The meeting was presided by Com. G. Maniachari President, NFAEE. Secretary General intimated that Com. A. Sathasivam, Johnson, Pothraju Sreenivasa Rao, Raghuramaih, S.N.Reddy, Sanjay Bhowmick informed that they will join in the Day Long Fast at units and hence could not attend the Working Committee meeting. Com Jayakumar president intimated that as the Special General Body meeting scheduled to be held on 18th December they could not attend the meeting.

Agenda 1: Review of the implementation of the action programme decided in the National Convention held at Mumbai on 09.11.2008.

The Secretary General briefed about the activities conducted after the convention held at Mumbai on 9th November 2008. As expected the Department issued notification on 10th November 2008 and spontaneous reaction was shown by all affiliates union by arranging protest meeting from 12th November 2008 to 16th November 2008. Thereafter the available Secretariat Members at Mumbai and the office bearers of affiliated unions and association of Mumbai scheduled the programmes as decided by the Convention and intimated to all affiliates. Accordingly the following programmes conducted by all affiliates as motioned below:



In the discussion the participants seriously noted that some of the affiliates are deviating from the decision to hold action programme. Some of the affiliates are not observed the programmes. Some of them changed the programme into solidarity. The members were in the opinion changes in the programme definitely will adversely effect the united movement. At the same time it is necessary to understand the ground realities in units, why such changes without consulting the Head Quarters taking by the affailites. Those who participated in the discussion were in the view that the continuous action programme succeeded to bring the discrepancies and anomalies created by the Department while introducing the Pay structure for DAE employees. Also employees realized that the without agitation it will be difficult to get the justice.

The meeting were in unanimous to confirm that the agitation prgramme planned and conducted was the correct decision and decided to interact with those association and unions are not conducted the action programme in proper spirit and try to make convince the need of uniform action programme in all units. The meeting further decided wherever it is necessary to address the general body meeting of the employees to explain the stand taken by the Federation.

The meeting decided to request all head of units of various DAE units to intervene and settle our genuine demands.

It is also decided to submit a detailed memorandum to the Hon’ble Prime Minister about the demands, approach of the Department, etc. It is also decided to approach all local MPs where our units situate and request them to intervene.

Agenda 2: To decide the next course of action programme

The meeting after detailed discussion decided to go for INDEFINITE STRIKE from 19.01.2009, if the Department has not came foreword for settlement of the major demands we already submitted to the Department. The Strike Notice should be served on 5th January 2008 after holding a public meeting all DAE units. It is decided that all affiliates should endorse the strike notice given by the NFAEE and serve the same to the Secretary, DAE through the Head of the units concerned. The meeting also decided that in the name of intervention of Regional Labour Commissioner, the Strike notice given by the affiliated unions and associations should not be withdrawn as the affiliates are endorsing the strike notice served by the Federation and the last movement by the RLC to postpone the strike should not be entertained.

Before serving the strike notice on 5th January 2009, all affiliates should organize campaign programmes from 26.12.2008 to 03.01.2009 and during the period should collect CONCURRENCE LETTER from the employees for their participation in the strike.

Performa for the concurrence letter is enclosed.

All affiliates are requested to send the feedback about the concurrence letter such as the number of employees/members the association/union approached and the number of employees given the concurrence for Strike action etc by 3rd January 2009 itself. A meeting of the Secretariat Members available and the Office Bearers of Mumbai based unions and association will meet on 4th January 2009 and assess the situation before serving the Strike Notice to the Department.

Agenda 3: Call given by the Confederation of Central Government Employees & Workers

Secretary General briefed the decisions taken in the National Executive meeting of the Confederation of Central Government Employees & Workers held on 13th December 2008 at New Delhi and read out the Charter of Demands. In the meeting it was decided to go for indefinite strike from 20th January 2008 and to serve notice to the Government of India as well as to the Departments/Ministries on 2nd January 2009. The meeting observed discrepancies in the Demand on Minimum pay and in the fitment formula as well as the demand on CGHS – insurance scheme shall be optional – The meeting decided to communicate the Confederation of CG Employees & Workers as well as all major affiliates that the demand on Minimum pay and fitment formula is contradicting each other and hence need to be modified before issuing the Strike notice. Similarly we should demand Insurance based Mediclaim or CGHS in Toto and should not be optional.

The meeting endorsed the decision to go for Indefinite Strike with the modified demands and decided to serve notice to the Department on 6th January 2009.

Agenda 4: To fix the venue, date for the next General Council meeting of NFAEE

The Working Committee decided to hold the next General Council meeting of NFAEE either at Talcher or Hyderabad. Com. Maniachari will discuss with the HWEU Talacher and communicate the possibilities. In the meantime the possibility to hold the General Council Meeting at Hyderbad shall be discussed with NFCEA and Supervisory Staff Association of NFC Hyderabad. The General Council meeting shall be held in the first/second week of February 2009.

Agenda 5: Any other item with the permission of Chairman:

1. All affiliates are requested to complete the donation collection and requested to remit the 50% of the donation collection made from the employees towards the Working Fund before 31st December 2008. Also requested to return the donation books issued by NFAEE.
2. All affiliates also requested to clear the subscription dues before 31st December 2008.
3. Members from NFC enquired about the incident happened on 5th December 2008 at the BARC North Gate with Security Office. Com. A. Sreedharan Gen Secretary AEWSU, BARC briefed the incident and intimated that the issue was taken up with the concerned authorities.

24 hours Long Fast at Mumbai on 17th December 2008 and Day Long Fast at DAE units on 18th December 2008 were conducted in almost all DAE units. A brief report as per the available information at Head Quarters is given below:

24 HOURS LONG FAST:

24 Hours Long Fast was started at EKTA CHOWK, Anushakti Nagar Mumbai at 4.30 pm on 17th December 2008. The Fast was formally inaugurated by Com. G. Maniachari, President NFAEE. In the fast following Secretariat members of NFAEE and Office Bearers/Executive Committee Members of various affiliates were participated.

Office Bearers of Atomic Energy Retirees Association (AERWA) visited the Pandal & Addressed by Shri Narurkar Gern Secretary (AERWA) and Shri K. Raghavendra Editor of the journal AERWA. Also the Shri Ram Dhuri President TIFR Staff Association also visited the participants in the 24 hours long fast.

On 18th December 2008 at 12.30 a lunch hour meeting was organized at the Pandal at EKTA CHOWK in which more than 300 employees from DPS, DCS&EM, HWB from VS Bhavan and the DCSEM sites attended the meeting. Meeting was addressed by Com. Jayaraj.K.V, G. Maniachari, Sunil Pawar, Prasant Sonkade, R.S. Tokle & P.M.Worlikar

At 13.00 hours on 18th December 2008 a Lunch Hour meeting was organised at the Parking Place of Central Complex, BARC in support of the 24 hours Long Fast which was addressed by Com. A. Sreedharan General Secretary AEWS Union, BARC and Com. N.J. Shukla. The meeting at CC was attended by more than 1000 employees.

The 24 Hours Long Fast was concluded at 4.30 pm on 18th December 2008. Fast was break by giving Coconut water to Com. G. maniachari by Shri. S.S. Ramachandran Secretary General, Central Confederation of Pensioners Association, New Delhi. Shri Ramachandran delivered a speech on the occasion and called upon all serving employees to join in the agitation against the retrograded recommendations of the Sixth Central Pay Commission and congratulated the effort initiated by NFAEE against the discriminatory approach of the Department as well as the Government. Com. Maniachari too addressed the gathering and the meeting was concluded at 5.30 pm with a vote of thanks by Com. A. Sreedharan.

DAY LONG FAST:

As per the information received at Head Quarters following places the affiliates of NFAEE conducted successfully the Day Long Fast in various DAE units through out the Country.

1. KALPKKAM:

At Kalpakkam under the banner of JAC of DAE Employees Kalpakkam, Day Long Fast was conducted from 6.00 am onwards. In the about 68 office bearers& Executive committee members of AEEA (IGCAR), BARCFEA (BARC facilities), GSO SA (GSO), TAPEU (MAPS), MAPSA (MAPS), DPS (DAE) EA (MRPU) AND Secretariat members of NFAEE participated in the Fast. A meeting was organized at 600 pm. All the units in Kalpakkam including KINCOSS (a society at MAPS) have given their support by providing Shawls to all the 68 participants. At about 6.15 pm the hunger strike was ended with juices and biscuits.

2. MANUGURU:

The Day Long Fast was started at 0800 Hrs. Total 12 Office Bearers and Executive members participated in the Day Long Fast. At 1700 Hrs started Gate meeting with General Shift-I employees. Fasting and meeting concluded at 1800 Hrs with G-II employees.

3. HYDERABAD:

The Day Long Fast was started by 8.30 am at NFC main gate. A tent was placed ahead of the gate. The programme took from morning 8.30 AM to evening 4.30 PM. In this, M B Vijay Kumar Yadav (President), Shankar Reddy, Mohammad Majheed, N Rajaiah Goud, R Chandra Shekar Rao (Vice President), Roop Chand, Raju (Asst Sec), Jaya Prakash, Poornachander Rao, Devi Kuar, Gopi (Org Sec), R Chandra Shekar (Gen Sec) and 20 Executive Members and Raghuramaiah Vice President, NFAEE participated.
Large number of employees took part in the meeting hold in the morning. Also in the afternoon, Admin, Accts, DPS, Shop floor Employees including women workers assembled in the Pandal. The Fast was concluded in the evening after holding a meeting in which R Chandra Shekar and Vijay Kumar Yadav gave a speech. B Poornachander Rao gave the Vote of Thanks.

4. BARODA:

The Fast was organized from 2.30 pm to 12.30 am (in the midnight). A meeting was organized at 4.30 pm with the out going employees of general shift. Similarly meeting was organized when the second shift people left the office in the night.

5. KOTA:

Day Long Fast was started at 8.00 am with a general meeting after getting down all employees at the Gate. The Fast was concluded at 4.30 pm with a concluding meeting

6. INDORE:

The DAY LONG FAST started at Sharp 8.00 Hrs on 18.12.2008 in frontof Guard House (in front of Plant gate Security. There were threebanners stating the Heading "Day long FAST" and the charter demand. inthe fast C.U.Jayakumar (President CATSA), Jatashankar Mahur (GenSec CATSA) R.P.Dhobi (Vice President CATSA) Dheeraj Shukla (Treasurer)andRamesh Chandra (member) and Vishwa Jeet Tiwari (member) participated.
We concluded our Fast at 3.00 pm as our special general body meeting was schedule dto held at 3.30 pm. A good number of Employees from Plant came near the Tent at around 15.00 hrs with juice and fruits and they concluded the Day long fast by shouting slogans about the department attitude and implement the demand immediately.

At 15.30 the General Body of CATSA in the Com. Jayakumar and Jatashankar briefed the necessary of the agitation and protest andrequested the members to join the future course of action programme.

7. TALCHER:

The Day Long Fast was started at 8.00 am in which about 20 members were participated. The Fast was concluded at 4.30 pm

8. KOLKOTTA:

The Day Long Fast was started at 8.00 am In the Fast more than 20 office bearers, EC members including NFAEE Secretariat Member participated.
The fast was concluded at 4.30 pm

9. TARAPUR:

The Day Long Fast was started at 8.30 am. All employees were got down from the buses and organized a meeting. Meeting was addressed by Shri. J.H. Raul, President BARC Employees Association Tarapur. In the fast about 20 members were participated. During the lunch time number employees including women employees came out to show the solidarity. The Fast was concluded at 5.00 pm.

Last two phases of action programme was conducted in almost all units successfully. On behalf of the Secretariat of NFAEE I heartfully congratulating those affiliates conducted BLACK DAY observation as well DAY LONG DHARNA.

In Hyderabad Store staff also joined in the programme. Similarly in Kalpakkam, the MAPS (NPCIL) employees union – TAPEU – too joined in the both programme.

From the above it can be seen that there were one or two affiliates underestimating the necessity of the united action and waiting for the fruit for which others are sweating and losing their pay. It is high time to identify such elements. But we cannot sit idle as there are a few ditches our movements in the middle. We have to march foreward with an appeal to those who are in double mind to join in the struggle.

As we decided unanimously in the All India convention held at Mumbai on 9th December 2008, the next phase of our agitation shall be 24 HOURS LONG FAST at Mumbai on 17th December 2008 in which at least one office bearers of all affiliates also will participate and DAY LONG FAST in all DAE units on 18th December 2008. Notice for the programme shall be given to DAE on 8th December 2008. Copy of the Notice to the Secretary DAE is attached herewith. All affiliates also requested to serve the notice by 10th December 2008.

I am directed by the Secretariat to inform all affiliates that the programme decided by the Convention should not be modified or altered by the affiliates as per their wishes.

Dear Comrades,

Our fight is not only to get the monitory benefit or for parity with the employees of Department of Space, but to gain our self respect. The DAE authorities has been taken such a stand that the non gazetted employees of the Department is nothing and proposed nothing for their career prospects where as they shown their consideration towards higher level scientific community. The approach of the Department is now exposing one after the other by getting the report/ comments prepared by the Committees as well as the Department to submit the Pay Commission, Secretaries Committee etc.

Their may always be a group to sabotage the Trade Union movement to weaken the bargaining power by misguiding the leadership as well as employees in general as they are the masters voice.

So I appeal to all affiliates of NFAEE to forgo the past and joint vigorously in the coming course of action programme

Sub: Notice for Protest Action Programme

Sir,

In protest against the Department’s continuous negative approach towards the justifiable demands to revise the pay structure of DAE employees of various categories, the DAE employees will conduct following protest programme:

24 HOUR LONG FAST AT MUMBAI:

24 Hours Long Fast shall be held at Anushakti Nagar, Mumbai from 17th December 2008. The fast shall be start from 4.30 pm on 17th December 2008 and will culminate on 18th December 2008 at 4.30 pm. Office bearers of NFAEE and all affiliated unions and associations of DAE employees will participate in the 24 HourLong Fast.

DAY LONG FAST IN ALL DAE UNITS:

In All DAE units employees will conduct Day Long Fast on 18th December 2008.

The charter of demands pertaining to the revision of the Pay structure of DAE employees is attached herewith.

We once again appeal to the Department to consider the demands of the employees to avoid the confrontation with the employees to maintain good employer – employee relation in this prestigious Department function under none other than the Hon’ble Prime Minister, Government of India

CHARTER OF DEMAND
ON REVISION OF PAY SCALES OF DAE EMPLOYEES:

v Ensure Pay Parity to the DAE employees with that of Department of Space as first step.

v Upgrade the pre revised pay scale of Rs2750 – 4400 into Rs3050 – 4590 so that the Group D category shall get the financial benefits as the senior most employees will get fixation justification with higher grade pay.

v Upgrade the posts in administrative, accounts, purchase, stores and auxiliary on par with the recommendations of the Cadre Review/DOS pattern

v Upgrade the Technical post in the grade of Rs7450 -11500 to Rs8000 – 13500 and Rs8000 – 13500 to Rs10000 – 15200 and so on. (Tradesman, Foreman, Draftsman, Scientific Assistant, Nurses, etc). Then should de-merge the merged pay scales Rs5000 – 8000, Rs5500 – 9000 and Rs6500 – 10500 with grade pay of Rs4200, 4600, 4800 respectively and accordingly higher grade pay should be extended for pay scales in the promotional hierarchy.

v The Committee further should consider the suggestions submitted by National Federation of Atomic Energy Employees vide NFAEE letter No. nfaee/sg/08/135 dated 25.09.2008 to extend higher grades at the entry level for Technical Staff, Promotional avenues for Auxiliary grades, upgradation of administrative, accounts, purchase & store staff, etc in consultation with similar Departments such as DOS for a permanent solution with a time frame. Copy of the suggestions submitted along with NFAEE letter No. nfaee/sg/08/135 is attached herewith.

v Initiate bilateral discussion with the National federation of Atomic Energy Employees and the affiliates associations and unions immediately to arrive a amicable solution

ON ALLOAWANCES & FACILITIES:

v Overtime Allowance should continue & should make statutory provision to revise OTA in all establishments including R&D establishments. Department should ensure the revision of Overtime Allowance of the employees working in the R&D and other establishment on par with Industrial units.

v As done in the Railways, Department should take initiative to continue the Transport facilities to their employees by using the infrastructure facilities existing in DAE units by charging nominal/incremental cost towards the expenditure for fuel and Transport Allowance should be given to all employees.

v Update Allowance should be revised as 50% of the mean of the Update Allowance given to Scientific Officers. Update Allowance should be net of Tax.

v Two additional increments should be given to all employees irrespective of their grade.

v Fulfill the commitment of equal pay and monitory benefits to the Scientific Assistants and the Scientific Officers in the same pay structure, given by the Department in the Court of Law, by extending same quantum of update allowance and two increments to all Scientific Assistants as is being extended to the Scientific Officers in similar grades.

v Extend Heavy Vehicle Allowance to the drivers who drive Heavy Vehicle w.e.f 01.04.2005 and revise the allowance as 10% of the revised pay.

v Qualification Incentive Scheme should be revised and extended to other units/Sections as agreed by the Department.

v NRPSA should enhance to compensate the extra duty being formed by the shift personnel.

v Introduce Productivity Linked based BONUS to all DAE employees based on the industrial activities of all Industrial units.

v No attempt to be made to convert CHSS into insurance linked scheme and should continue with improvement in the existing scheme.

The Department should take up with the concerned ministries to ensure:

v The Continuation of Patient Care Allowance & Hospital Patient Care Allowance and its revision.

v Continuation of ACP scheme based on the promotional Hierarchy

v Ensure increment from 1st July to over come the financial losses to the employees whose increment dates fall in between 2nd January to 30th June. (February & May cases)

v One more option to switch over from CPF to GPF

v Revision of Night Duty Allowance based on the Revised Pay and removal of ceiling of entitlement.

v Continuation of the Service seniority criteria for allotment of Departmental accommodation.

v Rate of Tribal Area Allowance should be enhanced on par with the State Government Employees.

v Continuation of Risk Allowance

ATOMIC ENERGY EMPLOYEES ON WAR PATH
AGAINST THE DISCRIMINATION ON PAY

Thousands of employees working in the various units of Department of Atomic Energy through out the country participated in the agitation against the discriminatory attitude of the Department on finalizing their pay. While implementing the revised pay structure the Department not only denied better pay structure to the non gazetted employees, but taken away the promotional avenues by merging the pay scales.

During the discussion the management assured better pay structure and facilities to the employees and a committee constituted to recommend proper pay structure in consultation with the similar Departments like Department of Space, etc. But the Committee failed even to recommend the pay structure adopted by the Department of Space for its non gazetted staff, though both Departments are coming under none other than Hon’ble Prime Minister. By doing so, the employees of Department of Atomic Energy losing thousands of rupees by way of salary on comparison with the employees in similar grade working in Department of Space and this will reflect in their pension and other benefits.

When Ministry of Health, Ministry of HRD etc succeeded to upgrade the pay structure of the employees of their core activities such as nurses, teachers respectively, Department of Atomic Energy miserably failed to ensure better pay structure for their employees working in the core area such as radiation and other hazardous field. Department also failed to complete the Cadre Review for their administrative, accounts, auxiliary, purchase & store staff which other department completed & implemented well before the submission of the recommendations of Sixth Central Pay Commission (SCPC), by which these categories in those Department got the financial up-gradation while implementing SCPC report.

By virtue of this attitude all section of employees of Department of Space is in better position. This can be clear from the facts given below:

· When the auxiliary staff of Space who got two promotions in their carrier getting higher grade pay than that of DAE employees and having better promotional option too.

· The entry level of administrative, accounts, purchase & store staff of the Space Department is higher than that of DAE and the difference in the grade pay at the entry level is Rs500/- per month.

· The Technical staff, core group of the R&D and Industrial activities under DAE too denied the better pay structure comparing to the Space staff. The senior most employees in Technical staff – Technicians, Draftsmen, Foremen, Scientific Assistants, etc – are getting lesser pay in the tune of Rs1000 to Rs1200/- per month, as the selection of pay scale has not been done properly.

As the Department is adamant in their stand and the demand for pay structure is unresolved call was given by the National Federation of Atomic Energy Employees (NFAEE) to protest against the discriminatory approach of the Department by way of protest demonstration, wearing black badges on 28th/29th November 2008 and holding Day Long Dharna on 3rd December 2008. More than 15 thousands employees working in the prestigious Research & Development establish in the Nuclear Industry such as Bhabha Atomic Research Centre – BARC- (Mumbai, Tarapur, Mysore, Kalpakkam)), Indira Gandhi Cente for Research – IGCAR - (Kalpakkam), Centre for Advanced Technology – CAT - (Indore) Variable Energy Cyclotron Centre – VECC - (Kolkotta), Industrial units such as Nuclear Fuel Complex – NFC - (Hyderabad), Heavy Water Plants (Tutiocrine, Manuguru, Baroda, Kota, Talcher) and other supporting units such as Directorate of Estate Management (Mumbai), General Service Organisation (Kalpakkam), Directorate of Purchase & Stores (Mumbai, Hyderabad, Chennai, Kalpakkam, etc) participated in the protest action programme.

The NFAEE & and its affiliates has been given notice for next phase of agitation, 24 hour Long Fast on 17th/ 18th December 2008 in Mumbai and Day Long Fast in all DAE units across the country on 18th December 2008.

If the Department is not coming with a solution to ensure at least pay parity with Department of Space, the Federation given a call for Referendum for Strike from 20th December 2008 and will declare the strike action which will decide in its Working Committee meeting scheduled to be held on 19th December 2008 in Mumbai.

REPORT ON BLACK DAY:

As per the call given by the NFAEE most of all affiliates has been observed BLACK DAY on November salary day. Non industrial units observed Black day on 28th November 2008 and Industrial units observed Black day on 29th November 2008 as the industrial units were worked on Saturday.

DAY LONG DHARNA:

Hopes that all affiliates may be completed the preparation for holding DAY LONG DHARNA on 3rd December 2008. All affiliates are requested to take all efforts to make grand success the Dharna followed by the public meeting.

Immediately after the programme all are requested to send detailed report intimating the name of the speakers, number of employees participated in the Dharana as well as in the meeting, photographs of the dharana as well as meeting etc.

It is reported that Administrative authorities of various units are trying to misguide the affiliates by intimating that the Dharna programme in other unit is not going to observe to mislead. It is therefore requested to all affiliates are requested to conduct the Dharana in all units.

24 HOURS LONG FAST AT MUMBAI & 8 HOURS LONG FAST AT UNITS:

So far only from AEEA, IGCAR received the name of the office bearer to represent the affiliate association/union of out station units participating in the 24 Hours Long Fast on 17/18th December 2008.

All affiliates are requested to send the name by 5th December 2008 to the Head Quarters for making the arrangements.

CAMPAIGN MEETINGS:

In BARC category wise meetings called to explain the demands and to hear the views of the employees. These meetings become great success and the response is good. So fat conducted the meetings of Technical Staff (Tradesman), Scientific Assistants, Auxiliary Staff etc. Meeting of Drivers and Administrative staff shall be held on 2nd December 2008 separately.

Hence it is requested to all affiliates to convene the meetings of employees’ category wise after Dharna programme, before next phase of action programme.

It is to be noted that the success of these programme only will put pressure on the Department to open their blind eyes. It is therefore requested to popularize the demands to convince each & every employees.

PROTEST MEETING
Unilateral decision to revise the Order on Child Care Leave (CCL)

To protest against the unilateral decision of the Government to revise the Office Memorandum issued to grant Child Care Leave (CCL) only to those woman employees who do not have Earned Leave on their credit, various DAE units conducted protest meetings on 21.11.2208.

Hundreds of women employees of BARC gathered in front of Central Complex. Meeting was addressed by Jayaraj.K.V, Secretary General, NFAEE and P.M.Worlikar President AEW& S Union, BARC. Meeting adopted a resolution to urge the government to withdraw the disputed OM issue don 18th November 2008

Women employees of DPS, DCS&EM and HWB was gathered in front of Vikram Sarabahi Bhavn Mumbai to show the protest against the Government’s decision and resolved to urge the Government to withdraw the Order. Meeting was addressed by K.G Bilaskar Treasurer NFAEE, R.S. Tokle Gen. Secretary HWBSA and others.

A good number of employees of DPS (Stores) assembled near Central Stores, BARC Mumbai to show the protest against the Government’s decision to restrict the CCL to those women employees having zero Earned Leave on their credit. The meeting urged the Government to withdraw the order immediately. Meeting was addressed by Co. S.R Sing Secretary, NFAEE, V.K.Patil Gen. Secretary AIAEDPS (Stores) SA and others.

GSOSA (GSO Kalpakkam) and AEEA (IGCAR Kalpakkam) also organize dmeetings of women employees on 21st Novemebr 2008 to show their protest.

Sub: Unilateral decision to revise the Order on Child Care Leave (CCL)

Sir,

NFAEE appreciated the recommendation of the 6th CPC as well as its acceptance by the Government of CHILD CARE LEAVE (CCL) for 2 Years to the women employees to take care of their children. The Government orders granting this leave including the Performa to be maintained were promptly issued. All in general and the women employees in particular were happy.

Suddenly the DOPT issued another dated 18.11.2008 in the name of clarification as references have been received from various sections regarding the procedure for grant of this leave etc. In the name of the clarification DoPT added a condition that CCL can be availed only if the employee concerned has no Earned Leave at her credit.

By virtually canceling its earlier orders of grant of CCL by putting a stringent condition that the CCL is permissible only to those women employees who completely exhausted her EL and no EL is at credit of her leave account. This is very retrograde stand taken by the Government even it is in the name of not allowing disruption of the functioning of offices.

The net effect of this revised order is that no women employee will be able to avail this leave if their EL account becomes ZERO. Thus there is no need for granting the ordered Child Care Leave to women employees anymore! If this is the approach of the Government, the whole central government employees especially women employees show their dissentient/ protest strongly against anti women employees attitude of the Government.

The recommendation by SCPC was all women employees having minor children may be allowed total leave of upto two years (730 days) for taking care of upto 2 children whether for rearing the children or looking after any of their needs like examination, sickness, etc. (para 4.7.5 (ii)). While accepting the said recommendation Government ha snot been modified the said recommendation.

Even if any reference has been made by any department regarding the procedure to be adopted for sanctioning the leave, then the clarification shall be the regarding procedure to be adopted for availing the leave etc. But in the name of clarification how the content of the Office Memorandum can be modified

Under this circumstance we humbly request you to intervene and give necessary instructions to the officer concerned to immediately withdraw the conditions stipulated to grant the CCL.

Dear Comrades,

Hopes that all affiliates might gave the notice for the next phase of action programme, Observing November Salary day as Black Day and holding Dharna on 3rd December 2008 in all units.

Similarly hopes that protest meeting against the Government’s arbitrary decision to stipulate conditions to avail Child Care Leave (CCL) by which majority of the women employees may not get the benefit of the leave. Al affiliates are requested to send the details of the meeting.

FOURTH PHASE OF THE ACTION PROGRAMME:

24 HOURS LONG FAST at Mumbai and solidarity programme in units

The meeting of the office bearers of Mumbai based unions and associations and the office bearers of NFAEE were held on 18th November 2008 and decided the FOURTH PHASE of ACTION PROGRAMME as follows:

· 24 hours long fast shall be organized in Mumbai on 17th December 2008. The programme shall be start at 16.30 hours on 17th December and will conclude on 18th November 2008 at 16.30 hours.

· To participate in the 24 hours long fast on 17th/18th December, each association should send one of the chief executive (President/General Secretary/Treasurer) of the affiliated union or association

· To express solidarity all affiliates should organize DAY LONG FAST on 18th December 2008 from morning 8.30 hours to 16.30 hours.

· Care should be taken while sending the office bearer to attend the 24 Hours Long Fast at Mumbai, not to affect the preparation for solidarity programme at the unit level. (Participation of President/General Secretary or Treasurer should not be the excuse for not organizing the programme in units on 18th December 2008)

· In Mumbai the unions and association will explore the possibility to mobilize the family members of the employees on 17th evening.

· On 18th December in all units mobilization should be carried out to bring the maximum of the employees at the venue where the Fast organized.

· Also special effort may be taken to bring the supervisory cadres in the joint movement.

· Maximum mobilization, campaign etc should be carried out by arranging corner meetings, divisional meetings, pasting posters, publishing pamphlets etc.

REFERENDUM ON STRIKE:

· Referendum on strike shall be start from 19th December 2008 and should be completed by 2nd January 2009.

POSTER for the Action Programme:

Two posters shall be posted through Professional Couriers/Speed post on 22nd November for the next two phases of the programme. Similarly another poster may print and circulate for 24 hours long fast.

WORKING COMMITTEE MEETING:

An extended working Committee meeting of NFAEE shall be held on 19th December 2008 at Mumbai to review the action programmes conducted after the last working Committee meeting held on 17th & 18th September 2008 and to finalize the next course of action prgrammes.

All affiliates should take maximum efforts to organize all action programmes, campaign work etc upto the maximum by taking all section of employees into confidence. Similarly all affiliates should interact with the Head of the units and put pressure on them to take up the grievances to the DAE authorities and settle amicably.

Draft Resolution:

The women employees of ----- unit, Department of Atomic Energy unanimously resolved to urge withdraw the condition stipulated in the Office Memorandum issued by DoPT vide their OM No. 13018/2/2008 – Estt (L) dated 18th November 2008. By interlinking the Child Care Leave with Earned Leave and indicating Zero EL in credit is the criteria for CCL, majority of the employees will be out of the purview of CCL

CHARTER OF DEMAND

ON REVISION OF PAY SCALES OF DAE EMPLOYEES:

* Ensure Pay Parity to the DAE employees with that of Department of Space as first step.

* Upgrade the pre revised pay scale of Rs2750 – 4400 into Rs3050 – 4590 so that the Group D category shall get the financial benefits as the senior most employees will get fixation justification with higher grade pay.

* Upgrade the posts in administrative, accounts, purchase, stores and auxiliary on par with the recommendations of the Cadre Review/DOS pattern

* Upgrade the Technical post in the grade of Rs7450 -11500 to Rs8000 – 13500 and Rs8000 – 13500 to Rs10000 – 15200 and so on. (Tradesman, Foreman, Draftsman, Scientific Assistant, Nurses, etc). Then should de-merge the merged pay scales Rs5000 – 8000, Rs5500 – 9000 and Rs6500 – 10500 with grade pay of Rs4200, 4600, 4800 respectively and accordingly higher grade pay should be extended for pay scales in the promotional hierarchy.

* The Committee further should consider the suggestions submitted by National Federation of Atomic Energy Employees vide NFAEE letter No. nfaee/sg/08/135 dated 25.09.2008 to extend higher grades at the entry level for Technical Staff, Promotional avenues for Auxiliary grades, upgradation of administrative, accounts, purchase & store staff, etc in consultation with similar Departments such as DOS for a permanent solution with a time frame.

* Initiate bilateral discussion with the National federation of Atomic Energy Employees and the affiliates associations and unions immediately to arrive a amicable solution

ON ALLOAWANCES & FACILITIES:

* Overtime Allowance should continue & should make statutory provision to revise OTA in all establishments including R&D establishments. Department should ensure the revision of Overtime Allowance of the employees working in the R&D and other establishment on par with Industrial units.

* As done in the Railways, Department should take initiative to continue the Transport facilities to their employees by using the infrastructure facilities existing in DAE units by charging nominal/incremental cost towards the expenditure for fuel and Transport Allowance should be given to all employees.

* Update Allowance should be revised as 50% of the mean of the Update Allowance given to Scientific Officers. Update Allowance should be net of Tax.

* Two additional increments should be given to all employees irrespective of their grade.

* Fulfill the commitment of equal pay and monitory benefits to the Scientific Assistants and the Scientific Officers in the same pay structure, given by the Department in the Court of Law, by extending same quantum of update allowance and two increments to all Scientific Assistants as is being extended to the Scientific Officers in similar grades.
* Extend Heavy Vehicle Allowance to the drivers who drive Heavy Vehicle w.e.f 01.04.2005 and revise the allowance as 10% of the revised pay.

* Qualification Incentive Scheme should be revised and extended to other units/Sections as agreed by the Department.

* NRPSA should enhance to compensate the extra duty being formed by the shift personnel.

* Introduce Productivity Linked based BONUS to all DAE employees based on the industrial activities of all Industrial units.

* No attempt to be made to convert CHSS into insurance linked scheme and should continue with improvement in the existing scheme.

The Department should take up with the concerned ministries to ensure:

* The Continuation of Patient Care Allowance & Hospital Patient Care Allowance and its revision.

* Continuation of ACP scheme based on the promotional Hierarchy

* Ensure increment from 1st July to over come the financial losses to the employees whose increment dates fall in between 2nd January to 30th June. (February & May cases)

* One more option to switch over from CPF to GPF

* Revision of Night Duty Allowance based on the Revised Pay and removal of ceiling of entitlement.
* Continuation of the Service seniority criteria for allotment of Departmental accommodation.

* Rate of Tribal Area Allowance should be enhanced on par with the State Government Employees.

* Continuation of Risk Allowance

Sub: Revision of pay structure in respect of certain categories of
Employees in the Department - Reg

Sir,

This letter is in response to DAE Office Memorandum No. 32/1(2)/2008 –
SCS/326 (R) dated 10th November 2008. In that OM, it is stated that after due
consideration, the Department has decided to adopt pay structure of various
grades, posts in Group A, B, C & D in respect of certain categories as
contained in Part B of the Ministry of Finance Notification dated 29.08.2008.
In this connection, we would like to recall out that DAE has constituted a
committee under reference No. 32/1(2)2008 – SCS/R – 198 dated 12th
September 2008, to examine the implementation of the decisions of the
Government on the Sixth Central Pay Commission with regard to certain
common categories of employees as contained in Part – B of the First Schedule
of the Notification dated 29th August 2008 and has been directed to submit its
report within six weeks of time.
Even after the passing of stipulated period of directive, there has been
no disclosure whether the said committee had submitted its report for
consideration of the Department OR the OM dated 10th November is based on
that report.
Presuming that the OM dated 10th November is based on Dr. Suri
Committee recommendations on revision of Pay Structure of certain categories
of employees; we would like to bring up the following:
First up all, it is our firm opinion that none of the mentioned terms and
references in the said OM has been considered by the Committee while
arriving at its conclusions.

First clause of the terms of reference:

the committee should minutely examine the implications of
such recommendation with regard to vertical and horizontal
relativities among various cadres while examine the aspects and
formulate the proposal for implementing the recommendations
with regards to revision of certain common categories of
employees as contained in Part B of the notification
But the Committee has not done any thing to ensure and to maintain the
vertical and horizontal relativities among the various categories existing in the
Department. It can be seen that the Committee has not done the minute
examination to maintain the vertical & horizontal relativities among
the Cadre. It is pertinent to note here that the Nursing categories are the
backbone of Ministry of Health and the pursuance of the Health Ministry results
in the recommendation of higher pay scales for Nurses. The conscious decision
of the Govt of India in granting up graded pay scales to Nurses could not be
easily brushed aside by Dr. Suri Committee and to recommend upgraded Pay
structure to Nurses working in our hospitals and dispensaries.
While doing so, the bare minimum liability of the Committee to propose
parity so as to ensure horizontal relativity among the Technical Staff was not
embarked on?

Second clause in the terms of reference:

the committee should consider anomalies if any arising
while implementing the above mentioned Government
notification among the various Groups in DAE and to recommend
measures to correct the anomalies, without creating new
anomalies.
By failing to recommend parity in the existing pay structure for
Technical, administration, auxiliary and purchase & store staff – leave alone
DOS and other comparative Department, the committee created further
anomalies.

Third clause in the terms or reference:

the committee was asked to take abundant precaution that
the anomalies which arise in the past are not further exacerbated
while merger and up gradation of pay scales as well as to take
care for maintaining parity amongst the equivalent cadres to the
extent possible.
Not only, the committee failed to lessen the anomalies exists in
Technical, Administration, Auxiliary, Purchase & Store Staff, but it further
exacerbated by holding the merged pay structure for Rs5000 – 8000 and
Rs5500 – 9000. The committee adopted the novel method of hitting the two
birds in a single stone i.e. eliminating the higher grade pay for Auxiliary staff
denying the and the promotional hierarchy scale of administration, accounts,
purchase & store staff etc existing since 1996 after the implementation of the
Fifth Central Pay Commission. The promotional hierarchy scale was the long
drawn conflation in Cadre Review in the Department like DOS, Railways,
Defence, Income Tax CSIR (Department of Science & Technology) etc.

Fourth clause:

The committee to consider the representations received from the
employees and their recognized Unions/Associations
The Committee and its members not concerned to consider the
representations received from the employees and their recognized
unions/associations. Only three members out of the 7 members of the
Committee met the representatives of NFAEE on the same day the Federation
submitted its suggestions. Four top members of the Committee could not find
time to meet the representatives of the employees or felt - not required to
hear the views of the representatives of the employees.

Fifth and last clause:

Committee to consult similar Departments likes the Department
of Space for comparable categories of employees while arriving
at its conclusions.
Though the committee had in custody the copies of the orders issued by
the similar Department like DOS, it not even given attention of advocating the
pay structure recommended by such Departments for various categories. The
end result of such outlook landed our DAE employees to content with lesser
pay.
As the OM dated 10th November has not revised the Pay structure of
administration, accounts, auxiliary, and purchase & store staff, there is a
strong reaction of the employees that a deliberate attempt was foisted to
divide the interests of employees and playing again with the same old divide &
rule principle of British era.
The employees and workers of the Department under the banner of
National Federation of Atomic Energy Employees shown their protest through
out India immediately after the issue of the Office Memorandum dated 10th
November 2008 and demanded to ensure parity with the Pay Structure of
the employees of DOS for comparable categories as FIRST STEP and up
gradation & creation of promotional posts for Administration, Accounts ,
Purchase, Stores and Auxiliary categories as proposed by NFAEE in meeting
the similar formulations of Departments like DOS.
In the midst of discontent created by the non fulfillment of the function
assigned to Dr. Suri Committee, among the employees, it our earnest appeal
to direct the administrative authorities concerned to revisit the terms and
references and to ensure pay parity with DOS and also to revise the Pay
Structure in certain categories of employees of DAE.
We request you to give an early appointment to explain our justified
position in this regard to your offices in person.

Dear Comrades,

An All India Convention of DAE employees was held on 9th November 2008 at the Multi purpose Hall, BARC Training School Hostel Anushakti Nagar, Mumbai to discuss about the Pay structure for DAE employees based on the Part B of the Government Notification on CCS (Revised Pay Rules) 2008, Allowances & Other facilities based on the revised pay and the recommendations of Sixth Central Pay Commission (SCPC). The meeting was attended by the office bearers of the 16 affiliated unions and associations of DAE Employees from various units of the Department of Atomic Energy across the country.

The convention adopted two resolutions on Pay, Allowances and other facilities for submission to the Secretary DAE. The convention also adopted two resolutions for the consideration of Leader/Secretary Staff Side, National Council (JCM) and President/Secretary General, Confederation of Central Government Employees Workers.

The Convention also decided to initiate protest action programme, if the Department come out with Order based on the recommendations of Dr. Suri Committee which is not on in parity with the Pay structure given to the employees of Department of Space protest demonstration, dharna, 24 hours fast, referendum for strike action etc are the agitational programme suggested by the Convention and authorized the Working Committee/Secretariat to finalize the date

Accordingly an extended meeting working committee of NFAEE was held on 10th November 2008 at the office of the AEW&SU union which was presided by Com. M. Sangiah Working President, NFAEE. The meeting chalked out the following action programme, if the Department is not ensures at least parity with the Pay structure of DOS.

· To organize Spontaneous protest demonstration in front of the Administrative building of all DAE units. Preferably next day of the issue of the Office Memorandum by DAE.
· To observe Day Long Dharna in all DAE units and hold general meetings within 10 to 14 days of issue of the Office Memorandum by DAE.
· To observe 24 hours Fast at Anushakti Nagar in which one office bearer from all DAE units shall attend along with the office bearers of the unions and associations of DAE employees based at Mumbai. To extend solidarity, office bearers of affiliated unions and associations shall conduct DAY LONG FAST in all DAE units and hold meetings
· To Conduct Referendum for Strike among the employees, if the Department has not come forward for settlement

All affiliates are therefore requested to ready for spontaneous protest action at any time as the Department may issue order based on the recommendations of Dr. Suri. Exact date for the second and third stage of action programme shall be communicated within a day or two after the issue of Office Memorandum by DAE

All affiliates are further requested to mobilize among the members about the approach of the Department and the disparity existing among the employees of DAE & DOS.

LATEST INFORMATION:

It is reliably learnt that DAE is likely to be issue the Office Memorandum by tomorrow based on the recommendations of DR. Suri Committee. In that case all affiliates are requested to organize protest demonstration on 12th November 2008 in front of the Administrative Offices of the concerned units.

If the OM is issued by DAE tomorrow the Federation office Bearers available at Mumbai and the office Bearers of Mumbai Based unions and associations shall meet tomorrow (11.11.08) and will asses the Order issued by DAE and will finalise the future course of programme

The convention further authorized the Secretariat of the National Federation of Atomic Energy Employees (NFAEE) to inform that if the Department is not ensuring parity with the Pay structure of the employees of DOS, the employees will constraint to start protest action programme against the step motherly treatment which may lead to strike action.

It is therefore request you to consider the resolutions adopted in the Convention of DAE employees in right spirit and do the needful to remove the injustice which the employees of DAE

RESOLUTION ON PAY STRUCTURE FOR
DAE EMPLOYEES

The All India Convention of DAE Employees held on 9th November 2008 at the Multi purpose Hall, BARC Training School Hostel, Anushakti Nagar Mumbai unanimously resolved to urge the Secretary DAE to remove the anomalies arises while implementing the decisions of the Government on the Sixth Central Pay Commission with regard Part B of the First Schedule of the Notification issued by Department Expenditure, Ministry of Finance, Government of India on 29th August 2008.

The convention noted that the past experience of DAE Employees during the implementation of previous Pay Commission recommendations are not encouraging and always the employees got worst package comparing with the employees of other departments such as Department of Space (DOS). The impact of such treatment was continued even when 5th CPC recommendations were implemented in DAE.

By virtue of the such treatment, when a senior Group D employee of DOS reaches in the Pay Scale of 3050 – 4590 after second promotion, Group D employee of DAE has to wait one more promotion than that of DOS employees to reach in that pay scale. The reason is that DOS selectively adopted the pay scales Rs2610 – 3540 , Rs2750 – 4400 and Rs3050 – 4590 where as DAE was not ready to leave any scales in between and thus selected Rs2550 – 3200, Rs2610 – 3540, Rs2650 - 4000 (later Rs2610 – 4000) and then 2750 – 4400.

When a Technician of DOS reaches after 7 promotions in the pay scale Rs10000 – 15200, Tradesman in DAE has to face 8
promotions as DOS selected the pay scale of Rs8000 – 13500 after Rs6500 – 10500 where as in DAE after Rs6500 – 10500 the scale adopted was Rs7450 – 11500, then only Rs8000 – 13500, resulting in employees having more service getting lesser pay. Similarly when a Scientific Assistant/Technical Assistant of DOS reaches in the scale of Pay of Rs10000 – 15200 after facing just three promotions, a Scientific Assistant of DAE has to face 4 promotions as DOS selected the pay scale of Rs8000 – 13500 after Rs6500 – 10500 where as in DAE after Rs6500 – 10500 the scale adopted Rs7450–11500, then only Rs8000 – 13500. Scientific Assistant in DAE is not only losing pay, but down graded on comparison with the status of a Scientific Assistant/Technical Assistant of DOS, as a SA/TA of Space from Rs6500 – 10500 will be promoted into Rs8000 – 13500 which is equivalent to SO (C) where as in DAE a SA in the scale of pay of Rs6500 – 10500 will be promoted into the scale of pay of Rs7450 – 11500 and has to wait till next promotion to reach the grade SO (C).

By implementing the Cadre Review report successfully in the year 2003, the administrative, accounts, auxiliary, store staff of DOS got financial upgradation for various categories mentioned above in 2003 itself and correspondingly got fixation in the upgraded scales while implementing the CCS (Revised Pay) Rules 2008. In DOS Office Clerk in the grade of Rs3050 – 4590 has been phased out as part of the implementation of Cadre Review and extended financial upgradation to most of the employees by creating additional posts in the scales of pay of Rs4000 – 6000, Rs5000 – 8000 and Rs5500 – 9000. Whereas in DAE the administrative authorities continuously did their best to delay the finalization of upgradation/cadre review by forming committees after committee with an ulterior intention to forward the Cadre Review report for the consideration of SCPC. The Cadre Review is still alive only because of the firm stand taken by the SCPC by returning the Cadre Review file submitted by DAE.

Thus all section of employees of DAE – auxiliary, administrative, accounts, technical, purchase and stores – are getting step motherly treatment on comparison with DOS, though both Department coming under the administrative control of none other than Honourable Prime Minister and having the same Member for Finance. If these anomalies which are existing since the implementation of Fifth Central Pay Commission are not rectified, the convention of DAE employees feels that the degraded pay structure of the employees will be carried forward for next ten years or more and the DAE employees will be getting lesser pay and hence at a later stage lesser pensionary benefits too.

The convention noted that after the notification of the Government on revision of pay scales various ministries/ departments took initiative to ensure better pay structure and protect the promotional hierarchy and upgraded various pre revised pay scales to next higher pay scale and accordingly given better pay with higher grade pay. Even in certain cases such Departments had gone such an extent to recommend higher-grade pay for the merged pay scale, as the later becomes promotional pay scales. The Department of Space, CSIR under Department of Science & Technology etc carried out such exercises and got the approval from the Member for Finance and got implemented.

Hence this convention urges the Department to take all steps to implement the suggestions submitted by the National Federation of Atomic Energy Employees (NFAEE) to get justice while implementing pay structure for DAE employees.

As a first step this convention urges the Department should upgrade the pay scales on par with that of Department of Space to maintain parity in the pre revised pay scales by which,

· Senior most employees in Group D category shall get the financial benefits as the senior most employees in the pre revised pay scale of Rs2750 – 4400 which shall be upgraded into Rs3050 – 4590 and hence they will get fixation with higher grade pay.

· Department should upgrade the Technical post in the grade of Rs7450 -11500 to Rs8000 – 13500 and Rs8000 – 13500 to Rs10000 – 15200 and so on. (Tradesman, Foreman, Draftsman, Scientific Assistant, Nurses etc). As the second step the convention further urges the Department should consider the suggestions to extend higher grades at the entry level for Technical Staff, Promotional avenues for Auxiliary grades/cadres, upgradation of administrative, accounts, purchase & store staff etc should be dealt in consultation with similar Departments such as DOS for a permanent solution with a time frame. For which a committee should be constituted by the Department in tune with the committee to be constituted by DOS with equal participation of Official side and representatives of the employees.

The All India Convention of DAE Employees held on 9th November 2008 at the Multi purpose Hall, BARC Training Scholl Hostel, Anushakti Nagar Mumbai unanimously resolved to urge the Secretary DAE to ensure justice by revising various allowances and facilities based on the recommendations of Sixth Central Pay Commission (SCPC). The convention noted that certain allowances are Departmental issues and the Department has to take initiative to revise the allowances based on the revision in the pay structure where as in certain cases the Government has to take decision in which Department has to take initiative to protect the interest of the employees who are concerned.

Hence the convention of DAE employees urges upon to the Department that:
