Sub: The points
of submission to be made before
7th
Central Pay Commission by DAE - Reg
Sir,
This letter is in continuation with our
letter No. nfaee/sg/14/175 dated 19th November 2014.
With great expectation to hear from the
Department about the proposals prepared by the Department to submit the 7th
Central Pay Commission, the representatives of this Federation and the
affiliated unions and association were attended the meeting being convened by
the Additional Secretary on 19th November 2014. But it became an unproductive
exercise as the Departments has not come with any proposal to share with the
recognized unions and associations. The only attempt done by the Department is
that a power point presentation has been done based on the proposal received by
the Department from this Federation and other 10 unions/association on the
questionnaire circulated by the 7th Central Pay Commission after its
constitution. It is pertinent to note here that the reply to the questionnaire was
asked to submit to the Department before 7th May 2014. Thereafter sequence
of developments took place based on the initiative and direction of the 7th
Central Pay Commission. But unfortunately Department of Atomic Energy stuck in
the first phase itself. The way the Department approached the matter of Pay
Commission is so casual and thus we fear the entire employees of the Department
is going to miss the opportunity to present our points pertaining to pay
structure, allowances, advances, facilities, etc and come out of the
discrepancies and anomalies exists.
We would like to put the following for your
kind information and attention:
Ø The
7th Central Pay Commission (7 CPC) constituted by the Government of India on
28th February 2014 with a view to go into the various issues of emolument’s
structure, retirement benefits and other service conditions of the Central
Government employees
Ø The
Secretary 7th CPC wrote a letter to you on 9th April 2014with a request to
furnish replies to the questionnaire circulated by the Pay Commission on before
10th May 2014
Ø NFAEE
wrote a letter to you vide No. nfaee/sg/14/056 with a request to hold a meeting
with NFAEE before finalizing the reply to the questionnaire of CPC
Ø On
30th April you met the office bearers of NFAEE. In the said meeting Shri.
Niranjan Kumar Director and IFA was present and heard our views and directed to
the administration to initiate action and
interact with staff side on issues pertaining to CPC
Ø Accordingly
on 30th April 2014, Shri. Niranjan Kumar Director (SCS), DAE has been issued a
letter to all Head of Units and to all recognized unions and associations to
furnish the considered views on Questionnaire of CPC before 7th May 2014.
Ø NFAEE
has been submitted its reply to the Questionnaire on 7th May 2014 through email
and handed over a hard copy.
Ø Thereafter
the Pay Commission requested to submit the Memorandum of proposal before 30th
June 2014 which was then extended upto 31st July 2014.
Ø NFAEE
has been submitted its proposal to the Pay Commission on 30th July 2014 by
email as well as sent a hard copy
Ø A
copy of the detailed proposals on various issues contains in more than 200
pages was submitted to the Department on 31st July 2014 with covering letter
No. nfaee/sg/14/102 addressed to the Secretary to the Government of India,
Department of Atomic Energy
Ø In
the said covering letter we requested to direct the official concerned to hand
over the copy of the Memorandum being submitted by the Department to the Pay
Commission and to have arrange a meeting to give us an opportunity to explain
our proposals.
Ø But
it is unfortunate to note here that the Administration of the DAE utterly
failed to move further on the matter on coordinating the Pay Commission matter
and respond to the Pay Commission either on questionnaire or detailed
memorandum for quite some time.
Ø It
is understood that DAE has not been submitted its considered view on the
questionnaire sent to you by their letter dated 9th April 2014. We fear that the DAE may be only one
Department may not submitted its considered views to the Pay Commission on
Questionnaire as well as its detailed memorandum in the stipulated time frame
prescribed the P ay Commission.
Ø Almost
after 7 months of the appointment of the CPC, DAE constituted two committees
vide their letter Nos. 8/3/2014 – SCS/12094 and 12096 dated 23rd September 2014
to ensure better coordination and comprehensive examination of the issues
relating to terms of reference of the 7th CPC
Ø DAE
has communicated NFAEE vide their letter Nos 8/3/2014 – SCS/13118 & 13119
dated 20th October 2014 the constitution of the Committees and advised to meet both committees with prior
appointment.
Ø NFAEE
vide our letter Nos nfaee/sg/14/155 & 156 dated 3rd November 2014 and
nfaee/sg/163 & 164 dated 11th November 2014 requested both committees to
give us time for discussion.
Ø But
both committees could not find time to meet as all were busy with various
meetings, visit of Pay Commission, etc.
Ø Now
it is understood that both committees submitted its report to Additional
Secretary and is finalizing the recommendation.
Ø At
this juncture only Additional Secretary convened the meeting for discussion on
points for submission to the Pay Commission on 19th November 2014.
Though the notification for the meeting on
19th November 2014 was categorically mentioned two separate session
for Scientific & technical and Administrative, Accounts, Purchase &
Stores, Auxiliary, nothing was presented during the power point presentation.
As explained earlier, the presentation was
done based on the comments being sent by the Federation/unions/associations to
the pay Commission on their questionnaire which was submitted in the month of
May 2014 and not on the basis of memorandum submitted on 31st July
2014 or the report submitted by the Committees constituted by the Department
vide their letter dated 23rd September 2014.
Even in respect to the questionnaire the
Department has not come out with their stand and just done compilation of the
suggestions received from Federation and associations. Even the comments
submitted by the constituent units or that of the DAE have not been shared with
the representatives of the recognized Federation and unions and associations.
In short it was futile excise just to put
it on record that a meeting was convened by the Department to present the
compilation of the proposals received from Federation, unions and associations.
We feel the very casual approach of the
Department on future of the employees will further amplify the discriminations
and anomalies already existing among the various categories of employees and
will difficult to find solutions on various un resolved issues such as Overtime
Allowances, Night Duty Allowances, etc and other Allowances and facilities.
Thus we request you to directly intervene in
the matter and take action on war foot measure to place the issues for the
consideration of the Pay Commission. In this regard we would like to suggest
that the Department should submit that:
v A
note on the questionnaire should be submitted immediately to the Pay Commission.
v Department
should create a separate cell for monitoring,
coordinating the submission of proposal to the Pay Commission
v A
detailed proposal on all issues as per the terms of reference of the Pay
Commission such as various issues of emolument’s structure, retirement benefits
and other service conditions of Central Government Employees in general and DAE employees in specific.
v Department
should compare the pay structure, promotional avenues, other benefits, etc with
similar placed Ministries/Departments based on the qualifications, experience,
etc.
v Also
the Department should take note of the approach of other Ministries/Departments
towards the Pay Commission.
v The
attitude of ‘comparison is not feasible’ is a wrong footing and prejudiced on
the earlier decision
v All
ministries such as Railways, Defence, Postal, Audit & Accounts, etc
submitting detailed proposals on pay structure of their employees, need of
upgradation, etc for the consideration of the Pay Commission. As per our
information those ministries submitted the reports to the Pay Commission. This
can be seen from the earlier reports of the Pay Commission that volumes are
engaged for all these departments where as the proposal on Department of Atomic
Energy contains in 5-6 pages giving an impression that no such categories of
employees are in DAE.

should be taken to sort out the discrepancies

meeting may be arranged for a presentation and detailed discussion from NFAEE
We hope that Department is going to submit
points based on the questionnaire without any more delay as the Pay Commission
insisted for that. Based on the observations/comments of the DAE during the
Power point presentation being done on 19th November 2014 we would
like to mention the following points should be considered for inclusion in the
note:

The ratio of the minimum pay to maximum pay
The average proposal for ratio was
1:8. The present ratio of minimum to maximum pay is 11.43. It should not be
more than that in any case.
·
Pay Scales
The
number of pay scales should not be reduced. Now there are 19 pay scales. It
should be retained
·
Grade Pay System
Grade
Pay System should be replaced with the earlier Pay Scales pattern
·
MACP
MACP should be on grade hierarchy and
not on pay scale hierarchy.
·
Allowances
o
OTA
Overtime
Allowance should be with reference to the revised pay. Stress should be given
on argument as the unique nature of work in DAE as uninterrupted service
demands in various activities.
o
NDA
Night
Duty allowance also should with reference to the revised pay. No ceiling should
be there for NDA. All those who performing Night Duty should be eligible for
NDA
o
NRPSA
The
upper limit for eligibility should be removed.
NRPSA
being the extra duty being done by the Round the clock shift personnel, the same
should be on actual wages for the extra work done by the Round the clock shift
personnel comparing the general shift people.
o
PRIS
PRIS
should continue. Fine tuning is necessary with comparing DOS
o
QIS
Allowance
should be revised
·
Pension
o
New Pension Scheme
As the Pay Commission put question in
the questionnaire, the reply based on the observation/request from the
employees should be referred to the pay commission. The Pay Commission also
knows that those who joined after 01.01.200 4will not retire by 2014.
All employees those who joined after
01.01.2004 wishes to replace the New Pension Scheme with the Old Pension Scheme
o
CPF to GPF option
One
more option should be extended to those employees in CPF
·
Out sourcing/Privatisation
Considering
the activities of DAE, various para meters/training etc various area of work
can’t be outsourced or privatized. Thus Department should be exempted from the
policy of the outsourcing/privatisation and cotracturisation. Based on the
expansion of the activities additional man power in all categories should be
sanction which will ensure the completion of the projects in time.
Apart from the questionnaire, other issues
also should be specifically submitted to the Pay Commission, as already the
Department is delayed all these exercises. All other Departments submitted its
detailed proposals for pay structure including the upgardation on comparison
with other similar placed cadres in other ministries/departments.
Detailed note on Department specific pay structure with upgradation by
considering the training programme, nature of job, etc, specific allowances,
etc should be placed for the consideration of the pay Commission, specifically
mentioning the quantum of the payment in such allowances.
