of the Government obtained in consultation with the Ministry of Finance and or Department of personnel
H. While adopting the Part B of the notification, Department of Space (DOS) de-merged the merged pay scales of Rs 5000 – 8000 and Rs 5500 – 9000 by extending the Grade Pay of Rs 4200 and Rs 4600 respectively and the cascading effect has been given further. Let us take the liberty to quote Dr. Abdhul Kalam, former President of India while addressing Scientists and Technocrats, “Science academics and scientific advisory committee should discuss ways to ensure an assured career growth for science graduates and send recommendations to the Cabinet for the same. We should work for the creation of science cadre with a clear mission goals, well defined growth path and attractive salaries in the organizations such as Department of Atomic Energy, Department of Space, Defence Research & Development Organisation, Department of Science & Technology, Department of Earth Sciences, Department of Bio – Technology, Department of Agriculture., CSIR and the universities”.


AUXILIARY STAFF:

The activities of the Auxiliary Staff appointed as Helper (Trade), Helper (CM), Mali, Ward Boy, Ayah, Security personnel, Canteen employees etc involves:

· Cleaning of radio active, contaminated and hazardous area, disposing of active waste, cosmetic cleaning work of active and inactive area.
· Handling of all kinds of radio active decontamination work
· Active support for maintenance as well as support the operational activities in the plants
· Proper House keeping
· Proper Gardening to ensure greenish surrounding in and around the establishments
· To help the doctors, nurses in the hospital, ensure cleaning in and around the hospitals, dispensaries.
· The nomenclature of the Hospital staff should be reviewed based on the existing system in DOS
· To maintain proper security to the establishment. Protect the man & material of the Department from all types of threat.
· To ensure hygienic conditions in the canteen. To ensure hygienic food for the employees in time.

REDESIGNATION of the POSTS:

Designations of the Post may be re-designated such as Field/Plant Attendant, Technical Attendant, Cosmetic Attendant, Security Assistant, Medical Attendant, Nursing Attendant, Catering Attendant etc.

Merged Pay scales of Rs. 2610 – 4000 should bring back to Rs. 2610 – 3540 and 2650 – 4000 as recommended in the 2nd Cadre Review Report.

Care Taker Staff of various Departmental Guest Houses should be considered on par with similar categories of employees placed in corresponding Pay Band/Grade Pay. 10% of the Pay shall be given as Care Taker Allowance. Department also should consider the feasibility to create a Care takers grade by centralizing the post controlling by DAE, so that promotional hierarchy can be evolve.

Promotional norms should be reviewed and re designed to ensure Track change from the auxiliary post to Technical/Administration etc as & when they attain the Grade Pay of Rs 2400.
DRIVERS:

The job of the Drivers in the Department is not just like as Staff Car Drivers that involves bring the officers in work place and drop back to their home in the evening. Most of the Drivers in DAE are exposed for multiple responsibilities to handle light as well as heavy vehicle.

The job of the drivers involves in project development which always may be in the remote locality, transportation of radio active and/or hazardous materials at a long distance, working for senior scientists and VVIPs.

Duty also involves in Round the Clock Shift. Most essential service during emergency occurs.

Present promotional avenues are linked with vacancy available based on specific ratio.

Since the activities of the Drivers of the Department is entirely different from that of the Staff Car Drivers, a separate Pay Scales should be selected for them.
Those who are handling Heavy Vehicle, they should be extended an Heavy Vehicle Allowance @ 10% of the Pay (Pay in Pay Band + Grade Pay
TECHNICAL:

1. Technical staff in the Department is recruits based on the minimum qualification of SSC with ITI or +2 in Science. Those qualified are appointed as trainees for two years and after the completion of the training based on the interview and grading, posting are being offered. By reviewing the recent year’s recruitment it can be see that normally offered the post of Tradesman ‘C ‘at the entry level.
2. Normally those who directly recruited with out training also offered Trades man ‘B’ in the scale of pay of Rs 3200 - 4900.
3. The grades continue upto Tradesman ‘K’ in the pay scale of Rs 10000 – 15200 except Tradesman ‘I’. In short in DAE we have 8 grades in between Tradesman ‘B’ and Tradesman ‘K’
4. Where as in Department of Space (DOS) the entry with minimum qualification of SSC with ITI is restricted as Tradesman ‘A’ with the scale of Pay of Rs 3050 – 4590.
5. The grades in DOS too continues upto the scale of Pay of Rs 10000 – 15200 in Technician grades but in between, they don’t have Tradesman ‘B’, ‘C’ & ‘I’. In short they have 6 grades in between the entry level and that of Rs 10000 – 15200.
6. The comparative chart given below shows the promotional norms of DAE & DOS
1. The above chart shows that a Technician with ITI qualification reaches in the Scale of Pay of Rs 10000 – 15200 as Technical supervisor within a span of 27 years of regular service where as in DAE a Tradesman reaches in the scale of pay after 33 years only. After getting an extra promotion after a gap of 6 years only will reach in that grade. Where for Scientific Assistants who were appointed in the Scale of Pay of Rs 5500 – 9000, to reach in the Grade equivalent to the Scale of Pay of Rs 16400 – 20000 has to face 7 interviews with a span of 34 years in DAE and 6 interviews in the span of 31 years.
2. While implementing the scale of pay after 5th CPC, Dr. Madhavan Nair Committee recommended to abolish the Technician ‘B’ to overcome the recommendation of merger of the scales of pay of Technician ‘A’ and ‘B’ (Rs 950 – 1150 & 1150 – 1500). Tradesman ‘C’ was abolished prior to 5th CPC itself. Hence after the implementation 5th CPC, DOS was operating only 8 scales of pay for Technicians.
3. To bring the parity with the scale of pay operating in DOS, The designation Tradesman K should be abolished and the said scale of pay should be given to Tradesman ‘J’.
4. 5th Central Pay Commission in its suggested vide para No. 43.7, 43.8 & 51.34 to upgrade the entry level pay for Technical staff in the pre revised pay exists during that time, i.e. Rs 1320 – 1800. If that were implemented during the implementation of 5th CPC recommendations, the entry level for Technician would be Rs. 4000 – 6000. The matter is still pending with DAE for arbitration and understood that the Ministry of Personnel asked to consider/settle the issue, based on the recommendation of the SCPC.
5. SCPC has been upgraded the pay scales of Nurses from Rs 5000 – 8000 to Rs 7450 – 11500 and correspondingly other grades too. The upwardly revised pay structure may be extended to the nursing staff.
6. Nurses in DAE have been included in the Technical Cadre on par with Scientific Assistants. Staff nurse having the qualification of BSc Nursing was in the scale of pay of Rs 5000 – 8000. Now SCPC upgraded the scale of pay of staff nurses into the scale of pay of Rs 7450 – 11500. The prescribed qualification for Scientific Assistant ‘A” BSc/Diploma in Engineering and with in house training they were given the grade of Scientific Assistant ‘B’ post in the scale of pay of Rs 5500 – 9000. To maintain the horizontal & vertical relativity of all Technical grades, those technical posts in the scale of pay of Rs 5000 – 8000 should bring into the scale of pay of Rs 7450 – 11500.
7. Primary School Teachers are in the scale of pay of Rs 4500 – 7000 which is equivalent to Tradesman ‘D’. Qualification for primary school teacher is SSC +2 + one year Teachers’ Training Certificate. SCPC recommended higher grade in the scale of pay 6500 – 10500 for Primary Teachers Grade III with promotional post in the grade of 7450 – 11500. To ensure the horizontal – vertical relativity the scale of pay of Technical staff should be upgraded.
8. Draftsman in DAE has been put at the entry level of Rs 4500 – 7000 as Tradesman (Drg). With three years of experience Draftsmen have been offered the scale of pay of Rs 5000 -8000. It is pertinent to note here that the draftsman course is a two-year certificate course offered by ITI under Labour Ministry who also conducts other certificate courses for various trades. But only in DAE has given an extra ordinary consideration for the Draftsman course by equating the same with Diploma Course conducting by Polytechnics under Board of Technical education of respective states/BSc from various universities. Even in the Department of Space the Draftsman are given the same scale of pay on par with other Technicians starts with Rs 3050 – 4590. To ensure parity with Drafts man & Tradesman of DAE, in future draftsman also is included in the Training programme offered by DAE in Category II. However the present draftsman should be protected by ensuring the present grades & promotion avenues.
9. As per the Order issued by Health Ministry the Dental Technicians should be in the scale of pay of Rs 5000 – 8000.
10. Initial appointment of Pharmacist was in the grade of Rs 1350 – 2040. Fifth CPC has been merged the scale with Rs 1400 – 2300 and the corresponding scale has been given as Rs 4500 – 7000. But in DAE the initial grade was been given on par with Rs 1320 – 2040 and corresponding scale of Rs 4000 – 6000 was given to Pharmacist ‘A’. When implementing the recommendation of Anand Committee, the scale of pay of Pharmacist was not upgraded as done in other cases. Thus the Pharmacist grade has been brought down on par with Tradesman ‘D’. To meet the discrepancies facing by the pharmacists the entry level grade may be upgrades to Rs 5000 – 8000 and correspondingly higher grades may be recommended for Pharmacist ‘B (spl)’, ‘C’, ‘D’ and so on.
11. Data Entry Operators in the Department were appointed based on the specific qualification in their filed. But the recommendations of Fifth CPC have not been implemented. SCPC also recommended up gradation of certain scales for DEO/DPA.

Considering the above-mentioned points, we suggest the following Pay scales for Technical Staff:
ADMINISTRATIVE/ ACCOUNTS STAFF:

As per the Second Cadre Review, the minimum qualification for entry level recruitment in administration/accounts cadre has been modified as graduation with typing skill and computer knowledge.

Similarly the minimum qualification of Stenographers also has been enhanced to Graduation with pass in Shorthand and typing skill and computer knowledge.

Almost all major departments such as Income Tax the LDC has been brought into the grade of 4000 – 6000 after the successful implementation of Cadre Review after 5th CPC.

Job of our administrative staff involves in project developments, attached with scientists/technocrats. Preparation of scientific/technical notes, materials for seminar, technical discussions etc

Workload has been increased substantially after the reduction in staff strength.

Administrative & Account staff only having career progression based on the vacancy oriented promotion scheme.

Considering the above points and the recommendations of 2nd Cadre Review Report of the Department, we suggest the following upgraded pay scales for administrative and accounts staff:
PURCHASE & STORTE PERSONNEL:

1) Directorate of Purchase and Stores having head quarter at Mumbai and regional purchase & stores units located in parts of India is a service organisation mainly responsible for procurement of materials and services to the various projects of the Department of Atomic Energy and last 3 decades provided satisfactory services to complete various projects.

2) The Cadre is a unique cadre apart from the Accounts and Administration and also maintaining separate identity and is now one of the isolate cadres without having any type of financial upgradation.

3) In view of para 2 duties and responsibilities are also unique as under:-

The DIRECTORATE OF PURCHASE AND STORES (DPS) is a constituent Unit of the DEPARTMENT OF ATOMIC ENERGY (DAE) catering to the needs of various programs of the DAE in the matter of procurement of equipment, materials, components, raw materials, plant and machinery spare parts etc. and other Materials Management functions related thereto. Due to the sensitive nature of activities, DAE has been exempted from the purview of Directorate General of Supplies & Disposal (DGS&D). The services of DPS employees are transferable all over India as the Directorate is having more than 20 units all over the country.

4) The Pay commission justifies equal pay for equal work, but the nature and duties of Purchase and Stores are very unique and none other staff working under Accounts and Administration are entrusted with such a type of duties and responsibilities. Said Cadre deserved upgradation of pay scale under part-B of the first schedule of the notification dated 29th August 2008 issued by Department of Expenditure, Ministry of Finance.

5) The post of Store/Purchase Clerk is the lowest feeder category for DPS Cadre. The person has to carry highly responsible & important jobs of materials handling including the other office works at par either Administrative/Accts jobs, whereas this post has very low pay scale & poor future prospectus. The well-qualified person if somehow joins DPS, within short period either he quit service or frustrated due to aforesaid reasons. Therefore this post deserves up gradation of pay scale.

6) Jr. Purchase Assistant/Jr. Store Keeper grade were in the pay scale of Rs. 1200-2040 in the fourth CPC were fixed in the corresponding pay scale of Rs. 4000-6000. In this connection equivalent post in store keeping staff operated in the Military Engineering Services were upgraded to the pre-revised pay scale of Rs. 1600-2660 and fixed in the pay scale of Rs. 5000-8000. The Jr. Store Keeper/Jr. Purchase Assistant post is feeder as well as promotion (50%+50%) They have to shoulder very important high responsibilities of materials management, whereas the pay scale is very low. Therefore proposed pre-revised pay corresponding revised pay scales in respective pay band & grade pay is fully justified for this post. Therefore the pre-revised pay scale of Rs. 4000-6000 should also be upgraded to the pay scale of 5000-8000 and corresponding pay scale of Rs. 9300-34800 in PB-2 with corresponding grade pay of Rs. 4200 may be granted.

7) Prior to 4th Pay Commission & after Implementation of 4th CPC Assistant, Assistant Accountant, Purchase Assistant and Store Keeper were in the same pay scale. During 5th CPC Assistant Accountant were fixed in the pay scale of Rs. 6500-200-10500 and Assistant in the CCSS were fixed in the pay scale of Rs. 6500-200-10500 but equivalent post in DAE were fixed in the pay scale of Rs. 5500-175-9000 whereas Purchase Assistant/Store Keeper who are equivalent to Assistant Accountant & Assistant were kept in pay scale of Rs. 5000-150-8000. Store Keeper/ Purchase Assistant is the promotion post for JSK/JPA and is the key post of DPS Cadre. As they cater most of the high responsibilities of management of materials directly & in-charge of materials sections as also Govt. charges for Fidelity Bond payments from them. They acquired the deep technical knowledge about each & every materials procure, receipt, check, classify/codify, storage, preservation, account, issue & dispose off in addition to keep manual as well computerized inventory of records. This post, therefore highly justified to be placed in the higher pay scales as has been awarded by other Govt. Deptts. & Also for Admn./Accts cadre. Hence the pre-revised Rs. 5000-8000 were operated in this Department for the post of Purchase Assistant/Store Keeper should be upgraded to the pre-revised pay scale of Rs. 7450-11500 shall be placed in the corresponding pay-scale of Rs. 9300-34800 in PB-2 with corresponding grade pay of Rs. 4600.

8) The Sr. Store Keeper / Sr. Purchase Assistant post has been created by 1st Cadre Review by DAE to remove stagnation of SK/PA. Senior Purchase Assistant/Senior Store Keeper who were drawing pay scale of Rs. 5500-9000 should be placed in the pre revised scale of Rs. 7500-12000 in the PB-2 with revised pay scale of Rs. 9300-34800 with next corresponding grade pay of Rs. 4800 may be granted.

9) Similarly Asstt. Purchase Officer/ Asstt. Stores Officer who was in pre-revised pay scale of Rs. 6500-10500 should be upgraded to the pre-revised of Rs. 8000-13500 and be fixed in PB-2 with corresponding pay band of Rs. 9300-34800 with corresponding grade of Rs. 5400. If the proposal submitted is accepted and implemented will help to solve disparities between Section Officers in the CSS (DAE) and Assistant Purchase Officer/ Asstt. Stores Officer in this Department who were in the equal pay scale since second pay commission onwards till implementation of report of Fifth CPC.

10) By seeing the above anomalies/discrepancies and based on the recommendations of the 2nd cadre review of DAE we suggest the following upgraded pay scales for Purchase & Store Staff:

Consequent upon recent amendment to 2(13)and Section 12 of the payment of Bonus Act 1965 enhancing the calculation ceiling effective from 1.4.2006 the question of extending similar benefit to Central Government employees has been under consideration of the Government. Dear Comrades,

The extended meeting of NFAEE was held on 17th & 18th September 2008 at the ARWA/JCM office Anushakthi Nagar, Mumbai 400 094. The detailed circular shall be send immediately. The decision of the meeting is given below:

1. PAY COMMISSION RELATED MATTERS

Draft structure of up gradation shall be circulated through email to all affiliates by 19th September 2008. All affiliates should discuss the same in the Executive Committee/Managing Committee/employees concerned and send back with modifications/alterations/ addition etc with supporting documents before 25th September 2008. If time permits the correctedversion shall be re-circulated for confirmation and submit to the Department by 30th September. In case the Department convened the meeting of Suri Committee before that and asked to submit the proposal in-between based on the inputs received from the affiliates, the corrected version shall be submit to the Department before 30th September 2008.

2. CALL GIVEN BY CONFEDERATION OF CG EMPLOYEES & WORKERS

Confederation of CG Employees & Workers has been a given call to observe 19th September as Strike Declaration Day in all Central Government Offices. As office bearers of affiliates are away from units to attend the Working Committee meeting at Mumbai, it is decided to organize the programme before 24th September in all units by organizing meeting of employees and passing the resolution addressed to the Prime Minister, Cabinet Secretary. It is also decided to send a copy of the resolution along with the Charter of Demand to the Secretary DAE too.

3. ORGANISATIONAL ISSUES

A. STREAMLINING THE ORGANISATION STRUCTURE

To streamline the Organizational structure it is suggested to bring the tenure of affiliate’s union/association same period as well as tenure year. For this the Unions/ associations has to amend the bye laws to ensure three year shall be the tenure. If Department not accepting the same, then Federation should bring down the tenure to two years. One time relaxation has to be given to bring the election of new committee for the same period. It is decided to discuss the issue with Department for getting approval for the amendments/modifications required to streamline the organizational structure.

B. SUBSCRIPTION

At present the rate of subscription varies from Rs 2/- to Rs 10/- per month per member. It is suggested to bring uniformity by taking step to increase the rate of subscription to Rs 10/- per month as the pay revised. Also approach the Department to deduct the Subscription for Federation though check of system which is one of the conditionality of recognition under CCS (RSA) Rules 1993

4. FUND COLLECTION

The meeting decided to collect Fund from the employees to create a Working Fund for Federation as well as to the affiliated unions and associations. It is also proposed to create a FIXED DEPOSIT for NFAEE for emergency requirement. Decided to collect at least Rs100/- from employees and out of which Rs 50/- shall be given to the Federation. Federation has to give Rs 20/- per member to Confederation of CG Employees & Workers for their Working Fund. It is also decided to print Donation Coupon to those associations/unions required the printed coupon from the Head Quarters. Also decided to collect the fund only in the month of October and shall be completed the collection by 31st October 2008 and remitted the quota to the Head Quarters immediately.

5. ALL INDIA CONVENTION

It is also decided to organize All India Convention of DAE employees in the month of October to popularize the demands on Pay Commission and other issues. GSO EA informed that, after discussion in JAC Kalpakkam they will communicate the possibility to conduct the Convention in Kalpakkam in the middle of October2008. Other wise the Head Quarters will communicate the venue and date after finalizing the place for convention.

Detailed circular follows. All are requested to take appropriate decision to implement the decisions taken in the Working Committee and intimate the action from your side.

SCIENTISTS PROTEST AGAINST DISCREMINATION

COAST Meeting at Bangalore – 21.09.2008

Second meeting of Confederation of Atomic and Space Scientists/Technologists (COAST) was held at Bangalore on 21st, September 2008. Scientists from various parts of the country, working in various units of DAE and DOS attended. A total of 22 members participated in the meeting and involved in all the deliberations. The members are from Bhaba Atomic Research Centre (BARC)-Mumbai, Indira Gandhi Centre for Atomic Centre-Kalpakkam, Raja Ramanna Centre for Advanced Technology (RRCAT)- Indore, Nuclear Fuel Complex (NFC)- Hyderabad, Atomic Minerals Directorate for Exploration & Research (AMD)-Hyderabad, Vikram Sarabhai Space Centre (VSSC)-Trivandrum, ISRO Satellite Centre (ISAC)- Bangalore, Master Control Facility (MCF)-Hassaan near Bangalore, National Remote sensing Agency (NRSA)- Hyderabad, Liquid Propulsion Systems Centre (LPSC)- Trivandrum etc. attended the meeting.

Scientists/Engineers met on the second COAST meeting exhibited the concern over the exodus of experienced scientists from these premier departments DAE & DOS. In order to attract and also retain the young scientific talents in these organisations, a 'Save India Campaign' was launched. The need for the separate pay package for the scientists/engineers in the country has been emphasized. It was vetted by the committee that a Ombudsman committee be formed with all the unit heads of these departments with the visible participation of DOS & DAE, COAST members too in order to address the grievances of the Scientists/Engineers and also to set right all the anomalies. Also COAST decided to forward the same request to PM and also seek his audience on these issues to protect he interests of the scientists/engineers in these premier research organizations.

It was also brought out by the committee to reduce the number of scientific posts and to have faster career growth in these departments. The committee also decided to bring forth a national level seminar to emphasize the significance of the development of indigenous science & Technology in our country to compete with the global market and also to cut down the inflations that is prevailing in the country.

COAST critically reviewed the present scenario and suggests these departments and also Government to take steps immediately to protect and preserve the robust knowledge base of these departments which otherwise will have a major set backs by the brain drain.




Scientists demand parity in salary

Bangalore: Scientists from the departments of space and atomic energy, including the Indian Space Research Organisation (ISRO), have expressed “disappointment” over the verdict of the Sixth Pay Commission and have demanded parity of salaries with employees of other services such as the civil services.
The scientists, under the aegis of the Confederation of Atomic and Space Scientists/Technologists (COAST), wrote to the Prime Minister in May last but received no response, said S. Joseph Winston, Scientific Officer at the Indira Gandhi Centre for Atomic Research (IGCAR) and president of COAST.
COAST had, in the letter, pointed out that while young scientists join these departments at Rs. 21,000, they receive only a 65 per cent increment in 20 years, placing their salary at Rs. 36,000. COAST had also expressed concern that the recommendations of the Sixth Pay Commission “would lead to a collapse of the scientific and technological base in India.”
The attrition rate among scientists in these departments is alarming and the loss is an irreplaceable one, said Dr. Winston. “As these scientists have been specially trained, it is difficult to fill the post with qualified people. It is in the interest of the country to curtail this trend.”
Scientists have been choosing multinational companies, the information technology sector, and work overseas as salaries are more attractive, he said.
The pay package of the entry and middle level grades (scientific officers of grades C to E) in particular should be increased to retain them, said Dr. Winston. “The Prime Minister had promised a ‘Technology Excellence Pay’ as incentive, which is a sum equivalent to a minimum of 40 per cent of the scientists’ basic pay. He has not kept his promise.”
Promotions
Another concern is that promotions in these departments take far longer than in other services such as the civil services. “Those who join the civil services are able to reach the position of joint secretary in 14 years, but it would take nearly 25 years for scientists to reach corresponding positions in the departments of space and atomic energy,” he said.

Sub: Implementation of the CCS (Revised Pay) Rules 2008 – Reg.

Sir,

This is in continuation with our earlier letter No. nfaee/sg/08/123 and 125 regarding above mentioned subject. As we indicated in our earlier correspondence, the Resolution issued by the Central Government on 29th August 2008 and the notification promulgated subsequently contains number of discrepancies, anomalies, inequitable principle. As the discontentment among the employees are increasing day by day, in various area where these discrepancies exists such as in deriving minimum pay, multiple factor to derive the pay structure for various grades, matters pertaining to promotion, deviation of the existing ACP of the financial upgradation to grade hierarchy to pay hierarchy etc. We hope the department also agrees with the grievances already raised by the employees and will take up to the Government to resolve the same.

Through this letter we would like to bring to your attention that by implementing the Government notification to revise the pay based on the CCS (Revised Pay) Rules 2008, in DAE there certain issues are going to be create which will certainly to be addressed before issuing the DAE notification, other wise there shall be discontentment among the employees in almost all sections of employees. The major issues to be addressed at the earliest are briefly explained below:

I. Group D Employees:

a. If the Government upgraded the existing entry lowest scale of pay of Rs 2550 – 3540 to Rs 2750 – 4400, it would be a welcome step as it is upgradation. But now through the notification Government merged all existing scales of pay for Group D employees into Rs 2750 – 4400. The result of this decision shall be bringing Mali A, Helper A, Security Guard, Wash Boy, Ayah, Sweeper, Mali B/C, Helper B/C, Bearer, Tea/Coffee Maker, Mali D, Helper D, Head Security Guard etc into same existing pay scale of Rs 2750 – 4400. By doing so the senior most employees who is in service for more 15 years and got two or three promotions also bring back into the entry level.

b. Under this circumstance the Department has to take a decision to ensure to extend the equal number of the financial upgradation what they got from the feeder cadre prior to 01.01.2006.

II. Fixation in Merged scales: [CCS (Revised Pay) Rules, 2008 – Part C, section I (ii)]

a. In the notification it is given that the scales of pay Rs 5000 – 8000, Rs 5500 – 9000 and Rs 6500 – 10500 has been merged into one. In fact the Government has not merged these three scales, but created an elongated scale of Rs 5000 – 10500. This can be clear from the selection of initial pay for Pay Band from the existing pay of Rs 5000 – 8000 (5000 X 1.86) and selection of Grade Pay by calculating 40% of the ending pay of the scale of Rs 6500 – 10500 (10500 X 0.4). By doing so, the Government brought back those employees who got promotion from the scale of pay of Rs. 5000 – 8000 into the scales of Pay of Rs 5500 – 9000 and Rs 6500 – 10500 to the pay scale starts with Rs 5000. This is nothing but degradation and not upgrdataion or even merger.

b. These scales of pay is existing in all section of employees in auxiliary, administration & accounts, technical, purchase & stores and hence the discontentment shall be in all those categories of employees.

c. Hence the Department has to take steps to ensure the promotional benefits to the employees by ensuring the existence of grades as earlier by revising the existing scale of pay of Rs 5000 – 8000 with the Grade Pay of Rs 4200 and moving next grade in the scale of pay of Rs 5500 - 9000 into next grade pay and correspondingly upgrading other grades.

d. If the Department initiates to abolish any post in between, then the existing employees in that particular grade should be moved into the next higher grade and cascading effects should be given by moving the employees in those grades into next higher grade to ensure the seniority as well as the promotional benefits.

e. Under this circumstance, we request the Department not to take any hasty decision to replace the pay scales of various grades existing in the Department for various section/categories. We request that the Department should consider all aspects to protect the promotional benefits acquired by the employees on their merit. Therefore we request the Department to immediately issue instruction to calculate the arrears to be paid to employees in the corresponding pay scale as mentioned in the notification No F.No 1/1/2008 – IC, dated 30th August 2008 and accordingly give the arrears to the employees. Thereafter in consultation with the similar Department such as Department of Space, DRDO as well as with the representatives of the recognized Federation/ Unions and associations of this Department, the proper pay structure may evolve for all sections of employees and accordingly implement the same.

III. Other issues:

1. Assured Career Progression:

While recommending 3 Assured Career Progression (ACP) to those employees who spent ten years continuously in the same grade, the Government watered in the present ACP. As per the present ACP, The employee who completed 12 years in the same grade is eligible for financial upgradation equivalent to the pay in his next promotional post. But in the proposed ACP, the financial upgradation where the promotional post is not in next grade pay, while considering for ACP, the employee shall be given the financial upgradation in the next pay structure in pay hierarchy and when the employee will get the financial upgradation corresponding to his promotional post at the time regular promotion. By doing so, in certain case, the employee who gets two financial in the span of 24 years in the present system shall be better than the new financial upgradation in the span of thirty years. Hence the Department should be taken up this matter with the Government to ensure financial upgradation equivalent to the next promotional post.

2. Over Time Allowance:

In the Government notification it was mentioned that the recommendations related to Overtime Allowance will be examined separately. In this regard without prejudice to our demand after 5th Central Pay Commission, we would like to mention here that it is responsibility of the Department to ensure revision of Overtime Allowance of the employees who perform Overtime as per the requirement of the Operational, maintenance and to over come the other emergency situation in the R&D establishments of the Department as in the Industrial units. In this regard, the activities of the Department should be taken as Industrial activity as in the case of Railways. The Department should take care of notify the order pertaining to OTA for R&D and other establishments also along with Industrial units.

3. Patient Care Allowance & Risk Allowance:

In the Notification it is mentioned that the Hospital Patient Care Allowance/Patient Care Allowance and Risk allowance will replace with Risk Insurance Scheme with effect from 01.04.2009 after consultation with the Staff side. Here too the Department too takes up the matter with the Government to ensure to continue the Patient Care Allowance as well as Risk Allowance as their is no logic to extend Risk insurance to the employees who suffered fatal due to the risk involves in the infectious deceases and other risk in case of the hospital staff and risk involves where the risk allowances are recommended. Hence the Department should take efforts to ensure to retain the Patient Care Allowance as well as Risk Allowance as exists and the Risk Insurance may be introduced as an additional benefit.

4. Transport Allowance:

Since the Government removed the condition “one Kilometer and with in Campus” in the earlier order by which Transport Allowance was extended to the employees, majority of the employees may eligible for Transport allowance.

In DAE, retaining buses are mandatory as per the international laws and therefore drivers also. Using that facility, we request the Department to consider continuing the Transport Facility by working out a methodology with mutual consultation. It is pertinent to note here that, before the introduction of the Transport Allowance also, Department was plying buses to various part of the city in all DAE units, by charging minimal amount towards the fuel expenditure along with subsidy from the Department. In the present condition it may be possible, by working out the exact expenditure towards the fuel which can be deducted as certain % of the Transport Allowance from those employees using the Transport facility extended by the Department.

There are few more anomalies/discrepancies while implementing the Government Notification. The same shall bring to the notice of the Department after detailed discussion among the affiliated unions and associations and other organizations. In this regard we would like to present our case in person. As the Department arranged immediately after the Report of SCPC released, a meeting of the office bearers of the Federation along with the President & General Secretaries of the affiliated unions and association may called to present our views.

It shall be highly appreciated an early appointment for a short duration and expecting a positive reply.

Sir,

We would like to invite the attention of the Department/ Government that if the Government notification issued on 29th August 2008 to revise the Pay scales of various categories of DAE employees represents NON SCIENTIFIC COMMUNITY as well as the entry level of scientific officers grade, the anomalies/discrepancies brought out to the notice of the Department as well as to the Government shall continue and the discontentment among these categories of employees continue as unresolved

It is sorry to mention here that it shows the Department failed to convince the Secretaries committee constituted by the Government to study the recommendations of the Sixth Central Pay Commission (SCPC) about the various anomalies in the recommendations and thus the Government has not made any modifications to ensure the better pay, promotional benefits, retaining the promotional avenues etc.

Though the entry level of a Central government employee is upgrades as in the pre revised scale of pay of Rs 2750 – 4400 in place of Rs 2550 – 3540 is a welcome step, the decision to merge all scales of pay of the Group D into single pay scale is nothing but denial of financial up gradation for the senior most employees which they gain during their entire service.

Similarly, the decision to abolish the scales of pay of Rs 5000 – 8000 and Rs 5500 – 9000 and bring those employees in the revised scale of pay of Rs 6500 – 10500 too welcome step, but here too senior most employees are the victims for not recommending financial upgradation. In fact the employees in the scale of pay of Rs 5500 – 9000 and 6500 – 10500 brought down into the scale of pay of 5000 – 8000 , thus taken away the benefit of one/two promotion they got in the service carrier as the case may be. This anomalies applies all section in auxiliary, administration, accounts, technical, purchase, stores and in the initial level of scientific officers.

It is also observed that the Department/Government enhanced the benefits of senior scientific community starts from Scientists F (SF) and above by ensuring lifting pay band from PB 3 to PB 4, ensuring the two increments and enhancing the special pay of Rs 2000/- to Rs 4000/- etc. Further the Department took effort to ensure better increment rate 4% for 20% of the scientific staff in PB3 and benefited by the enhancing the grade pay of these categories.

While appreciating effort by the Department to ensure better pay structure for the senior scientific community of the Department along with Department of Space (DOS) and Defence Research and Development Organisation (DRDO), we expects the same approach towards the other section employees in the non scientific community as well as that scientific officers in the junior level. It is pertinent to note here that with out the co operation and joint effort all section of employees, the Department cannot move towards growth, for which satisfying a meager section of scientists only will not give results. Especially when the brain drain happens in the entry level of Scientists and Technocrats including Technicians than in the senior most scientists/technocrats, a scientific approach should be applied to the pay revision to attract, retain the brilliant/scholars in the Departments.

But it is very unfortunate to note here that the revision in the pay for non scientific community will ensure a meager 21% to 40% pay rise for non scientific community where as an increase from 81% to 121% to the senior scientific community which most inequitable and is not based on any scientific principles. To over come the discrepancies as well as to ensure satisfaction among all section of employees, at least the existing promotional avenues as well as the benefit of the promotion already availed by the senior employees, Department has to apply scientific approach by taking the employees and there representatives into the confidence while revising the pay scales as per the Revised Pay Rules 2008.

It is` therefore request you to take initiative to ensure to remove anomalies/discrepancies while implementing the Revised Pay Rules in DAE.

While appreciating effort by the Department to ensure better pay structure for the senior scientific community of the Department along with Department of Space (DOS) and Defence Research and Development Organisation (DRDO), we expects the same approach towards the other section employees in the non scientific community as well as that scientific officers in the junior level. With out co operation and joint effort all section of employees, the Department cannot move towards growth, for which satisfying a meager section of scientists only will not give results. Especially when the brain drain happens in the entry level of Scientists and Technocrats including Technicians than in the senior most scientists/technocrats, a scientific approach should be applied to the pay revision to attract, retain the brilliant/scholars in the Departments.

But it is very unfortunate to note here that the revision in the pay for non scientific community will ensure a meager 21% to 40% pay rise for non scientific community where as an increase from 81% to 121% to the senior scientific community which most inequitable and is not based on any scientific principles. To over come the discrepancies as well as to ensure at least the existing promotional avenues as well as the benefit of the promotion already availed by the senior employees, Department has to apply scientific approach by taking the employees and there representatives into the confidence while revising the pay scales as per the Revised Pay Rules 2008.

Hence this general meeting calls upon the Secretary to the Government of India, Department of Atomic Energy to take initiative to ensure to remove anomalies/discrepancies while implementing the Revised Pay Rules in DAE.

The meeting further resolve to initiate discussion with the representatives of the employees – office bearers of NFAEE as well as ---------------- (name of the union/ association) – about their proposals before revising the pay structure of DAE employees.

The resolution may pass in the general meeting/lunch hour meeting (as the case may be) and send to DAE on 5th September itself. A copy may be given to the Head of your units by meeting him in personally to intervene and explain the gravity of the situation.


STRIKE DECLARATION DAY – 19.09.08:

In the National Executive Committee meeting of the Confederation of Central Government Employees & Workers held on 26th August 2008, it was decided to initiate agitation against the Governments’ approach on the suggestions submitted by the staff side on various retrograded recommendations of Sixth Central Pay Commission (SCPC). To start with the agitation, the National Executive decided to observe Strike Declaration Day on 19th September 2008 by organizing meetings, badge demonstration etc. In the meeting charter of demand should declared and send to the Prime Minister, Cabinet Secretary and to the Head of the units of the concerned Department

All affiliates are requested to send their suggestions to be added into the Charter of Demand (the issue shall be common in nature) to the NFAEE Head Quarters before 8th September 2008, so that the same can be compiled and send the Head Quarters of Confederation of CG Employees and Workers before 10th September 2008. The Secretariat of the Confederation will finalise the Charter of Demand based on the suggestion received from the affiliated on 10/11th September 2008 and there after will circulate.

All affiliates are requested to issue the notice to the Department on 10.09.08 for observing STRIKE DECLARATION DAY on 19th September 2008. Though Working Committee Members proceeding to Mumbai to attend the Working Committee meetings all affiliates are requested to ensure that programme on 19th September 2008 conducted in all units.

NFAEE WORKING COMMITTEE – 17.09.08:

As mentioned in the notice issued for the Working Committee meeting of NFAEE, the meeting shall be held on 17th September 2008 at Mumbai. All affiliates are requested to send the following details:

· The posts (designation wise) operating in all units and the sanctioned as well as the existing staff strength in each category.
· Anomalies/discrepancies observed by the associations/members in the Central Civil Services (CCS) Revised Pay Rules 2008 issued on 29th August 2008 and the suggestions to remove such anomalies before 12th September 2008, so that all such suggestions can be compiled and circulate, so that the time can be saved in the meeting to presentation.

Ensure the participation of all Working Committee Members in the meeting apart from the DC members.

Sub: Implementation of the Government notification on Pay Revision 2008.

Sir,

The Government of India notified the Revised Pay Rules 2008 on 29th August 2008 and directed all Ministries and Department to implement the same at the earliest. In this regard we would like to call your attention that:

· While issuing the above mentioned notification the Government has not been considered the discrepancies in the recommendations of Sixth Central Pay Commission and the implementation of the notification as it may invite discontentment among the staff belongs to the non scientific community

· The Government while recommending merger of the pay scales at various level not consider the cases of senior employees who got the promotion. By merging the pay scales of Rs 6500 – 10500, 5500 – 9000 and 5000 – 8000, the Government in fact being done the degradation of Rs 5500 – 900 and 6500 – 10500. This nullified the promotion benefit of the employees who rendered more years of the service in the Department in Technical, administration, Auxiliary, Purchase & Stores.

· The Government has not considered the consequence of placement of all Group D employees in the revised scale of Pay of Rs 2750 – 4400. In this case too the Group D employees numbering about 3000 of this Department who rendered their service more than 20 years placed with the new incumbent.

Under this circumstance, we request you to give necessary direction to the concerned not to issue replacement pay scales in a hasty manner. We request that the Department should consider all aspects to protect the promotional benefits acquired by the employees on their merit. Therefore we request you to immediately issue the corresponding pay scale as mentioned in the notification No F.No 1/1/2008 – IC, dated 30th August 2008 and accordingly give the arrears to the employees. Thereafter in consultation with the similar Department such as Department of Space, DRDO as well as with the representatives of the recognized Federation/ Unions and associations of this Department, the proper pay structure may evolve for all sections of employees and accordingly implement the same. This may defuse the discontentment among the employees.

In this regard we would like to present our case in person. So it is highly appreciated an early appointment for a short duration.

GOVERNMENT RELEASED GAZETTE NOTIFICATION IN THE MID NIGHT-
A LATE NIGHT AFFAIR OF THE GOVERNMENT

Dear Comrades,

The Gazette Notification by the Government of India has been published yesterday LATE NIGHT in the website of Ministry of Finance. This was done after circulating the unofficial copy of Notification to our affiliates through email. Now we can say that what is exhibited by us is authentic. However comrades who want to verify the original Notification of Gazette can visit the Finance Ministry website http://www.finmin.nic.in - Both Hindi and English version of Notification is available in the above Finance Ministry website.

Since the official Notification has been published by the Government, the immediate reactions/preliminary comments and observations on the common issues hereunder:

NEGATIVE:

1. As already analysed by the National Executive of Confederation of Central Government Employees the denial of Need Based Minimum Wage as per 15th ILC norms Rs.10,000 for Group 'D' but only granting of Rs.7,000 as Minimum wage to Group 'C' is most disappointing.

2. The fitment formula of 1.86 times of basic pay as on 1.1.2006 do not ensure even minimum wage rise of 40% to employees while the Group A officers

3. Group D employees without Matriculation qualification would only get the fitment in 1S scale with 1300/- grade pay and not PB-1 scale with 1800/- pay now until they are retrained suitably. The Non-Matriculate Group D officials who retired between 1.1.2006 and now would not be eligible for the PB-1 at all and thus deprived even this minimum wage of 7,000/- level and therefore their pension benefit would go down which is a major disappointment to the low paid employees.

4. Recommendation of pay commission to not to allow Merger of Dearness Allowance with Basic Pay at any stage is accepted. This is going to make a big difference and negative impact on our wages in future.

5. The three Assured Career Progression (ACP) is recommended in the Pay hierarchy not in the grade hierarchy, which great loss to the administrative & auxiliary staff

Transport Allowance - The employees below Rs.4000/- basic pay in the existing pay scales are going to get very less increase because of acceptance of recommendation for abolition of CCA.
7. Flexi-time for women employees and flexi-week recommended for physically challenged are rejected by the Government.


POSITIVE:

1. Transport Allowance for those employees in the basic pay of 4000/- in revised pay scales also will be on par with those who are in grade pay level of 4200/- to 4800/-. These employees will get 1600/- + DA on it in Metro Cities and 800/- + DA on it in all other places.

2. Campus restriction for Transport Allowance is removed by the Government so that all employees who occupy campus attached quarters [like SPM Quarters] will also be eligible for Transport Allowance.

The modification by the Government for granting two uniform dates of annual increments to facilitate drawal of increment either on 1st January or on 1st July is am improvement.

Benefit of one increment is given to avoid bunching of more than two stages in the revised running pay bands [But @ 3% of basic pay in pay band without including Grade Pay].

5. Rejection of the recommendation for reducing the Holidays only to National Holidays and allowing the status-quo is welcome.


CONCLUSION:

The decision of the National Executive of Confederation of Central Government employees & workers to go for an indefinite strike is the only alternative for opposing the retrograde stand of the Government on many issues like Need Based Minimum wage, Denial of uniform fitment benefit to all, Denial of Transport Allowance minimum 1200/-+DA on it for Metro and 800/-+DA on it for other places, Denial of Minimum 10% fixation benefit on promotion, Denial of ACP on grade hierarchy etc.

The Working Committee meeting scheduled to be held on 17th & 18th September shall assess thread bear the Government Notification & take important decisions to ensure justice to the workforce for of the Department

Let us concentrate to build a powerful movement by forging unity with all possible organisations outside the Confederation and let lose a powerful campaign and agitational programme to culminate in indefinite strike. Acceptance without further increase would result in huge loss.

Confederation Decides to Organise Indefinite Strike

The extended meeting of the National Executive Committee of Confederation of Central Government employees and workers held at New Delhi on 26th August, 2008 deliberated upon the refusal of the Government of India to accept any of the major suggestions made by the Employees organizations under the auspices of the JCM National Council, on the 6th CPC recommendations. It noted with disappointment that the Government did nothing to correct the wide disparity in wages amongst the employees and officers accentuated by the recommendation of the 6th CPC.

By suppressing minimum wage without any justifiable reason, the meeting noted that the wage structure of Group B, C and D cadres has been depressed with devastating impact for many years to come. The abolition of Group D posts numbering about 9 lakhs has opened up vast avenue for contractorisation of various Group D functions. It rightly observed that in the days to come the Government organizations will have more daily rated contract workers than regular employees.

The meeting came to the conclusion that the Government's decision warrants serious agitational approach and decided to call upon the Central Government employees to mobilize themselves for an indefinite strike Programme to generate necessary sanctions to compel the Government to enter into meaningful discussion over these issues with the employees' organizations and settle them satisfactorily. All the constituent units of the Confederation have been advised to meeting in their national convention/conference and endorse the decision of the indefinite strike action immediately. The National Executive Committee will again meet after holding discussion with the sister organizations in Defence etc. in the month of November, 2008 to decide upon the date on which the said indefinite strike action should commence.

The strike will be organized in the first fortnight of December, 2008 if the Government does not come forward for discussion, negotiation and settlement of the under mentioned Charter of Demands.

The extended meeting of the National Executive of Confederation was held on 26th August, 2008 at New Delhi ( at IT Recreation Club hall). The representatives of twenty affiliated All India organizations and eleven State COCs were present at the meeting, besides the National Executive members.

It was thus a well represented meeting. The meeting briefly reviewed the strike Participation of Central Govt. employees on 20th August 2008 and endorsed the Press statement issued by the Confederation on that day, which had indicated the overall picture. The meeting evaluated that the announcement of the Govt.'s acceptance of the 6th CPC recommendation (even though major demands of the employees had been rejected) had created certain confusion amongst the rank and file of the workers, which had adversely affected the strike participation in certain areas, especially the northern and western India. The meeting attributed this mostly to the failure to combat the media propaganda.

The meeting came to the conclusion that the Govt.'s decision without conceding any of the major suggestions made by the employees organizations in the JCM was a serious matter and if not contested would bring about devastating impact on the wage structure of the Central Govt. employees. The meeting pinpointed the following issues, on which absolutely unsatisfactory position has been taken by the Govt.

a) Minimum wage
b) Contractorisation of Group D functions
c) Fitment formula
d) Financial benefit on promotions
e) Transport allowance, daily allowance etc.
f) The denial to give effect to the revised allowance from.1.01.2006. etc

The meeting also took note of the delay in the submission of the report of Natraja moorthy Committee on GDS Pay revision.

The meeting came to the unanimous opinion that:

a) Without organizing a serious industrial action of a prolonged nature including indefinite strike, no fruitful/meaningful negotiation or settlement is likely to be brought about.

b) A serious campaign has to be under-taken by holding department/organization- wise convention and state wise conventions to mobilize the employees for a militant action like indefinite strike.

c) Besides the CPC related issues, the other major pending issues, viz Compassionate Appointment, Board of Arbitration awards, Continuing ban on recruitment and abolition of posts, Outsourcing, Privatization, Contractorization, Regularization of existing daily rated workers, Bonus ceiling etc. should also be projected for settlement through the strike charter.

d) Serious consultation with the leadership of AIDEF should be made to explore the possibility of a united action.

e) Strike ballot has to be employed as a means of mobilization and to ensure that the decision for such a serious action has the seal of approval of all members.

f) The date of commencement of such action is to be decided by the National Executive on conclusion of the strike ballot by all the affiliates and in consultation with the sister organizations.

g) The proposed action should be slated to take place within a period of 3- 4 months time.

h) The draft resolution and charter of demands prepared by the Secretariat will be placed in the website as early as possible to elicit suggestions and amendments to reach the CHQ by 10th Sep., 2008

i) 19th Sept. will be observed as "Strike Declaration day" (SANGHARSH AHWAN DIVAS) throughout the country to popularize the demands and submit the resolution of NE meeting to all heads of offices and departments.

CHARTER OF DEMANDS

1. Grant Rs.10,000 as Minimum Wage as per 15th ILC Norms.
2. Grant minimum fitment benefit of 2.625 times of pre-revised basic pay to bring about uniform rise in emoluments.
3. No abolition of Group D posts and functions.
4. Lift ban on recruitment; fill up all vacant posts and scrap Screening Committee.
5. Grant Pension and Status of Civil Servants to GDS.
6. Grant 10% of Pay + Grade Pay as minimum benefit on promotion or financial upgradations.
7. No outsourcing or contractorising of Governmental functions.
8. Fix the date of effect of all allowances as 1.1.2006.
9. No reduction in the commutation value and restoration of full pension after 12 years.
10. Grant statutory defined pension scheme to the employees recruited after 1.1.2004 and withdraw the PFRDA Bill from Parliament.
11. Compute the pension entitlement on the basis of notional pay as on 1.1.1996.
12. No performance related pay or bonus scheme.
13. Implement all Board of Arbitration Awards.
14. Remove the arbitrary 5% ceiling and 3 years condition on compassionate appointment and withdraw court cases and absorb all waitlisted RRR candidates.
15. Implement the revision of bonus ceiling @ 3500/- in the case of Government Employees; Remove adhoc bonus and replace it with PLB and remove the 60 days ceiling.
16. Grant SDA to all employees in NE Region.
17. Revise the Transport and Daily Allowances as demanded by the Staff Side JCM National Council.
18. Direct all the Departmental Heads to settle 6th CPC related department specific demands / problems within a stipulated time limit.




















R e s o l u t i o n

adopted at the Extended meeting of the National Executive of the Confederation of Central Govt. Employees and Workers held at New Delhi on 26-08-2008.

This extended meeting of the National Executive of the Confederation of CGE and Workers held at New Delhi on 26 Aug 2008 unanimously resolves that the decisions taken by the Govt. on various recommendations of the 6th CPC, as is made known are unacceptable in as much as most of the modifications suggested by the employees organizations unitedly to reverse the anti-employee stand of the Commission have been rejected.

The Govt.'s propaganda that it has raised the minimum wage to Rs.7000/- is an untrue statement for the lowest level employees it works out to only Rs.6,040/- on the basis of which only the pay structure has been constructed. The non-acceptance of the suggestion to revise the fitment formula has resulted in the financial benefit flowing in a fortuitous manner whereby the senior employees and those in the higher scale of Pay of the bunched pay scales getting lesser than their juniors. It is deplorable that the arrears are to be paid in two installments of which the major chunk having been deferred by one year especially when the interim relief demanded by the employees was denied. There had been no improvement made in the grant of transport allowances, daily allowance, financial benefit on promotion commutation value of Pension etc. The meeting notes with extreme dissatisfaction that while the commutation value has been drastically reduced the restoration period has not been altered.

It appears that the Govt. has decided to accept the proposal for introduction of Performance related Pay System. Doing away with the present Bonus computation methodology and continue with the drastic downsizing measures and to do away with the Group D employees and hand over their functions for contractors are some of the other major decisions that affect adversely the career and job security of the employees. The meeting realizes that the abolition of Gr.D posts is intended to usher in large scale contractorisation of the permanent and perennial types of jobs. The meeting also notes with pain that the revision of wages affected on the basis of the present decision of the Government will have a deleterious effect in the long run and over a period continuation of 5th Pay scales and allowances would become more beneficial to the employees. While appreciating the decision of the Govt. to raise the ACP from 2 to 3 in acceptance of the suggestion made by the Staff side JCM in their memorandum and the slight increase in the rate of increment and the correction carried out in respect of the actual receipt of DA as on 01-01-2006.

The meeting realizes that the notification on acceptance of the recommendation of the 6th CPC as and when issued will make the picture clearer and the real purport and impact would become discernible to the mass of the employees.

The meeting has come to the inescapable conclusion that without an industrial action of a prolonged duration, no settlement would come about on the CPC related issues. The meeting therefore calls upon the affiliates of the Confederation to mobilize the rank and file of the membership for an eventual industrial action including strike action to take place with the next 2-3 months. The meeting also decides that besides the 6th CPC related common issues the Charter should also include the long pending common issues and department specific demands arising from the acceptance of 6th CPC suggestions by the Govt.

The meeting specifically decides that the demand for pension and Civil Servant status to Grameen Dak Sewaks must be included in the strike charter of demands.

The meeting has directed the Secretariat to get in touch with the leadership of the AIDEF to explore the possibility of the Defence Workers joining and leading the proposed strike action.

The meeting calls upon all affiliates to organize a strike ballot after extensive mobilization campaign and presentation of the issues before the mass of the membership and to complete the same by 10th November, 2008. The meeting asks the Secretariat to bring home the negative impact of the Govt.'s decision through a pamphlet

This meeting decides that the next meeting of the National Executive should meet before 20th November, 2008 to review the preparation made and take appropriate decision.

The meeting also calls upon all affiliated Associations/Federations to hold a national Convention enlisting the participation of leaders of all Units for mobilization of the grass root membership.

The meeting also calls up on the leaders of all State C-o-Cs to hold State level conventions eliciting the participation of the unit leaders of all affiliated Associations/Unions in the respective States in a bid to prepare the membership for a serious struggle.

The meeting decided to call upon all affiliated to collect a donation of Rs. 20/- from each member as and when the arrears are disbursed and remit the same to the Confederation CHQ.
