PFRDA BILL INTRODUCED IN THE PARLIAMENT:





Dear Comrades,



The UPA Government re-introduced the Bill on PFRDA in the Parliament today (24.03.2011). It is to be recalled that he same was introduced by the earlier Government, but because of the opposition from the left parties, Government could not move with the bill.



It is pertinent to note here that the Joint convention of Confederation of Central Government Employees & Workers and All India State Government Employees Federation given a call to protest against the PFRDA Bill and decided to have protest programme if the Bill introduced.



As the Bill has been introduced today by the Government in Parliament, Confederation of CG Employees & Workers given a call to organize protest programme on 25th March 2011.



Copy of the confederation Circular is attached for ready reference.



All affiliates are requested to organize lunch hour demonstration on 25th March 2011 to express the opposition against the Governments decision.

THE ATTROCIOUS ATTEMPT OF THE UPA GOVERNMENT

TO REINTRODUCE THE LAPSED BILL



Dear Comrade,



The UPA II Government has today introduced the PFRDA Bill once again in the Parliament. The bill that was introduced earlier by the then Finance Minister, Shri P. Chidambaram, could not muster sufficient support to get enacted as the Left parties opposed it. Even though the enactment could not be made, the Government through executive fiat had converted the statutory defined benefit Pension scheme which is in existence for decades in the case of Government employees into a contributory pension scheme.



The All India State Government Employees Federation and the Confederation of Central Government employees had jointly taken the decision earlier to oppose the introduction of the Bill by organizing a two hour walk out programme. Accordingly we call upon all our Affiliates and State Units to immediately organize demonstration in front of all offices between 12 and 2 PM and mobilize the members for sustained serious programmes of action in the days to come. Intensive campaign programmes must be undertaken to bring home the pernicious impact the bill will bring about on the existing pensionary benefits of the Government employees. Besides, the funds accumulated from the contributions made by the employees as stipulated in the New Contributory Pension Scheme would be diverted to stock market for investment. Since the Government is to contribute equal amount as is being made by the employees, the new contributory pension scheme would be an unbearable drag on the exchequer and the sole beneficiary would be the big corporate houses. We must therefore embark upon a sustained struggle against the new scheme including a day's strike action as and when the bill is taken up for enactment by the Parliament.

Sub: Follow up action of the meeting held on 14th September 2010



Sir,



We would like to draw your kind attention towards the meeting we had with you on 14th September 2010 and the minutes of decisions thereof.



It was decided in the said meeting to form a small committee to analyze the pay structure chosen by DAE on the recommendation of the Sixth Central Pay Commission (SCPC) as the same created anomaly with other comparable scientific Departments. Even after lapses of 4 months the committee has not been constituted.



In the meanwhile we had an opportunity to appear before the Norms Committee constituted by the Trombay Council BARC, Wherein, we were asked to present our views on norms for career progression of technical staff, attendant, etc.



We pleaded with the Norms Committee that the de-merger of the pre revised scales of Rs.5000 – 8000 and Rs.5500 – 9000 was the most to enable and to maintain the horizontal relativity with other categories existing in this department –importantly this was the reference matter for Dr. Suri Committee. The action initiated by the Department to over come the merged pay scale has been further brought financial losses as well as career degradation comparing with other Departments.



Like wise, the career progression and the financial up gradation of ‘Attendant”, the erstwhile Group D employees also been put in stagnated position and the same also been again referred to norms committee. The analogy adopted by the DoPT while formulating MACP and also specific enabling order considering their past service into account for financial up gradation/promotion as the spend service was to be deemed to be the service in the present grade pay. If the yardstick prescribed by DOPT was adopted by DAE, the spent service varying from to 20 to 30 years in majority of the cases by the ‘Attendant’ would have been entitled for added financial up gradation with the promotion norms in vogue as on 1.1.2006 – leave alone the new norms.



The norms committee members expressed that these points to be looked into by the Department or the proposed committee and is not coming under the purview of the Norms Committee.



In the meantime, the office bearers of AEW&S Union, BARC taken up these matters with the Director, BARC in their meeting and the Director too stated that this is the subject matter for the joint committee to be constituted by DAE.



We feel that without addressing the problem of de-merger of pay structure for technical staff and the financial up gradation of Attendants, the norms committee may again meddling with the residential period of the existing categories of scientific, technical and attendants.



If the Norms Committee finalized its recommendation without considering this burning issue, it may further lead to wrongness in the forthcoming days.



Hence we request you to kindly treat the matter is urgent in nature and direct the officials concerned to set right the issues brought in by bilateral discussion with the office bearers of NFAEE at the earliest possible time.

Sir,

 
Reference is invited to the letter No. 3/4/2010 – IR &W/27 dated 15th February 2011 in response to our letter NFAEE letter No.NFAEE/SG/10/123 dated 15-09-2010.
In the above mentioned letter it was mentioned that the Director BARC constituted a Norms Committee vide Standing Order D38 2010 dated October 25, 2010 under the Chairmanship of Dr. A.K. Suri, Director, Materials Group, BARC to review the issues arising out of the formation of various recruitment and promotion norms and the Committee invited various Associations and Unions including NFAEE for presenting their view points. It was further mentioned in the letter that as the views of NFAEE will be taken into account while formulating the recommendation of the Committee for consideration of the Trombay Council there is no necessity to constitute additional Committee for this purpose.

 
In this regard we would like to mention the following:

 
The concepts of Joint Committee look into the various issues raised by the representatives of NFAEE is not going to full fill by hearing the view points of NFAEE by Norms Committee headed by Dr. A.K. Suri. It is pertinent to note here that in the introductory remarks, Dr. Suri categorically mentioned that the presentation is only an opportunity for expressing the views and no discussion on issues. Since it was a power point presentation with a time lime limit of 45 minutes a passing reference of various issues pertaining to various categories of non gazetted staff of DAE.

 
Where as the concept of the Joint Committee is entirely different as the committee will get an opportunity to debate on issues based on the various documents, precedence and can try to reach settlement on various issues based on a healthy bilateral discussion.

 
NFAEE strongly feel that a Joint Committee is very much necessary to go through the whole aspects of the discrepancies shaped after the implementation of the recommendations of Sixth Central Pay Commission (SCPC) by considering the developments in the Department that the Department has been constituted Committee after Committee under the permanent Chairmanship of Dr. Suri failed to resolve the basic issue resulted after its implementation and come out with surface finished solutions and later created further complications instead of removal of the anomalies.

 
NFAEE vide our letter No. nfaee/sg/11/026 dated 24.01.2011 brought out the discontentment among the employees to the notice of your good selves

 
In this situation the Department has to come out with immediate solution for bring confidence among the employees by

 
Stalling all directives to recovery of payment made by various DAE units

• Ensuring promotional benefits for Attendants and other auxiliary staff based on the service they rendered in the Department

• Constituting Joint Committee as promised by your good selves for a joint retrospection to resolve all discrepancies, anomalies, and irregularities created after the implementation of the recommendations of SCPC and ensuring the seniors pay and status.

We hope you will consider this as most urgent and will take initiative to resolve the justifiable demands of employees. By which the department also can ensure the whole hearted support to achieve the goals.

I hereby issuing Notice for holding 4th All India Conference of National Federation of Atomic Energy Employees (NFAEE) from 18th December 2010 to 20th December 2010 at the Multi purpose Hall, BARC Training School Hostel, Anushakthi Nagar, Mumbai 400 094. The Conference hsll start at 9.30 am on 18th December 2010. The Agenda for the Annual Conference is given below:


i) To read and confirm the minutes of the previous conference held at Manuguru.


ii) To adopt working report.


iii) To adopt the audited statement of accounts


iv) To appoint Auditor(s) and fix their remuneration.


v) To act as an appellate authority in matters pertaining to the affairs of Federation.


vi) To elect the office bearers as mentioned in Article 19 and the members of the General Council as mentioned in Article 16.


vii) To consider any resolution for which the due notice has been given.


vii) To formulate the charter of demand.


ix) To take such matters not herein specifically provided for with the permission of Chairman.


x) Amendment in the constituition.

With great pleasure we would like to intimate all affiliates and sister orgnaisations that a Reception committee has been formed to conduct the 4th All India conference of NATIONAL FEDERATION OF ATOMIC ENERGY EMPLOYEES (NFAEE) from 18th to 20th December 2010 at the Multi Purpose Hall BARC Training School hostel.

A meeting of the office bearers and activists of union and associations affiliated with NFAEE (AEWSU – BARC, DCSEMSA – DCS&EM, AIAEDPS (Stores) SA - DPS, DPS DAE (Purchase) EA – DPS, HWBEA – HWB, BRITSA - BRIT) , BARCOA, Teaching and Non Teaching Staff Associations, Atomic Energy Retirees Organisation & ARWA was held on 26th October 2010 at the ARWA Hall, Anushajkthi Nagar Mumbai.

Com. Jayaraj KV, Secretary General NFAEE, briefly explained the importance of the Conference and proposed the programmes. P.M.Worlikar (Secretary Staff Side), A. Sreedharan (AEWSU), RS Thokle (HWBEA), Sunil Pawar (DCSEMSA), R.C Durve (AIAEDPSSSA), KG Bilaskar (DPSDAEEA), R.K.MIshra (BARCOA), Anil Jadhav (Teaching Staff Association), Rajan Gaikwad (Non Teaching Staff Association), N.J.Shukla (ARWA), M.P Sankaran (AERWA), etc were participated in the deliberations and assured full co operation to make the conference a grand success.

 
The meeting elected a Reception Committee consist 101 members with the following Office Bearers:

Com. P.M.Worlikar Secretary

Com. S.R Singh Treasurer

Presidents and General Secretaries of the affiliated unions and associations stationed Mumbai Shall be the Vice President & Joint Secretaries of Reception Committee. Presidents and General Secretaries of other sister organizations shall be the Executive Committee members. Com. Jayaraj KV, M. Sangiah, H.C.Tiwari (NFAEE office bearers stationed at Mumbai) shall be Ex officio Members of the Reception Committee.

 
The meeting also elected various sub committees for co ordinating the functions of the Reception Committee as well as to conduct the Conference effectively.

 
The Meeting proposed the following programmes to be hold along with delegate session:

 
Inaugural Session

• Seminar on Trade Union Movement

• Seminar on Nuclear programme

• Convention of Working Women

• Interactive session with sister organization in the Department, Department of Space, DRDO including Officers Association

Cultural programme

 
The meeting adopted a budget of Rs5 lakhs for the conference and decided to rise the fund through collection from the employees of DAE, delegation fee, sponsorship from various organizations, publishing Souvenir etc. To collect the donation from employees it is also decided to print donation coupon of Rs 100/- and blank receipt for collect donation more than Rs 100/-. The meeting also decided to print and distribute an appeal for collecting advertisements for Souvenir immediately.

First meeting of the Executive Committee shall be held on 28th October 2010 and finlaise the formation of various sub committees, tariff for the advertisement for souvenir, delegation fee, etc.

 
The meeting was presided by Com. PM Worlikar, President AEW&S Union BARC. Com. Jayaraj KV, Secretary General NFAEE welcomed the gathering and Com. KG Bilaskar Treasurer extended vote of thanks to the participants.

Sub: Resolution adopted in the

ALL INDIA CONVENTION OF DAE EMPLOYEES held on 31st July 2010



Respected Sir,


Please refer our letter No nfaee/sg/10/083 dated 2nd August 2010 seeking an appointment in the second week of August 2010 for submission of the resolution adopted by All India Convention of DAE Employees held on 31st July 2010 at the Multi Purpose Hall, BARC Training School Hostel Anushakti Nagar, Mumbai. For the reason of your busy schedule, your offices could not spare the time during that week, so we submitted the copy of the resolution to your office on 13th August 2010.



However we are pleasurable for allowing us to meet you in person to hand over the Resolution which contains the demands pertaining to the DAE employees pending unresolved for long time.



The major issue we feel is that the failure of the Department to continue a healthy interaction with the elected representatives at various level. Although the Federation was recognized by the Department in the year 2007, only three meetings had been convened with the Secretary DAE. It is a sorry to state that the meeting with Secretary and the representatives is only an after effect of notice for strike. The last meeting with the officials was held on 18th February 2009. That too was after effect of STRIKE NOTICE. In the meeting a decision had been consciously arrived to work out a methodology and would be adapted to hold periodic meeting with NFAEE to resolve the issues raised by the NFAEE and its affiliates.



But even after lapses of 18 months, not a single meeting even at the level of Joint Secretary has been convened. In the month of October 2009, NFAEE sought an appointment with the Secretary DAE to discuss various issues, especially the discrepancies created while implementing various recommendations of the Sixth Central Pay Commission (SCPC). Not only meeting has been arranged but also not obligatory response to the various letters addressed. When ever, this Federation approaches the office of the Secretary/DAE, the ready made excuse is the busy schedule of the Secretary. Even after new Secretary took charge, even a courtesy meeting too could not be arranged either the Staff relations officials of DAE or Office of the Secretary.



During this period, a number of letters have been written to the Secretary, Additional Secretary to take necessary proper action to resolve the issues. But, DAE never communicated to this federation – leave alone the letters addressed by our affiliates- what action has been initiated to resolve the problem brought to the notice of the Department.



The JCM functioning in DAE become derision. The Departmental Council meetings are now a day becomes a futile exercise. The Chairman of the Department Council (unique from all other central Ministries/ Departments where Secretary to Government is the Chairman of DC) doesn’t have the time to chair the meeting full day to discuss and settle the issues. Lakhs of rupees are being spent to convene the meeting that too without adequate notice and finish the meeting within hours without any meaningful decisions.



The agenda items submitted for discussion in the DC meeting has been unilaterally taken out and the staff side kept in dark on issues. In the earlier days the Chairman of DC was prepared to sit even two days to complete the proceedings and even small group meeting was arranged to follow up the decision taken. DC meeting become for the sake of calling meeting and treating Joint Consultative machinery in a disdain mood. Earlier days the date of the ensuing DC meeting was tentatively fixed in the meeting itself and strictly adhered to the date also, but now not ready to confirm the month in which next DC will be held.



There are laid down norms for the functioning of Joint Consultative Machinery. But DAE is not bothered about on such norms. If a cursory look at the functioning of our JCM Scheme, it is very much evident that JCM is treated as untouchable. No issues have been concluded in the last so many years. Even after given right up and supportive documents with agenda items, the Chairman simply asking the staff side to submit papers like imposition and simply delay the decision on issues.



Though not liking, let allow us place that the atmosphere created in the Department of Space by sharing the information with the representatives of the employees. The Chairman Space Commission regularly meets the office bearers of the recognized organizations at regular interval and shares the views. He spare times to Chair the Departmental Council meetings regularly resulting in time bound decisions thus effective exploitation of JCM.



In this circumstance the approach towards on the recognized Federation, unions and associations to be reviewed by the Department in a spirited mutual manner and initiate a confidence building measures to deliver the effectiveness of bilateral discussion. A proper system as promised shall be evolved for frequent interaction with the office bearers of NFAEE to sort out the issues raised time to time as the present system of JCM is contending only to Group C employees.



It is therefore we request you to convene a meeting of the office bearers of NFAEE at the earliest to discuss the issues submitted along with this letter. The list of the office bearer is also attached. Since the office bearers of NFAEE are representing various DAE units across the country the date of the meeting may be communicated to all officer bearers in advance so that they can reach at the place of the meet in time. The copy of the resolution adopted in the All India Convention of DAE Employees held on 31st July 2010 is attached herewith



Lastly let we quote Hon. Prime Minister Dr. man Singh’s Independence Day Speech



Discussion and dialogue are the only options to resolve complex issues. As far as the Central Government is concerned, we are ready to take forward every process of talks which could lead to progress in resolution of problems.

CHARTER OF DEMANDS

PART I

1. Price rise of essential commodities to be contained through appropriate corrective and distributive measures like universal PDS and containing speculation in commodity market.



2. Concrete proactive measures to be taken for linkage of employment protection in the recession stricken sectors with the stimulate package being offered to the concerned entrepreneurs and for augmenting public investment in infrastructure.



3. Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.



4. Steps to be taken for removal of all restrictive provisions based on poverty line in respect of eligibility of converge of the schemes under the Unorganized Workers Social Security Act 2008 and creation of National Fund for the Unorganized Sector to provide for a National Floor Level Social Security to all unorganized Sector workers including the contract/casual workers in line with the recommendation of National Commission on Enterprises in Unorganized Sector and Parliamentary Standing Committee on Labour.



5. Disinvestment of shares of Central Public Sector Enterprises (CPSEs) is not resorted to for meeting budgetary deficit and instead their growing reserve and surplus is used for expansion and modernization purpose and also for revival of sick Public Sector Undertakings.



6. Fill up all vacant posts and lift the ban on recruitment.



7 Stop outsourcing/contractorisation of Governmental functions



8. Regularise all daily rated workers/employees/;Grameen Dak Sewaks and remove the ceiling on compassionate appointments; end the discrimination in the bonus ceiling of GDS employees.



9. Withdraw PFRDA bill and extend the statutory defined benefit pension scheme to all Government employees



10. Guarantee right to strike as a fundamental right of employees.



PART II



1. Initiate bilateral discussion with NFAEE to settle the long pending issues of the DAE Employees which is annexed as Annexure I

ANNEXURE I

CHARTER OF DEMANDS



01. Permanent arrangement to have bilateral discussion with NFAEE on various issue



a. Meeting with Secretary DAE – at least once in six months

b. Meeting with Additional Secretary – at least Once in four months

c. Meeting with the Joint Secretaries – At least every Alternate Months



02. Remove Discrepancies in the Pay Scales and other facilities after the implementation of SCPC recommendations:



a. Pay parity with DOS, as the pay scale of DAE is inferior to DOS pay scales.



b. Protection of fixation benefit on promotion in the merged pay scales in the cases of Scientific Assistant B, Tradesman F, and other equivalent post.



c. Protection of fixation benefit on consequent upon on the upgradation of the pay scale of Mali D/Helper D from the pay scale of Rs2750 – 4400 to Rs3050 -4590



d. Protection of fixation benefit on promotion in the merged pay scales in the cases of Senior Clerk and Assistant and other equivalent post



e. Revise the revised promotional norms issued by DAE/TC which are detrimental to the career and benefits of the Scientific Assistants, Technicians, Attendants, etc.



f. Re-establish the benefit of track change during promotion for Scientific Assistants, Technicians, and Attendants



g. Cadre restructuring of auxiliary staff (Mali, Helpers, Drivers, Security Staff, Canteen staff) to ensure the promotion benefit on par with Department of Space



h. Revise the changes made in the nomenclature of auxiliary staff by converting them as “Multi Skill Staff” and retain the grades of Tradesman personnel to them. Conversion of Attendant to Technician (without any condition) for those who are working in radioactive areas as well as technical/workshop field.



i. Over and above speedy rectification of the discrepancies raised out of the selection of pay structure, revision of norms, etc.



03. Entry level pay for the Technical Staff in the pre revised pay of Rs4000 – 100 – 6000.



04. Uphold the Solomon affidavit given by DAE in the Supreme Court to maintain status, pay & allowances of Scientific Assistants on par with the Scientific Officers in the corresponding grades and mitigate the financial losses



05. OTA revision for R&D and other non industrial unit.



06. Revision of other allowances such as NRPSA, Qualification Incentive, NDA, etc



07. Formulate Promotional norms for Canteen Staff, Security Staff, taking into consideration of the existing employees’ long innings.



08. One more option to switch over from CPF to GPF for Technical Staff.



09. Mitigate the loss in pay due to the merger of pay scales S2 &

S3 as S2A (elongated pay scale) being done in the year 2002.



10. Continuation of Transport Facility.



11. Initiate steps to change the allotment rules based on the basic pay (Pay in Pay band + Grade Pay) corresponding to the pre revised pay to ensure allotment on seniority in place of Grade Pay



12. Withdraw the clarification Order issued by DAE to deduct the PRIS in proportion to the Earned Leave availed in the year 2009 - 2010. Initiate steps to ensure the Bonus to employees who are not getting PRIS



13. Stop the contractorisation/outsourcing



14. Fill all vacant posts



15. Lift the 5% ceiling on compassionate ground appointment
