Dear Comrades,

In the meeting held on 28th April 2008 with the Secretary DAE, the matter pertaining to the agitation to be started from 1st May 2008 also figured for discussion. The following was the reaction from the DAE authorities:

1) Revision of OTA:

a. The Secretary DAE has told in respect to the regulation of the rate for OTA as per order issued by Dr. Homi Bhabha in 1963 can only possible to implement for R&D establishments and other units where it is in operation, as and when the DoPT issue an Office Memorandum to regulate OTA in the revised rate for all government employees other than industrial units.

b. In respect to the DoPT order dated 21st November 1997, Official side informed that as per the ‘order’ issued in 1999 by DoPT, the DA shall be calculated as on 31st December 1995 and not the DA revised notionally. The official side intimated to the staff side that as per the said ‘order’ issued in the year 1999 by the DoPT, the pay shall be considered by FR 9 (21(a) (1). When the staff side insisted that there is no Order issued by DoPT after 1997 in respect to regulate OTA and the pay shall be considered as FR 9 (21) (a), the official side firmly argued order was issued by DoPT in 1999 and agreed to give the copy of the said ‘order’ after the meeting as the copy was not available with them in the conference room. The official side also intimated that accordingly DAE issued order to regulate OTA based on the order issued by DoPT in the year 1999 on 24th April 2008 and a handed over a copy of the said order. The Staff Relation Officer after the meeting handed over the copy of the said ‘order’ of DoPT issued by DoPT to Shri. S.R. Singh Secretary NFAEE. It was then found that it is not a copy of any order issued by DoPT in the year 1999, but it was merely a reply for the clarification sought by DAE through a DO letter dated 1st June 1999.
2) Cadre Review Report

a. The Chairman intimated that the Finance Ministry returns the file of cadre Review with a request to revisit the recommendations on Cadre Review in the context of the recommendations of the 6th Central Pay Commission. The Chairman also told that the whole movement is to be considered as positive, though it took time and the Ministry of Finance have not closed the issue. The official side further intimated that the reply of the Finance Ministry is not disapproval of the Cadre Review proposal, but only a direction to revisit the issue and the Department will definitely initiate the exercise as per the directive of the Ministry of Finance.

3) Up-gradation of Pay Scale for Assistants & Senior PAs

a. The matter has become subjudice.

The Secretariat meeting of NFAEE held on 30th April 2008 assessed the situation and decided the following:

1) Since the DAE handed over the copy of the ‘order’ issued by DoP9 in 1999, we should assess the reality.

2) Similarly, since the file of Cadre Review has returned the Finance Ministry for review and resubmission, it may take some time.

Under this time the Federation and its affiliates also should their home work and accordingly decided to communicate the Department that agitational programme to be started from 1st May 2008 shall be temporarily deferred.
