Sub: Brief on the meeting of the NAC held today under the chairmanship of Jt. Secretary(E), DoP&T,
        Government of India

As per notification No.11/1/2015-JCA dated 12.05.2015 of the DoP&T(Government of India), meeting of the National Anomaly Committee was held today under the Chairmanship of Jt. Secretary(Estt.),            Jt. Secretary(Pers.) and officials from other establishments and Ministry of Railways were also present.

At the outset, Secretary(Staff Side), National Council(JCM), Shri Shiva Gopal Mishra, expressed anguish for communication gap and non-finalization of the issues raised by the Staff Side JCM at various levels, and that is the reason, the staff working in the Central Government is quite agitated.

He also mentioned that, when we met the Secretary, DoP&T, we were given assurance that very soon meeting of the NC/JCM would be held, but unfortunately could not.

NAC was formed seven years back, and up-till now whatsoever had been agreed, that is not implemented, and wherever disagreement, items have not been sent for arbitration.

Out of 60 items, only 48 were discussed, and most of them are under review, and there are 12 items which are still pending, require urgent meeting on pending items.

Leader, Staff Side, Shri M. Raghaviah also shown his anguish and demanded meetings more frequently. Shri K.K.N. Kutty, Shri Sri Kumar and other members of the Staff Side also expressed their anguish on inordinate delay.

The J.S.(E) assured that the meeting on the pending items would be held soon. On the insistence of the Secretary(Staff Side), she agreed for the meeting on the pending items in the afternoon of 9th June, 2015. She also agreed for giving status papers.  

 Agenda Items

Item No.1 – Review of MACP to GP of Rs.2000 where there is no such grade pay in Railways

Though the Official Side was not in the mood to make any change, but on the insistence of the Staff Side, they agreed to review the matter once again.  

Item No.2 – Granting of Additional Pay to Loco & Traffic Running Staff

The Jt. Secretary(Pers.) asked the Railways to give some more logical arguments, so that they can reconsider the issue of Additional Pay to Loco Pilots and Guards of the Goods Trains.

Item No.3 – Treatment of employees selected under LDCE/GDCE Scheme

The Official Side informed that, they have already sent a letter on 27.09.2012, that whatsoever benefit is available to the employees selected under LDCE and GDCE in the ACP, that will continue in the MACPS also. The item is closed.  

Item No.4 – Grant of minimum entry pay meant for Direct Recruits to Promotees

There had been lots of arguments and when the Staff Side insisted that, in the JCM Scheme, once the items have been finalized and we reach to an agreement in the Standing Committee, there is no provision of referring back the issue to JCM again. The Secretary Staff Side told pointblank to the Official Side that we are not going to yield on this issue, and if the Official Side feels that the Hon’ble Finance Minister has some specific objection for implementing this issue where Promotee should get bottom of the grade where Direct Recruitment is available, we would like our meeting with Hon’ble Finance Minister. The Official Side agreed that they will put up the case to the competent authority to approach the Hon’ble Finance Minister once again.

Sub:- Hike in Tuition Fee in AECS & Junior College - Reg

Dear Comrades,

       As communicated vide NFAEE letter dated 2nd June 2015, DAE issued instruction to the AEES that the revision in the fee structure notified by AEES vide order dated 08.02.2015 should be kept in abeyance for a period of 3 months. Further they instructed that the students who already paid the fees in revised rate, the excess amount so paid should be adjusted against future dues in accordance with the final decision in the matter.

       We once again express our sincere gratitude to the parents who patiently waited by not paying the fee till a decision from the Department based on the appeal given by NFAEE, its affiliates and other associations.

Dear Comrades,

        Please refer the letter NO. nfaee/sg/15/109 dated 20th May 2015 w.r.t the subject mentioned above.

Along with the said letter, copy of the proposed amendments in the DAE allotment Rules was attached and requested to the affiliates to submit the comments on the proposed amendments before 28th  may 2015. I am enclosing herewith proposal circulated by DAE on amendments in DAE Allotment Rules.

No affiliates has been submitted their views till date. Once again appeal to all affiliates to consider this as most urgent and send back the comments on proposed amendments in the DAE Allotment Rules before 4th June 2015. On 5th June based on the comments received from affiliates shall be submitted to the Department. If no comments received from affiliates, no one should blame later to the Federation head quarters for taking up the matter with Department.

Sir,

          Please refer our letter No. nfaee/sg/15/094 dated 5th May 2015. In the said letter the subject under reference was explained in detail and requested your immediate intervention to resolve the issue. Copy of the letter is attached here.

          It is to be noted here that in the DAE Departmental Council Meeting (JCM) held on 9th April 2015, the Chairman of DAE DC assured the staff side that within 5 working days, the matter shall be discussed with the Secretary, DAE and will inform the Staff side the outcome. But unfortunately till date no decision has been taken on the above mentioned subject.

          The AEES has been put on hold the collection of Fee till the School reopens after summer vacation. The School reopens after the vacation in the third week of June 2015.

          Before opens the Schools the issue of Revision of Tuition Fee, PUVVN, collecting Tuition Fee from Girls child and children belongs to SC/ST, etc. should be reviewed and a amicable solution is necessary to be taken at the earliest.

          It is therefore once again requesting you to take up the matter on priority to resolve and give us an opportunity to explain the matter in person at the earliest.

Sub: Revision of Tuition Fee, PUVVN
with effect from the Academic year 2015-2016

Sir,

We hope that the issue related to the Revision of Tuition Fee, PUVVN, extending the fee structure to Girl Child and the children belongs to SC/ST raised by NFAEE, its affiliated unions and associations, ARWA, SC/ST Associations, etc may be brought to your notice by the concerned authorities of DAE.

        The matter was raised by this Federation during the month of February 2015 when it was brought to the notice that the Tuition Fee and PUVVN have been exorbitantly enhanced by AEES and withdrawn the free education ensured by the Government of India to the GIRL child and SC?ST Students.

        We wrote a letter to the Chairman, AEES (Ref. No: nfaee/sg/15/042 dated 23rd February 2015) with a request to withdraw the enhanced rate of Tuition Fee and PUVVN.

An extended meeting of representatives of unions, associations and welfare associations of DAE employees stationed at Mumbai & Tarapur was held on 26.02.2015 at the Seminar Hall, Nabhikiya Bhavan, Anushaktinagar, Mumbai and passed a resolution to urge the Chairman AEES (Ref. No: nfaee/sg/15/048 dated 27th February 2015)

·         To withdraw the hike in Tuition fee as well as in PUVVN immediately and continue the pre revised fee structure
·         To spend the amount in PUVVN strictly as per the guidelines given in Annexure II of the “Authorized Expenditure of Heads under PUVVN”
·         To examine/audit the utilization of PUVVN has been done in the previous years.
·         To ensure admission to the wards of non DAE employees who all are admitted in Pre – Prep and now in Prep classes in first standard. 

NFAEE sought an appointment with the Chairman, AEES and accordingly met the Chairman, Secretary, CAO of the AEES and the Chairman LMC, Mumbai on 2nd March 2015 and discussed elaborately the matter referred above. In the meeting Chairman AEES explained various steps initiated by DAE to curtail the non planning expenditure and the direction given to the AEES to divert the amount in PUVVN to Cosmetic maintenance, salary for adhoc appointed teachers, etc which is nothing but violation of the guidelines  for utilization PUVVN. Based on the discussion NFAEE wrote a letter to the Governing Council of AEES vide our letter No. nfaee/sg/15/049 dated 3rd March 2015 requesting to the AEES to reconsider the hike in Fees.

The Governing Council Meeting held on 4th March 2015 directed the AEES to seek guidelines on hike in Fee as well as to enhance the budgetary support for non planning expenditure. Accordingly the matter was referred to DAE by letter dated 16th March 2015, Ref No. AEES/P&C/Tuition Fees/ 2015-16/6555.

Vide our letter NO. nfaee/sg/15/076 dated 3rd April 2015 NFAEE brought the matter to your notice and sought intervention to resolve the matter.

Again on 8th April vide letter No. nfaee/15/073 dated 8th April 2015 addressed to Chairman AEES requested to put on hold the Fee collection till a decision taken by DAE.

In the meanwhile 69th meeting of DAE Department Council was held on 9th April 2015 and the matter has been discussed. Additional Secretary, DAE and the Chairman of DAE Department Council assured the meeting that the matter shall be apprised to the Chairman, AEC and within 5 working days shall communicate the feedback. The same has been communicated to the AEES authorities and requested to suspend the Fee collection till a decision arrived at DAE.

To put in record we wrote letter vide No. nfaee/sg/15/078 dated 13th April 2015 in which we have been raised the deviation of Government policies such as free education to girl child and SC/ST students also raised.

On 15th April 2015 representatives various unions and association of DAE units stationed at Mumbai along with NFAEE office bearers met the Chairman AEES to express our concern about the authorities attempt to put pressure on wards to collect the fee in an urgent manner and after the discussion he agreed to put on hold for collection of the fee. But there after again attempts were made to collect the fee in a war foot manner and even the kids were harassed and humiliated by the Principals and teachers. Through vide our letter No. nfaee/sg/087 dated 26.04.2015 further requested to stop immediately such pressure on kids.

In response it is now communicated that the date of fee collection shall be communicated in the month of June after open the School after summer vacation.

Above all there are various administrative lapses on various accounts of the day to functioning of the AEES such as no regular administrator/Secretary, no proper accounting and handling of financial matter, etc are some of the issues

In the above mentioned circumstance, it is highly praiseworthy if a positive decision taken by the Department on our demands to streamline the AEES activities such as

·         Withdraw the hike in Tuition fee as well as in PUVVN immediately and continue the pre revised fee structure.
·         Ensure free education to the GIRL child and SC/ST students upto 12th Standard
·         Spend the amount in PUVVN strictly as per the guidelines given in Annexure II of the “Authorized Expenditure of Heads under PUVVN”.
·         Examine/audit the utilization of PUVVN has been done in the previous years.
·         Appoint a regular administrator or Secretary to look after the AEES functioning for which already a sanctioned post exists.

A comparative chart on the Fee collection in DAE, DOS and KVS along with our observation on FEE is attached herewith for your ready reference while considering the matter for review.

We once again request you to intervene and to resolve the issue at the earliest. It will be highly appreciated if you permit us to present our views in person before arrive in a decision.

From the above charts NFAEE observed that:

·         No Tuition Fee for the students for 1st to 8th standard was collected in KVS and DOS.
·         Even the Tuition Fee collected for the students of 8th Standard and above for KVS and DOS was lesser amount comparing that of AEES (DAE) even at the pre revised level.
·         The revised rate of Tuition Fee is exorbitantly higher than that of the KVS and DOS
·         60% increase in Tuition fee and 233% increase in PUVVN proposed by AEES which is exorbitant.
·         The total expenditure for a student to complete his education at the level of 12th Standard in AEES (DAE) is higher than KVS and DOS even at the pre revised rate.
·         The total expenditure for a student to complete his education at the level of 12th standard in AEES (DAE) after revision is four times more than that of DOS and 82% more than the rate exists in KVS.
