Sir,

I am directed to state that the Working Committee of National Federation of Atomic Energy Employees have decided to organize indefinite strike commencing from the first shift on 19.01.2009 in support of the charter of demands. Copy of the charter of demands is enclosed herewith.

Accordingly I hereby submit the Notice by respectfully intimate you that the employees of DAE units across the country will start Indefinite Strike from first shift on 19.01.2009 onwards for settlement of the enclosed common demands of the DAE employees

The Working Committee meeting of the Federation held on 19th December, 2008 has also been endorsed the decision of the Confederation of Central Government employees, in which NFAEE is an affiliated organization, to go for indefinite strike from 20th January 2009 for common demands of Central Government employees related to the Sixth Central Pay Commission with certain modifications and for settlement of the demands in general to that of Government employees.

You are specifically requested to take necessary steps to bring about settlement of the demands which are department specific.

CHARTER OF DEMAND

PART I

ON REVISION OF PAY SCALES OF DAE EMPLOYEES:

v Ensure Pay Parity to the DAE employees with that of Department of Space as first step.

v Upgrade the pre revised pay scale of Rs2750 – 4400 into Rs3050 – 4590 so that the Group D category shall get the financial benefits as the senior most employees will get fixation justification with higher grade pay.

v Upgrade the posts in administrative, accounts, purchase, stores and auxiliary on par with the recommendations of the Cadre Review/DOS pattern

v Upgrade the Technical post in the grade of Rs7450 -11500 to Rs8000 – 13500 and Rs8000 – 13500 to Rs10000 – 15200 and so on. (Tradesman, Foreman, Draftsman, Scientific Assistant, Nurses, etc). Then should de-merge the merged pay scales Rs5000 – 8000, Rs5500 – 9000 and Rs6500 – 10500 with grade pay of Rs4200, 4600, 4800 respectively and accordingly higher grade pay should be extended for pay scales in the promotional hierarchy.

v The Committee further should consider the suggestions submitted by National Federation of Atomic Energy Employees vide NFAEE letter No. nfaee/sg/08/135 dated 25.09.2008 to extend higher grades at the entry level for Technical Staff, Promotional avenues for Auxiliary grades, upgradation of administrative, accounts, purchase & store staff, etc in consultation with similar Departments such as DOS for a permanent solution with a time frame. Copy of the suggestions submitted along with NFAEE letter No. nfaee/sg/08/135 is attached herewith as Annexure

v
Initiate bilateral discussion with the National federation of Atomic Energy Employees and the affiliates associations and unions immediately to arrive a amicable solution

ON ALLOAWANCES & FACILITIES:

v Overtime Allowance should continue & should make statutory provision to revise OTA in all establishments including R&D establishments. Department should ensure the revision of Overtime Allowance of the employees working in the R&D and other establishment on par with Industrial units.

v As done in the Railways, Department should take initiative to continue the Transport facilities to their employees by using the infrastructure facilities existing in DAE units by charging nominal/incremental cost towards the expenditure for fuel and Transport Allowance should be given to all employees.

v Update Allowance should be revised as 50% of the mean of the Update Allowance given to Scientific Officers. Update Allowance should be net of Tax.

v Two additional increments should be given to all employees irrespective of their grade.

v Fulfill the commitment of equal pay and monitory benefits to the Scientific Assistants and the Scientific Officers in the same pay structure, given by the Department in the Court of Law, by extending same quantum of update allowance and two increments to all Scientific Assistants as is being extended to the Scientific Officers in similar grades.

v Extend Heavy Vehicle Allowance to the drivers who drive Heavy Vehicle w.e.f 01.04.2005 and revise the allowance as 10% of the revised pay.

v Qualification Incentive Scheme should be revised and extended to other units/Sections as agreed by the Department.

v NRPSA should enhance to compensate the extra duty being formed by the shift personnel.

v Introduce Productivity Linked based BONUS to all DAE employees based on the industrial activities of all Industrial units.

v No attempt to be made to convert CHSS into insurance linked scheme and should continue with improvement in the existing scheme.

v The Income ceiling for getting CHSS benefit should be increased. The parents once got the benefit should not be debarred based on increase in the pension other source of Income.

The Department should take up with the concerned ministries to ensure:

v The Continuation of Patient Care Allowance & Hospital Patient Care Allowance and its revision.

v Continuation of ACP scheme based on the promotional Hierarchy

v Ensure increment from 1st July to over come the financial losses to the employees whose increment dates fall in between 2nd January to 30th June. (February & May cases)

v One more option to switch over from CPF to GPF

v Revision of Night Duty Allowance based on the Revised Pay and removal of ceiling of entitlement.

v Continuation of the Service seniority criteria for allotment of Departmental accommodation.

v Rate of Tribal Area Allowance should be enhanced on par with the State Government Employees.

v Continuation of Risk Allowance


Part II

Charter of demand pertaining to
Central Government Employees in general

A. 6th CPC related issues

1. Grant Rs 10000 as minimum wage as per 15 ILC Norms.
2. Grant minimum fitment benefit of based on the minimum pay decided as per the 15th ILC Norms to bring about uniform rise in emoluments and raise grade pay to 50% of the maximum of the pre-revised scales in respect of PB 1,2 & 3 as has been done in the case of PB 4.
3. No abolition of Gr.D. Posts and functions. Lift ban on recruitment, fill up all vacant posts and scrap screening Committee.
4. Grant 10% of pay+ Grade pay as minimum benefit on promotion or financial up gradation.
5. Fix the date of effect of all allowances as 1.1.2006.
6. No performance related pay or bonus scheme
7. Revise the Transport and daily allowances as demanded by the staff side JCM National Council.
8. Remove the condition of 6 months for applying the uniform date of 1st July as increment dates.
9 . ACP to be on hierarchical system obtaining in each department.
10. Retain and improve CGHS. CGHS should not convert into insurance scheme
11. Patient Care Allowance, Night Duty Allowance, Overtime Allowance, Risk Allowance, etc should be retained and enhanced
12. Implement flexitime working hours for women/disabled employees as recommended by the 6 CPC.
13. Direct all the Departmental Heads to settle 6th CPC related department specific demands/problems within a stipulated time and remove clause (iv) of OM No.13019/2/2008-Estt.(L) dated 18th Nov. 2008 on Child Care Leave.
14. Grant civil servant status and Pension to 'Gramin Dak-Sevaks.'
15. No reduction in the commutation value and restoration of full pension after 12 years.
16. Compute the pension entitlement on the basis of notional pay as on 1.1.1996

B. Demands pending settlement for long in the National Council JCM

1. No outsourcing or contractorisation of Govt. functions.
2. Grant statutory defined pension scheme to the employees recruited after 01.01.2004 and withdraw the PFRDA Bill from Parliament.
3. Implement the Board of Arbitration Awards.
4. Remove the arbitrary 5% ceiling and 3 years condition on compassionate appointment and withdraw court cases and absorb all waitlisted RRR candidates.
5. Implement the revision of bonus ceiling @ 3500/- in the case of all Personnel employed by the Government including casual/ contingent and daily rated workers and Grameen Dak Sewaks. Replace adhoc bonus with the PLB and remove the 60 days ceiling.

Sub: Discrepancies in the Pay Revision of
Employees of Department of Atomic Energy - Reg

Respected Sir,

At the out set on behalf of the employees of the Department of Atomic Energy (DAE) we would like to wish you a HAPPY & PROSPEROUS NEW YEAR and SUCCESS IN ALL YOUR NEW YEAR RESOLUTIONS. National Federation of Atomic Energy (NFAEE) is a recognized organization by the Government of India/DAE representing more than 15000 employees working in various establishments of DAE through out the country. 22 unions and association recognized by DAE is affiliated with NFAEE. The unions and associations apolitical organizations working in various DAE units under NFAEE always in the forefront to maintain the democratic culture of the country and work hardly to maintain the harmonious relation among the work force during any crisis. We always give utmost importance to build strong establishment for facing any crisis the Government, the common people faces. Being a premier scientific establishment, the role of Department of Atomic Energy and its establishments such as Bhabha Atomic Research Centre (BARC) in the present era of scientific revelations, is very much important to face any challenge from the competitive world. Self reliance and indigenous development is the answer to face these challenges and for this purpose whole employees – scientists, technocrats and all other section – should work together with proper understanding.

We would like to bring to your attention and your intervention to resolve the situation aroused while implementing the revised pay structure based on the recommendations of the Sixth Central Pay Commission (SCPC). Immediately after the Government issued notification on revision of pay based on the recommendations of Sixth Central Pay Commission, DAE too initiated steps to implement the revised pay structure for its employees. After the submission of the recommendations of SCPC Dr. Anil Kakodkar Secretary, Department of Atomic Energy (DAE) called the Office Bearers of NFAEE for discussion on 28th April 2008. During the discussion the management assured better pay structure and facilities to the employees and a committee constituted to recommend proper pay structure. On 12th September 2008, the Department issued order to implement the Government order and also constituted another committee to suggest the proper implementation of Revised Pay Rules. NFAEE had given its suggestions to remove the discrepancies/anomalies likely to be arising while implementing the revised pay scales as it is. But it is unfortunate to note here that the said committee failed to suggest steps to remove the discrepancies/anomalies. While implementing the revised pay structure the Department not only denied the better pay structure to the non-gazetted employees, but taken away the promotional avenues by merging certain pay scales.

Department of Space (DOS) is another prestigious Scientific Department of the country doing R&D in the Space Technology and recently succeeded in their CHANDRAYAN abhiyan. Both Department DAE & DOS are coming under none other than our Hon’ble Prime Minister and directly looking after by Shri Pritviraj Chauhan, Minister for State in charge of PMO. It is pertinent to note here that DOS too issued Order to implement the revised Pay structure on 12th September 2008. Without appointing a committee DOS could do justification on revision of pay by taking proper care while selecting the pay scales. DAE even failed to recommend the pay structure adopted by the Department of Space for its non-gazetted staff, though both Departments are coming under the Hon’ble Prime Minister. Because of this attitude of the department, employees losing thousands of rupees by way of salary on comparison with the employees in similar grade working in Department of Space and this will reflect in their pension and other benefits. This can be clear from the facts given below:

· When the auxiliary staff of Space who got two promotions in their carrier getting higher grade pay than that of DAE employees and having better promotional option too.

· The entry level of administrative, accounts, purchase & store staff of the Space Department is higher than that of DAE and the difference in the grade pay at the entry level is Rs500/- per month.

· The Technical staff, core group of the R&D and Industrial activities under DAE too denied the better pay structure comparing to the Space staff. The senior most employees in Technical staff – Technicians, Draftsmen, Foremen, Scientific Assistants, etc – are getting lesser pay in the tune of Rs1000 to Rs1200/- per month, as the selection of pay scale has not been done properly.

NFAEE and its affiliates through representations approached the Secretary, DAE, Director BARC and other officials, but no attempt has been initiated to resolve the anomalies. When Ministry of Health, Ministry of HRD, etc succeeded to upgrade the pay structure of the employees of their core personnel such as nurses, teachers respectively, Department of Atomic Energy miserably failed to ensure better pay structure for their employees working in the core area such as radiation and other hazardous field. When the Defence personnel given lesser pay, the Chiefs of the armed force took up the issue with the Prime Minister and the Cabinet rectified the anomalies of certain cadres.

The discontentment among the employees increased and this lead to protest action in all DAE units and employees were observed Black day by wearing black badges, Day Long Dharna, 24 hours Long Fast, etc. In the mean time Director BARC called a meeting for discussion, but the Department has not come foreword to resolve a single anomalies raised by NFAEE. As the adamant approach is continues, the employees have no other option than go for industrial action and is preparing for indefinite strike.

You are requested to take up the issues with the Ministry concerned and do the needful to resolve the justified demands of DAE employees and at least ensure parity with DOS in respect to the Pay structure.

Anticipating an initiative and intervention from your side to resolve the problem facing by the Employees of DAE.

Sub: Strike preparation and Draft Notice

Dear Comrades,


Wishing you all a HAPPY & PROSPEROUS NEW YEAR 2009.


Hopes that all of you must received the letters, campaign material sent through email from Head Quarters which contains the decisions taken in the extended working committee of NFAEE held on 19th December 2008, campaign material prepared fro campaign programme, draft copy of the consent letter along with matter for pamphlet, matter for posters, etc. Hopes that all affiliates are vigorously initiated campaign programme to make success the Indefinite Strike of DAE employees to be commenced from 19th January 2009.

All affiliates are requested to send note regarding the campaign programme organized in their units and the response from the employees. A brief about the programmes being orgnaised in DAE based units is given below:

Immediately after the Working Committee, the Joint Action Meeting was held on 23.12.2008 in which following decisions were taken:

· To convene the Managing/Executive Committee meetings of all affiliated unions and associations at Mumbai in which Federation Officers should attend & brief the decisions taken in the Working Committee
· For campaign programme, 500 poster should print in Marathi & English
· Consent should be taken in writing by issuing detailed pamphlet to each and every employee in which perforated consent form also should be prepared and that portion should be taken from the employees.
· The campaign should continue even after 5th January 2009 as good numbers of employees are on leave.
· Decided to hold meeting on 4th January 2009 to assess the mood of the employees
Accordingly all major units have been convened the meetings of Managing/Executive Committee as follows:

DPS (DAE) EA – DPS (Purchase) 26.12.2008

In all meeting NFAEE Office bearers attended and briefed the decision taken in the Working Committee meeting. All committees discussed in detail about the decisions taken by the extended meeting of NFAEE Working Committee and endorsed the decision for IDEFINITE STRIKE from 19.01.2009.

CAMPAIGN Programme initiated by all affiliates from Monday (29.12.2008). In BARC from Monday onwards daily 6-8 divisional meeting has been arranged and briefed the decision for Indefinite Strike and collected the Consent from members. The response is good. Those who attended/present on duty in each division/section were given Consent form voluntarily. As it is year end, a good number of employees are on leave and hence second round attempt has to be carrying out to complete the collection of consent forms from the members.

In HWB a general body meeting was called on 1st January 2009 which was addressed by Jayaraj.K.V & KG Bilaskar. From the meeting itself good number of employees given their consent for indefinite strike in writing.

DPS (Purcahse & Stores), DCSEM employees also started to give their consent and the response in these units also positive.

In the meantime approached media by Press Conference and two Marathi daily published the Press Conference issued by NFAEE. Also prepared a letter addressed to Member of Parliament and by this week end will submit the representation to Member of Parliament from Mumbai by this weekend.

In the similar manner all affiliates are requested to send the information to the Head Quarters which shall be boosting for other unions and associations yet to start the campaign prgramme.

All affiliates are requested to continue the campaign programme vigorously as there is no indication from the Department for any sort of conciliation or settlement.

Hence all affiliates are requested to submit the Notice for INDEFINITE STRIKE from 19.01.2009 on 5th January 2009. Also request to organize mass meeting on 5th January 2009 either before submitting the notice or immediately after the submission of the Notice to the Department. Copy the Draft notice to be issued to the Head of the unit along with the charter of demand is enclosed herewith.

After 5th January 2009, all affiliates are requested to convene the special general body meeting to explain the issues as well as the stand taken by the Federation and its affiliates to its employees in detail. AS per the request from the affiliates Office bearers of the NFAEE will attend such explanatory meetings of all affiliated organizations.
