Sub: Cadre Review of the Administrative and
Auxiliary Staff of DAE - Reg

Sir,

        We are in receipt of your letter vide No: 12/1/2011/1r&W9Vol. III) 325 dated 6th October 2015. The letter was received after officer hours, so could see in the morning only. I would like to mention the following in response to the content of your letter.

1.   Since last week of August 2015 we are trying to meet the Chairperson of the Cadre Review Committee. Whenever asking appointment the office of the Director Admin will communicate she is busy or she is on tour. More than three occasions our office bearers visited DAE to have a personnel meet in between also became futile exercise as never given permission to meet. Similar attempt was only made on 29th September 2015 and that day also even the Director Admin was available at DAE could not find time to meet and spent few minutes to hear our voice.

2.   Prior to that during the month of June 2015, vide our letter No. nfaee.sg/15/122 dated 19.06.2015, we requested to the Director, Admn for circulating the draft proposal of the committee and sought an appointment for discussion. That also was not considered.

3.   On 10th September 2015 to express the concern of the employees on delay in finalizing the Cadre Review a letter was sent to the Chairman AEC. With a copy to the Additional Secretary and Director Admin which was also not responded till date. Letter No. nfaee/sg/15/174 dated 10th September 2015

4.   Even during the period we tried to contact the Additional Secretary, DAE to share our concern he was also not available with his prior appointments.

5.   It is a fact that you were kind enough to meet us on 29th September 2015, but the uncertainty about the Cadre Review among the employees are continues and to express the displeasure only the lunch hour demonstration is organized. Under this circumstance the NFAEE Secretariat felt to continue the programme as schedule.

6.   Further we request you to arrange a meeting with the Chairperson, Cadre Review Committee and the Additional Secretary and initiate the process for competition of Cadre Review Report and ensure the implementation, so that further resentment can be brought down.

Proposed Indefinite Strike from 23rd November has been deferred

National Joint Council of Action met on 30.09.2015 at New Delhi to discuss on the proposed indefinite strike from 23 Nov, 2015. It was decided that as the government is delaying the submission of the seventh pay commission report till the Bihar election, the strike action slated for 23rd November 2015 be delayed to coincide with the Parliament budget session during February - April, 2015.

The meeting further decided to call up on all Federations of Central Government Employees to organize massive protest demonstration in front of all offices on 19th November 2015 by wearing black badges to protest against the Government’s indecision on demands of the Government Employees.

Further the meeting decided to hold DAY LONG DHARNA by the leaders of the National JCA at Jantar Mantar on 19.11.2015.

Copy of the circular issued by Com. Shiva Gopal Mishra, Convener National Joint Council of Action of JCM participants along with Resolution adopted in the metting is attached herewith.

Dear Comrades,
The National JCA met today on 30.09.2015. In the background of the engineered delay in the submission of the 7th CPC report, the meeting reviewed the decision to go for indefinite strike action commencing from 23rd Nov.2015 and arrived at the following conclusions.

1.   The 7th CPC, as per the indication the NJCA had, concluded its deliberations and finalised its report. But due to the pressure exerted by the GOI the report is not likely to be out till the Bihar election is going to be concluded on 8.11.2015.

2.   Even if the report is given, the Government might plead for some more time to consider the same and arrive at conclusions.

3.   Even though the charter of demand contains other major issues, viz FDI, outsourcing, New Pension Scheme etc, the CPC related issues especially the revision of wages has its own significance and struggle without the said issue is impracticable.

4.   The meeting also noted that after the impressive march to parliament held on 28th April, 2015, no serious programme of action was undertaken, which has created certain complacency in the movement. The meeting noted the necessity to rejuvenate the NJCA functioning at all levels.

5.   It was also noted that there are states which have not held the state level conventions and consequently have not brought into being the state apparatus required to spearhead a serious action like indefinite strike.

6.   In view of above mentioned conclusions, the National JCA has decided to defer the strike to a date during the Budget session of the parliament i.e from Feb to April 2016. The exact date of commencement of the strike will be decided by the National JCA when the 7th CPC report is available.

7.   The NJCA also has decided to call upon all Federations of Central Government Employees to organise a massive protest demonstration in front of all work-spots/offices on 19th November 2015 wearies Black Badge to register our anger and resentment over the Government’s action in engineering delay in the submission of the report by the 7th CPC.

8.   The National JCA leaders and all standing council members will sit on a day long Dharna at Jantar Man tar on 19.11.2015 by wearies Black Badge to highlight the anti worker attitude of the GOI and its concerted efforts to undermine the functioning of JCM.

We also send herewith the resolution adopted at the meeting which has been forwarded to the Government already.

RESOLUTION

1.   The National JCA of Central Government Employee, which met today on 30.09.2015 at New Delhi strongly, condemns the Governments’ action in engineering delay in the submission of 7th CPC report. The 7th CPC was to submit its report on 28th August 2015. i.e on the expiry of 18th months’ time provided to it by the Government as per the terms of reference. The demand for interim-relief and merger of DA was denied. The Government refused to amend the terms of reference despite repeated appeals made by the National JCA on several occasions.

2.   The Charter of demand submitted by the National JCA to the cabinet Secretary realization of which it has been decided to organize indefinite strike commencing from 23rd November 2015 has remained unattended and unsettled. No follow up action was initiated by the Government after discussion of the issues at the level of Secretary Personnel held on 25th February 2015.

3.   The National Council JCM has not met in the past 5 years even once, giving the impression that the Government’s intention is to award a natural death to the negotiating forums and compel the employees to tread the path of struggle for realization of the demands. Many departmental councils have been placed on hibernation for the part one decade.

4.   The National JCA has come to the inescapable conclusion that the present Govt has no intention to reach out to a settlement on any issue pertaining to the Central Govt. Employees, given its anti labour, anti people attitude.

5.   The National JCA has decided to call upon the Central Government Employees throughout the country to organise massive protest demonstration jointly on 19th November 2015 in front of all Offices/work place eliciting the participation of all employees workers and pass resolution and send the same to the Finance Minister and the Cabinet secretary.

Sir,

          This is in continuation with our earlier letter No. nfaee/sg/15/174 dated 10th September 2015 regarding the Cadre Review of Administrative, Accounts, Auxiliary and Purchase & Store Staff. As mentioned in the above referred letter though the Department committed to carry out the Cadre Review of these section of employees till date the report even finalized and delaying the action on Cadre Review.

Even when approaching the administrative authorities are not available for discussing the issue and no information about the present status of the Cadre Review has not been shared with the staff side.

Under this circumstance the employees are forced to come out for express their concern on Cadre Review of the employees.

Accordingly NFAEE decided to hold lunch hour demonstration on 7th October 2015 in front of Administrative Office of all DAE units.

CADRE REVIEW:

          In response to the repeated letter written from NFAEE HQ regarding Cadre Review of Administration, Accounts, Purchase & Stores and Auxiliary staff following affiliates sent their suggestions:

          Various suggestions were given by the Associations. Following are some of the comments, suggestions send by those affiliates:

·         Immediately write letter to the Chairman and other officials in DAE to speed up the Committees work and request the Department to ensure the implementation before 7th CPC
·         Hold Lunch hour demonstration in all units
·         Request to all administrative, accounts, auxiliary, Purchase & stores staff who are coming under cadre review to send post card to the Chairman with an appeal to intervene and ensure the implementation of the 3rd Cadre Review Report before 7th CPC implementation
·         Black badge demonstration
·         No need for any action as employees are not responding the call given by the Federation

Based on the suggestions a proposal for action programme was circulated among the NFAEE Secretariat Members. Considering the suggestions and alterations following action programme has been suggested to carry out by all affiliates by the Secretariat:

1.   Hold lunch hour demonstration in front of Administrative office all DAE units in between 7th October 2015 and pass a resolution and send to the Chairman, AEC for the intervention.
2.   To send post cards by all employees who are coming under the purview of the Cadre Review. This campaign shall be carried out for a week from 12th October 2015 to 16th October 2015. Make this programme more attractive by planning demonstration of employees to the nearest post office to drop the post cards by each and every employee.
3.   Black badge demonstration by all employees who are affected by Cadre Review on 29.10.2015
4.   There was a suggestion to conduct a demonstration from Mumbai VT to Anushakthi Bhavan. In Mumbai after series of incidents in VT area no demonstration is allowed and only permission shall be given to hold sit in dharna at Azad Maidan which will not gave any attention for our cause. Hence the same has not been considered.
5.   Similarly another suggestion to hold dharna exclusively by the effected employee’s participation in Mumbai. The understanding is that such wider participated agitation prgramme may be organized after detailed discussion in the Working Committee.   
6.   If the Department is not coming with proper proposal on Cadre Review by the time further action programme including Non co operation movement if the affiliates are fully agreeing to carry out in letter and spirit such programme, shall be decided in the NFAEE Working Committee Meeting which can be convened after the festival season over. 

All the affiliates are requested to carry out the programme for their own interest and for the benefit of the members of the unions and associations affiliated with NFAEE uniformly and united.

Working Committee Meeting:

          To decide the second phase action programme after the first phase of the campaign on Cadre Review and discuss other issues Working Committee shall be convened in the third week of November 2015. Venue and date shall be decided and communicated in short time.
