SA CASE UPDATE
Dear, colleagues,
Hope you all must aware that the agreement by all parties of OA (OA/288/2012)
filed in Mumbai CAT on track change for
SA has been completed and directed for written submission and was posted high on-board and came for final
argument on 01-03-2017.
In the meanwhile applicant No. 3, SK Singh has approached CAT
Principal Bench, New Delhi through a Petition (P.T./100/36/2017) to transfer
the above case from CAT, Mumbai to Principle Bench New Delhi. CAT
Principal Bench, New Delhi has kept Mr.SK Singh’s petition on 17-03-2017 and
listed for Admission/Rejection.
In the light of the above development, CAT Mumbai Bench has
adjourned the case to 01-05-2017 and caused further delay for final judgment.
Now the SA case is transferred to a
new Bench in CAT Mumbai and this has happened because of the boycotting of a
particular Judge in the CAT Mumbai as decided by the Bar Council. We have
submitted the final written submission as directed by the honorable CAT Mumbai.
It is also came to know the Chairman Principal Bench New Delhi is visiting
Mumbai to sort out the internal issues between Judges and Bar Council.
When the SA case at CAT Mumbai is
shifted to a new bench, and expected a judgment shortly, the move of SK Singh to
transfer the case from CAT Mumbai bench
to Principal Bench New Delhi is highly suspicious and mischievous when all
parties involved in this case including SK Singh is stationed at Mumbai.
Following a case at Delhi, is highly impractical and waste of
money. In case the matter is admitted in the Principal Bench and any set back
happens, Writ Petition to be filed in the Delhi High Court only.
In these circumstances, we believe that moving to Principal Bench
is not in the interest of Scientific
Assistant Community and the same was already informed to S.K.Singh. Hence
we inform all the stake holders that S.K Singh is sole responsible for the delay
and future uncertainties in the OA filed in CAT Mumbai for track change.

OA PENDING IN MUMBAI CAT OF SA REGARDING TRACK CHANGE:
The date for next hearing has been
given in the month of MAY 2017 as S.K. Singh of SAAB has moved to Principle
Bench of CAT Delhi.

SLP PENDING IN HIGH COURT HYDERABAD ON PARITY OF ALLOWANCES
